1 APPRENTICESHIP Procurement

2 The Nova Scotia Apprenticeship Agency engages Nova Scotia employers and industry; designates trades for apprenticeship training and certification; registers and monitors apprenticeship agreements; assesses, counsels and certifies apprentices and skilled tradespersons; sets standards for apprenticeship technical and workplace training; recognizes credentials and supports labour mobility issues; participates in the national Red Seal program and jurisdictional initiatives. The Agency is responsible, under the Operating Charter, for: stewarding and operating a relevant, accessible and responsive industry-led trades training and certification system, and; for improving access to and participation in the system by Aboriginal persons, African Nova Scotians, differently-abled persons, immigrants, women and members of other under-represented groups.

5 Sustainable Procurement Policy 5 Procurement Manual (released October 1, 2016) states: Increasing employment opportunities for apprentices and youth is a priority for the Province. For Procurement Projects involving work within the designated trades, Public Sector Entities are encouraged to consider ways to support the use of apprentices. 6 Sustainable Procurement Policy - Training 6 Fall 2016: staff participated in training all procurement category managers to ensure procurement staff are aware of the possibilities to advance apprenticeship in the province and the legal requirements of the compulsory certified trades. Training was also delivered to para-government organizations. staff participated in the Reverse Trade show to educate industry on the Policy and to encourage industry to become engaged in the apprenticeship system.

8 PROCUREMENT PILOT in the ICI Construction Sector 8 In January 2016, the Nova Scotia Apprenticeship Agency in partnership with the Department of Transportation and Infrastructure Renewal and the Construction Association of Nova Scotia, introduced requirements whereby contractors bidding on provincially funded construction projects must be engaged in the Apprenticeship Program. This project aims to increase employer participation in apprenticeship training with a requirement for contractors to have apprentices employed when building schools in Nova Scotia. SCOPE For the first year, the Pilot Project applies to the five Government of Nova Scotia new school construction contracts; All construction work that falls within the scope of one or more of the designated trades as defined in the Apprenticeship and Trades Qualification Act; All contractors whose portion of a bid is equal to or exceeds $100,000.

9 9 PROCUREMENT PILOT cont d LETTER OF ENGAGEMENT A letter of engagement will be sent to any contractor that: has all apprentices registered and have at least one apprentice registered anytime within the last 2 years in any designated trade or have participated in a Youth Apprenticeship Program (ie, Building Futures for Youth, Workit, etc.); o Although preferred, the registered apprentice does not have to be directly o employed at the contract site; Although preferred, an apprentice does not have to be registered in Nova Scotia to be considered. However, the contractor will be required to provide proof of the apprentice s registration in another jurisdiction; is in compliance with the Apprenticeship and Trades Qualification Act and Regulations; and provides a written commitment from the contractor to continue to employ apprentices during the period in which the contractor performs work under the contract.

10 10 PROCUREMENT PILOT cont d LETTER OF EXEMPTION A letter of exemption will be sent to any contractor who: does not engage in work within a designated trade as defined in the Apprenticeship and Trades Qualification Act; employs less than three persons during the term of the contract; works in one of the designated trades where apprenticeship training is not offered; or At the discretion of the Director of Programs and Operations, Nova Scotia Apprenticeship Agency who adequately demonstrates that he/she has limited ability to hire an apprentice may be eligible for an exemption.

11 11 PROCUREMENT PILOT cont d PROCEDURES To be eligible for award of a contract, general contractors must submit, within 48 hours of a request, either a Letter of Engagement or a Letter of Exemption issued by the Nova Scotia Apprenticeship Agency. General contractors are also responsible for ensuring that all subcontractors engaged in work in a designated trade, whose portion of the bid exceeds $100,000, also submit a Letter of Engagement or a Letter of Exemption from the Nova Scotia Apprenticeship Agency. In order to be deemed compliant, general contractors will be responsible for providing the necessary documentation from subcontractors within 10 days of contract award

12 12 PROCUREMENT PILOT cont d To date, 78 contractors have submitted an application for either a letter of engagement or a letter of exemption. There has been an even split between letters of engagement and letters of exemption issued. Almost all of the letters of exemption have been issued because the contractor does not engage in work within a designated trade as defined in the Apprenticeship and Trades Qualification Act. The majority of the applicants (90%) were sub-contractors 21% of which are a member of a Joint Registration Agreement (JRA). The remaining applicants were general contractors (10%), 2 received a letter of engagement and 6 received a letter of exemption. The Nova Scotia Apprenticeship Agency is committed to responding to all applicants within 5 days of receiving an application. It is important to note that 99% of the applications received to date were completed within 24hrs or less. The only exception was when was waiting on confirmation of employer engagement from a JRA holder.

For example: Ensure that any catering is provided by an employer who has a Red Seal chef or apprentices on staff Ensure that any landscaping company hired has a certified landscape horticulturalist on staff
