2 Low Emission Strategies Definition Provide a package of measures to help mitigate the transport impacts of development by accelerating the uptake of low emission transport fuels and technologies in and around new development
3 Why low emission strategies? Current guidance looks at significance e.g. London Councils, NSCA Provide grounds for refusal and recommend mitigation measures Many AQ assessments show a not significant impact on air quality Low Emission Strategies are targeted at all categories of development, including those regarded as not significant or a low priority consideration
4 What do you need? Central Government Policy: Planning Policy Statement PPS 23 Local Development Policies: Unitary Development Plan (soon to be Local Development Framework) Planning Obligations Supplementary Planning Document AQMA (optional) Air Quality Action Plan
5 Planning Policy Statement 23: Planning and Pollution Control Local Air Quality Management Declaration of AQMA impacts on development planning and planning control decisions Partnership-working between all departments is required when: Taking any development control decisions which may have a direct or indirect bearing on existing air quality or creating exposure to poor air quality
6 Using Section 106 Agreements PPS23 Annex 1: Pollution Control, Air and Water Quality Planning Obligations not appropriate to use planning conditions to address the impact of a proposed development Uses of Section 106 Agreements: i. Improve air quality ii. Make other environmental improvements before a development goes ahead or offset the subsequent environmental impact of a proposed development In particular the purchase, installation, operation and maintenance of air quality monitoring equipment or provision of other assistance or support to enable authorities to implement any necessary monitoring or other actions in pursuit of an Air Quality Action Plan.
7 Impact on ambient air quality is likely to be particular important: a) Where the development is proposed inside, adjacent to, a AQMA b) Where to grant planning permission would conflict, or render unworkable elements of a Local Authority Action Plan Explore suitable mitigation measures
8 Unitary Development Plan Policies Strategic policies to include: Encourage environmentally sustainable development Protect and improve environment in terms of air and water quality, reduce impact of pollution, noise, smell, especially from transport Specific policy to: a) resist proposals resulting in a deterioration in air quality unless measures are included to minimise the impact of air pollutants and; b) requiring mitigation measures in in areas of poor air quality.
9 Purpose: Supplementary Planning Documents (SPD)s Deliver financial contribution towards AQ Provides advice on how contributions will be assessed and the process by which contributions will be sought Helps to strengthen development and delivery of LES - by Model Section 106 Low Emission Transport Strategy
10 Greenwich s Formula for Financial Contributions A standard contribution will be sought of: 100 per dwelling for residential development, 44 per bedspace for residential education institutions, prisons and other secure residential facilities 10 per m2 for town centre and business developments at or above 500m2
11 Model S.106 Low Emission Transport Strategy Construction phase: All HGV s and LGV s (3.5 tonnes and over) to be Euro 4. All Non-Road Mobile Machinery (NRMM Ultra Low Sulphur Diesel (ULSD). All (NRMM) shall comply with either the current or previous EU Directive Staged Emission Standards. NRMM shall be fitted with Diesel Particulate Filters (DPF). The defined performance of DPF shall be ensured through a programme of on-site checks.
12 Operational phase: Commercial vehicles shall be Euro 4, with target quotas of at least 50% of Euro 5 or better by 1st January Euro 5 for 100% of commercial vehicles by 1st January 2013, with further target quotas for Euro 6. By 1st January 2015 timetable for the introduction of at least 50% Euro 6 vehicles by Managed parking to be Euro 4 standard, with at least 50% to be Euro 5 by 1st January % Euro 5 by 1st January Incremental supplement on residential vehicles based on Carbon Dioxide emissions (separated over 5 emission-based bands). Revenue used to support the car club or other agreed low emission initiative. AQ Monitoring required as part of the Construction CoP and/or enabling the LA to implement their AQ Action Plan.
13 April 2003, development of the Millennium Dome, subject to LEZ being agreed February 2004, S.106 Agreement was signed, provision for LEZ and AQ monitoring 2005, GMV granted second phase approval. Enlarged Peninsula LEZ, includes carbon dioxide emission reduction criteria First LEZ in the UK
14 Example Woolwich Town Centre Planning Application Major mixed use scheme in Woolwich town centre i.e. 960 residential accommodation, community and/or offices, retail store, retail, food and drink units, 1,172 parking spaces and cycle parking Whole borough is a Air Quality Management Area for nitrogen dioxide and particulates Woolwich town centre has good accessibility PTAL=6 Air quality implications include operational impacts, construction impacts, traffic growth, car parking and air quality monitoring
15 Planning Obligations we achieved via Section 106 Agreement Provision of a car club 500 residential spaces annual charge depending on VED rating of car Controls on parking permits and transfers Ten electric vehicle charging points within the residential car park 50% of delivery vehicles and 50% Home delivery vehicles to meet Euro 5 rating by store opening 100% within 5 years. To report on the implementation of the Low Emission Zone measures and targets on store opening and at five and ten years afterwards 16,000 per annum for ten years towards Council s Environmental Monitoring (total 160,000) 10% renewable energy commitment BREEAM excellent rating CHP plant including community heating

18 How do we achieve it? (cont) Engagement Ensure that engagement between the key partners and the applicant starts early in the process:- at the pre-application stage when planning application is first received Negotiation Be positive in the approach to securing S.106 contributions and mitigation. Key partners should be prepared to participate in the negotiation.
19 Challenges & Solutions Implications of the credit crunch, fewer developments time to pursue policies Fear that developers will develop on a site in a different LA: a) let them b) consult with them c) develop policies with neighbouring authorities
