1 POLAND - COUNTRY REPORT 1.1 Response from questionnaire Preliminary questionnaire by Working Group, filled in by The Building Research Institute (ITB) Questionnaire filled in by The Building Research Institute (ITB) Questionnaire filled in by Office General du Controle de la Construction, shortened hereafter as OGCC correspondence with ITB, resulting in a combined answer for ITB and OGCC. 1.2 Rule Type of regulation Governmental Law - performance based, a set of governmental regulations on technical conditions to be fulfilled by different types of structures and their localisation. There is also the Act on spatial planning with general rules National strategy and implementation The adoption of the sustainable development idea is supported by several national strategies and policies, for example: National development strategy setting general priorities on sustainable development and competitiveness and innovativeness, National ecological plan setting priorities on Green Public Procurement, green reform of the tax and green workplaces Energy Policy of Poland - promoting energy efficiency, use of energy from renewable energy sources, reduction of CO2 emission and use of environmentally friendly technologies. There is no strategic approach to sustainablity in construction. Sustainability aspects in different life cycle stages are under responsibility of different bodies and the choice of private parties involved in works on new acts may differ, depending from the assumed targets of regulation. There is no form of public forum which would be organised specially for sustainable construction. The main problem which prevents the effective implementation of sustainable construction is the separation of competences and responsibilities. For example, the regulatory provisions concerning performances of construction objects or construction products are under responsibility of Ministry of Infrastructure, issues connected with eco labelling are under responsibility of Ministry of Environment and supervision on LMI initiatives on sustainable construction is carried out by Ministry of Economy. Without governmental strategy for implementation of sustainable construction and with lack of coordination between responsible bodies, the effective adoption of sustainability issues may be problematic. Regulation will be however one of driving measures for implementation of the idea of sustainable construction - establishment of a national for building s sustainability assessment, adopting eco-labels into national regulations as proof of evidence (for example, of sustainable use of natural resources). 2 The other problem for sustainable construction in Poland is low cost competitiveness of environmentally friendly products or technologies. Without strong regulatory, financial or fiscal support their market effectiveness is still very poor Regulated sustainability topics for new buildings There are no specific voluntary or mandatory requirements concerning sustainability of buildings or construction products in the national building regulations. Even though there are existing assessment standards (not normative) for environmentally friendly construction products (EKO ITB), they cannot be used by the manufacturers or designers as a mean to confirm compliance. Sustainable issues are implemented by separate regulations concerning energy efficiency, use of energy from renewable resources, CO2-emissions, ozone depleting gas emissions, greenhouse gases emissions, impacts on environment etc. Many environmental, social and economic aspects are aggregated in the Ordinance of the Ministry of. Ecological quality: Many aspects of the ecological quality are currently covered by different governmental acts and regulations setting general requirements on environmental protection (applicable not only for construction). Example: Environmental Law from 27th of April 2001, Act of 17 July 2009 on the System to Manage the Emissions of Greenhouse Gases and Other Substances., The Act of 20th April 2004 on the ozone-depleting substances. Requirements aimed at reduction of energy consumption refer mainly to renovated buildings. For the new buildings only threshold levels of energy performance are set. The separation of waste is regulated on a local level. In the future, regulation will be set for implementation of water efficiency techniques (e.g. low-water flush toilets) and recycling of materials. For economic quality there is only regulation at local level for the density of the development (e.g. minimal number of dwellings per area). Many social aspects are regulated by different laws: e.g. act on spatial planning, act on social care. For functional quality and technical quality there are many aspects aggregated in the Construction Law and by buildings and their localization Rules for existing buildings and for renovation of existing buildings In case of renovation of buildings there is regulation on energy performance, and social, functional and technical quality. 3 implementation of water conservation techniques registration of waste production limitation of ozone depleting gasses provision of safe and healthy work environment moisture protection of the building electric magnetic shielding acoustic comfort structural safety fire resistance/safety Ordering of the regulations The regulations apply to all types of buildings Type of requirements and deemed-to-satisfy solutions Most regulation is prescriptive. Only the requirements on energy performance and functional and technical quality are performance based. In some cases it was also difficult to estimate if a certain group of regulations is performance based or prescriptive - sometimes there is a mix of both types of requirements. There is no documentation on deemed-to-satisfy solutions Process of implementation It was mostly a top-down (government led) process, with help of other parties (like universities). The best and the most significant example is the process of implementation of EPBD. Previously, Poland had national regulations on energy performance, but the process of implementation of directive 2002/91/EEC revealed various problems with the new methodologies. It took 3 or 4 years to achieve an agreement between different parties (some universities were quite active in this field) and find the consensus. What is more, in order to make the law acceptable to all parties, legislators decided to leave alternative in the form of both performance and prescriptive (U - values) requirements on energy efficiency of buildings. Over a year after the implementation, the adopted methodology is still non acceptable for some parties. 1.3 Enforcement regime For the building permit, building plans are visually checked by the municipality (or his technical advisor) on energy performance, social quality, functional quality and technical quality. Work under construction is checked on energy performance, functional and technical quality, by the municipality (or his advisor) or the architect. Existing constructions/buildings are checked on several sustainability aspects. 1.4 Sustainable construction initiatives including public and joint public-private initiatives The relationship between government regulation to sustainable construction and complementary sustainable construction initiatives is difficult to define. There is no clear mechanism of implementation of the results of voluntary initiatives into national regulation. There is no coordination (e.g. in the form of national strategy) to develop a coherent of regulation and voluntary measures. Y , Screening nat. building regulations - Poland febr. 2011

4 Example 1: Inventory and development of technical assessment measures In early 2009, the Building Research Institute (ITB), in a framework of statutory projects, started a research work on the development of inventory of technical assessment measures, which could be used in the formulation of a national strategy for sustainable construction. The project will take into account simple technical measures as energy consumption, waste production or water consumption, measures based on life-cycle approach, such as eco-labels or eco-design scheme, building sustainability assessment schemes, measures concerning the use of environmental or energy management and other technical, economical, social and environmental issues which may be found in national regulations or normative references connected with sustainability aspects. These measures will be connected with defined national targets concerning environmental, social and economical pillars of sustainability. ITB is also going to formulate a set of implementing mechanisms as: regulation, public procurement, innovation and competitiveness stimulation, education and training which shall use the most appropriate measures. The project takes into account basic guidelines for the best practice formulated in Guidance in Preparing a National Sustainable Development Strategy, submitted by UN Department of Economic and Social Affairs (UNDESA). Studies on Life Cycle Analysis of construction products are carried out in Building Research Institute, as well as at several Technical Universities. ITB is also working on the environmental labelling of construction products (EKO-ITB scheme) and on the sustainability assessment for buildings. There is no public or governmental body responsible for national coordination of strategic initiatives concerning sustainable construction. 1.5 Role of EU On the question: Do you see any role for the EU to stimulate sustainable construction in your country?, ITB answers: Yes, EU may provide us a framework of sustainability assessment in the field of products, construction works and services, guidelines on strategies and regulation change programs. But on EU-level, ITB also identifies potential inconsistence between EU regulations, Commission initiatives and the standardisation works. The problem concerns mainly the different EC initiatives regarding environmental performance and characteristics of construction products or buildings, as Energy Label, Eco design, Green Public Procurement Criterions, and standards supporting the implementation of EPBD developed by CEN/TC 371, standards developed by CEN/TC 350 concerning sustainability assessment of construction works, or CEN/TC 351 concerning the assessment of the release of dangerous substances from the construction products. There is potential for the lack of consistence between requirements of specifications under Eco design Directive, with its range extended over energy related construction products, and the Environmental Product Declarations, developed under mandate M 350. 5 Legislation and key issues Some of the key issues in sustainable construction include the following: Although large panel or slab construction in multi-storey construction is already a thing of the past, housing construction is still pre-dominantly highly expensive technology and materials (durable and solid structures). In Poland there are mandatory engineering standards defining permissible technical, technological and material applications or techniques in housing (in particular concerning energy-saving s, especially insulation). In Poland there is no mandatory of urban standards defining permissibility of spatial applications. The basic issues in this field are regulated by fire protection norms, safety rules, constructions law etc. Construction in urban areas Dwelling house and any other construction, both in towns and in rural areas, require a building-permit from the local authority and is conditional on compatibility between the planned measure and regulations mentioned above. If the regulations, norms and standards are fulfilled, a final decision concerning construction technology or technique is merely an investor's business. Local authorities are subjected to pressure on the part of investors as regards infrastructure construction, which is the local authority's exclusive competency. Local authorities in giving a building permit, exert pressure on investors to follow principles based upon rational spatial planning (for instance, parking spaces incorporated into buildings, size of buildings, physical planning in the immediate neighbourhood of the building, etc.).
