3 Piombino has been included in the sites of national interest (SIN) under article 1, clause 4 of the law 426/98, and the boundaries of the area were defined in the Ministerial Decree of 1 January 2, with later modifications to enlarge these in the Ministerial Decree of 7 AprilA 26, as published in the Gazzetta Ufficiale n 147 of the 26 June 26 The SIN of Piombino is made up of: A land area of 93 ha A sea area of 2,15 ha Boundaries of the Piombino SIN

This is evaluated on a case-to-case basis, considering the quality and quantity of the sediments that are not in conformity and the legitimate use of the area in question (such intervention values are proposed by ICRAM to the Ministry for the Environment and the Care of Water and the Seas under the protocol n 264/6 of 21 March 26).

9 The definitive reclamation project for the seabed in front of the Marinai d Italia wharf, approved by the Ministry of the Environment and Territorial Protection on 28 September 24. The reclamation intervention has been carried out by way of the mechanical removal of the contaminated sediments and their succeeding removal to an infill basin. In detail, the reclamation operations involved the removal of a total quantity of 93, m³ of marine sediments.

11 ENVIRONMENTAL MONITORING DURING RECLAMATION/DREDGING ACTIVITIES The priority objective of the monitoring plan to evaluate the effects of activities connected with dredging in the water space in front of the Marinai d Italia wharf in the port of Piombino was to environmentally safeguard the areas involved in activities of dredging, transport and storage in infill basins of the sediments arising from the reclamation. This was to be brought about through checking certain environmental parameters which could have been influenced by reclamation activities (re-suspension of sediments, turbidity, mobilisation of contaminants) and their interaction with the biota. Monitoring was carried out not only during the activities outlined above, but also during the periods before and after, in order to verify any possible variation in the conditions of the environmental parameters involved, and to verify that the conditions existent prior to beginning dredging were restored at the close of such operations.

12 The monitoring plan: investigative fields The chosen monitoring system to evaluate the effects that activities of excavation, transport and backfilling into the basins might have had on the surrounding marine environment was articulated as: - monitoring the changes in the physical and chemical characteristics of the water column; - determining the bio-accumulation and analysing bio-markers in bivalve molluscs transplanted to the areas under investigation (Mussel Watch); - analysis of outflow waters from the basin; - analysis of waters collected in pietzometers installed around the edge of the basin; - analysis of surface sediments close to the backfill basins.

13 The monitoring programme - sampling sites. In order to carry out the monitoring as mentioned above, on the basis of existing knowledge of the marine area under investigation, a system of fixed sampling sites was set up within the area involved in such a way as to permit the following typologically different areas: - area to be dredged (port), - area of stocking and the stretch of sea in front of the basin (basin), - control area on the external side of the Molo Batteria breakwater (white).

30 WHERE THEY ARE - in the Environmental Code article 185 Exclusion from the field of application clause 4: Saving those obligations deriving from specific Community standards, the following are excluded from the field of application of this Fourth Part of the present decree: those sediments moved within surface waters for the management of such waters and watercourses, or for the prevention of flooding, or for a reduction in the effects of flooding or of drought or of soil reinstatement, if it is proven that the sediments are not dangerous as under the decision 2/532/CE of the Commission of the 3 May 2, together with subsequent modifications. - Law n. 84/94 article 5 bis as modified - -National Reclamation Programme - MOBILITY
