1 Course Description: The law requires that all Managers and Supervisors be familiar with the Occupational Health & Safety Act (OHSA; "the Act") and its regulations, plus industry best practices, CSA Standards and published guidelines. Managers and Supervisors at conventional businesses, in Provincial or Municipal governments or any other type of organization or business interest that employs workers, including those in the Not-for-Profit sector, must know the requirements under the Act, their duties and responsibilities, and what constitutes due diligence. In addition, they must implement and maintain a strong "Internal Responsibility System." Participants in this course will learn how to conduct workplace inspections, hazard recognition, assessments and develop appropriate control measures. Reporting procedures and investigation of workplace accidents will be covered in detail. Participants will also learn about the Internal Responsibility System and Bill C-45 of the Criminal Code of Canada, covering prosecution of workplace-related infractions. This course consists of one full day of intensive training (8 hours of teaching time) This course meets or exceeds the employer s legal responsibilities as cited by the Occupational Health and Safety Act, Ontario Ministry of Labour guidelines and CSA Standards. Proper training of all employees is the legal responsibility of both the Employer and Supervisors. Under the Occupational Health and Safety Act, training is mandatory, not optional. Ignorance of the law is not a viable defense. Penalties for non-compliant companies can be as much as $500,000 per incident. Penalties for Supervisors who don't meet the legal standards of competence, or those who supervise workers who aren't properly trained or otherwise fail to meet the standards of legal competence, start at $5,000 and may be as much as $25,000, plus 25% Victim s Fee, and/or up to 12 month s incarceration. Penalties for Supervisors are assessed to the individual, not the Employer. Learning Outcomes: Upon successful completion of this course, participants will be able to: 1. execute and provide adequate procedures that prove due diligence measures have been implemented and are being followed, including the use of written procedures and documentation and verification of learning provided to employees 2. describe the concept of the Internal Responsibility System and take steps to implement or improve the company s current system 3. describe and implement initiatives that meet or exceed legislated duties and responsibilities of the employer, supervisor and worker 4. recount applicable regulations and how they apply to their individual workplaces

2 Learning Outcomes (cont'd): 5. describe the ramifications of Bill C-45/Criminal Code of Canada Section and understand initiatives to implement to avoid prosecution 6. conduct efficient workplace inspections in order to recognize, assess and recommend hazard controls 7. implement and evaluate hazard controls and measure their effectiveness 8. communicate and work more efficiently with a worker Health and Safety Representative or members of the Joint Health and Safety Committee (JHSC), whichever is applicable 9. conduct workplace accident investigations and understand reporting requirements 10. identify causes of workplace accidents based on the five categories: People, Equipment, Materials, Environment and Process Evaluation: The final mark for this course will be determined by the results of a written test. For the protection of the employer, supervisor(s) and workers, a minimum grade of 80% is required to become certified. Who Should / Must Attend This Course: All personnel who act in a position of authority over any other person in the workplace must have this training, including, but not limited to Owners, Managers, Supervisors, Forepersons, Team Leaders and Lead Hands. The definition of a supervisor is not dependent on job title or union designation. This training is required for all business interests that employ workers, including all levels of Provincial and Municipal government and all organizations, charities, etc. in the Not-for-Profit sector. Additional Information About This Course: Under the Act, Section 25 (c), a Supervisor must take every precaution reasonable in the circumstances to ensure the protection of the worker."
