7 COMPLIANCE REPORTING REQUIREMENTS M-DCPS Online Diversity Compliance System PRIMES (Construction Manager) - Contract and Workforce SUB-CONTRACTORS Contract and Workforce PRIMES (Architects/Engineers) Contract ~ No Workforce SUB-CONSULTANTS Contract ~ No Workforce -Primes responsible for sub-contractor/sub-consultant reporting. Primes considered in Breach of Contract for Sub-contractor/Sub-consultants not reporting. -Begin Compliance Reviews on Primes for non-reporting Primes and Subcontractors/Sub-consultants (M-DCPS - OLDC System is being utilized by MDCPS staff, OEO staff, and businesses)

8 Update on Onsite Workforce Reviews were conducted have been conducted During Onsite Workforce Reviews we: Conduct Prime and Sub-contractor worker interviews Inspect vendor badges for compliance with Jessica Lunsford Act Verify Sub-contractors and Sub-consultant reported in the M-DCPS Online Diversity Compliance System Document Workforce on the project through interviews and pictures Complete Onsite Workforce Report for each project site visited. Workforce Report distributed to District Staff (Office of Facilities)

9 Non-Compliance All Prime Contractors & Sub-contractors/Sub-consultants with Small, Micro and M/WBE participation must report monthly via the Online Diversity Compliance System. A penalty of one percent (1%) of the contract amount or one thousand dollars ($1,000) per day (whichever is less) may be applied if reporting requirements are not provided within the specified time. If Non-Compliance is not cured in a reasonable amount of time with the OEO, the District shall deem non-reporting a breach of contract, in which case the District may terminate the contract.
