1 LLR FMC (The Leicester, Leicestershire and Rutland Facilities Management Collaboration) FAQ s Sheet Issue date: 13 January 2013 These FAQ s will be regularly updated. New questions will be highlighted at the beginning of each section and any updated answers will be typed in blue. Section 1: TUPE What is TUPE? TUPE stands for the Transfer of Undertakings (Protection of Employment) Regulations This is legislation that protects the rights of individuals when a contract transfers from one contractor to another. Simply, it means that when a business or part of a business is being transferred to a new person (or contractor), the employees must go with it on the same terms and conditions of employment. How long does TUPE last for? TUPE regulations protects your terms and conditions at the point of transfer and are not subject to an expiry date. We are able to review current structure models and conditions of service but can only implement these changes on Economical, Technical and Organisational (ETO) grounds. Any changes will only be made once full and proper consultation has taken place. You say that my service is preserved. What does this mean to me? Service refers to continuity of service, for example, it means that if you have 10 years service with your current employer, then that will transfer with you. Therefore, although you join Interserve in February 2013 you will have 10 years service with no break. Are you going to make changes to my contract? Under TUPE your current contract of employment transfers to Interserve as it exists. However, it is likely that the specification of the contract between Interserve and our Client may differ to that which your current employer is operating. This may necessitate reviews of current working practices. If this situation was to arise, and you were potentially affected, we would aim to talk to you in good time. We do not impose changes without full and proper consultation. Will you move us around to different areas/make us do different jobs/change our work tasks? We will assess the current working methods and structures to identify the best and most effective ways of working. There may be things you do in your current role that could be made easier and more efficient with different equipment or working practices. There may also be situations where some of your current responsibilities no longer fall within the contract specification. We will involve you in any discussions as mentioned earlier and would always welcome any suggestions or ideas you may have. We do not impose changes without full and proper consultation. If changes are made when will they be implemented? We are unable to say at this stage. Will I need to apply for and be interviewed for my job and will I be expected to complete a trial period with Interserve?
2 No. Under TUPE your current contract of employment will transfer. When will I become an employee of Interserve? The transfer date is 1 March I am a bank member of staff. What will happen to me? Discussions are taking place with the current employers regarding bank staff. Interserve do use bank staff and we are looking to continue this working practice. What happens if I don t want to transfer - am I redundant? It is your right to decide whether or not to transfer. If you choose not to transfer you are not redundant however, your current employer may deem this as resignation. You should discuss this with your current employer. What happens if I lose or make an error on the TUPE forms? We will send you an extra copy. Please contact us on the Hotline Number Hr.leicester@interserve.com or via Section 2: Terms and conditions of employment Will our rate of pay change and will you give us a pay rise? Your current rates of pay will be maintained. Rates of pay will be reviewed as per your current contract of employment. How will we be paid? Your money is paid directly into your Bank/Building Society Account by BACS transfer. It is, therefore, essential that you take care to provide accurate bank details on the Staff Data Form contained in the TUPE pack. We request all TUPE pack forms are completed clearly and correctly. If we do not receive your bank details, we will be unable to pay you as your current employer will not provide this. Please ensure you return the completed forms to our office in West Bromwich. If your wages are paid into another person s account, you will need to provide us with written permission both from yourself and that person, to continue with this arrangement. If you wish, we can provide you with blank forms for completion to assist you with this. When will I be paid? You will be paid on 28 th of each calendar month. If the 28 th day falls on a weekend or Bank Holiday, payment will be the last working day prior to the 28 th. I am currently weekly paid will I move to monthly paid? If you are currently paid weekly/fortnightly the following arrangements will apply: your current employer will pay you up to the end of February. We will pay you calendar monthly from 1 st March. Then your next pay date would be the 28 th March. We appreciate this may have an impact, we are currently reviewing options to assist in implementing this change and will look to offer a one-off advance payment of your March salary. The loans and repayment schedules can be discussed at a 1:1 meeting in January If you are interested in an advance payment please telephone our Hotline number for further details. Please note, we will also request that you complete an additional form to ensure we are able to make the advance payment.
3 How do you know if my bank details are correct? We are going to run a trial penny payroll for all staff transferring to Interserve. This will take place towards the end of February 2013 (date to be confirmed). 1p will be deposited into the bank account you have provided us with. If you do not receive the 1p, we have incorrect details and request you contact us immediately so we can look into why this has occurred and rectify any problems before the first pay date which will be 28 March How will I get my payslip? Payslips will be sent to your home address, each month. Will you provide us with new uniforms/id badges? New work wear and ID badges will be provided on or around the transfer date. It is essential that you provide us with uniform sizes when asked so we can order the appropriate items. Samples of what the uniforms will look like will be provided in due course. Please note uniform sizes may be smaller than your usual size please feel free to order one size larger. What is the holiday entitlement? Your current holiday entitlement will be honoured and as per your contract of employment. What happens if I already have a holiday booked? If you already have a holiday booked we will be informed by your current employer. If you are about to book holiday, please continue to do so in the normal way through your current employer. When you have transferred to Interserve, you will be asked to follow our holiday authorisation procedure. The holiday year will run from January to December. What will happen if my holiday year is currently April to March? You will be given pro-rated holiday entitlement from April to December From January 2014 your full holiday entitlement will begin. For example if your holiday entitlement is 27 days you will receive 20 days annual leave to use from April to the end of December 2013 and then from 1 st January 2014 you will have 27 days to use these up until the end of December You will receive the same holiday entitlement as per your contract of employment. Section 3: Interserve and the contract Who are Interserve? Interserve is one of the world s foremost support services and construction companies, operating in the public and private sectors in the UK and internationally. We offer advice, design, construction, equipment and facilities management services for society's infrastructure. Interserve is based in the UK and is in the FTSE 250 index. It has revenue of 1.9 billion and a workforce of nearly 50,000 people worldwide. Why was Interserve selected as preferred bidder to the Leicester, Leicestershire and Rutland NHS Trusts? We fought off tough competition to be awarded the contract and over the preceding months, we have demonstrated our expertise and ability to deliver the service expected. Interserve is one of the largest providers of multi-service facilities management in the health sector and therefore is well placed to deliver this contract. Interserve will introduce new, efficient ways of working e.g. micro fibre cleaning, steam meals, PDA s, tablets for menus. We will review the system of delivering services across the three Trusts and we will work with the Trusts to reduce costs and enhance savings across LLR Trusts.
4 What will the contract cover? Interserve will provide a full suite of support services to the Trusts across 550 building, totalling 490,000m² and nearly 3,100 beds, ranging from facilities and estate management to strategic consultancy and advice, to help Trusts in their objective of achieving foundation status. Who and how many staff will transfer under the contract? Staff employed by UHL, LPT, NHS Leicester City and embedded contractors currently providing services at UHL and LPT. The numbers of staff in scope to transfer is approximately How will Interserve s performance be measured? Interserve will be measured against key performance indicators. There will be a management monitoring team to ensure compliance and there are financial penalties for failure to perform to the agreed standards. When will the contract start? The proposed start date is 1 March How long will the contract run for? The contract is for seven years and will be reviewed at the end of this time. Will Interserve be reducing the head count/making redundancies? We envisage making changes as part of this new contract with LLRFMC. If there are any changes to be made these will only made once full and proper consultation has taken place. Will Interserve be sub-contracting any of the services out to another contractor? What will happen to me if this is case? Sub-contracting will only occur if there is a specialist service which is currently not provided by in-house staff. Staff who may be affected will be fully consulted. Section 4: Learning and Development What learning and development opportunities will Interserve provide? Interserve will be implementing a learning and development and social enterprise hub for supporting the contract, and the people of Leicester, Leicestershire and Rutland which will provide all of the core skills, training and learning development for our staff. It will also operate as a hub to assist in social enterprise, SME business start up support and increasing opportunities for jobs. I am currently completing a course through my current employer with Leicester College. Will I be able to continue my course? We will be partnering with local colleges to provide training opportunities to our staff such as apprenticeships and mentoring. If you are currently completing a course we will endeavour to work with you and the College to ensure that you are able to continue with your course. Do Interserve offer a graduate training programme? Yes we have committed to providing 7 graduates access to our Graduate programme over the 7 year contract.
5 Section 5: General questions What is happening regarding pensions? All eligible employees will receive information separately from our Pensions Department. What about Union membership? Interserve Support Services work closely with many Trade Unions (for example UNISON, UNITE GMB, ISTC etc) across the number of different industries in which we operate. You have the right to join a Trade Union. If you are a member of a Trade Union and/or a Shop Steward, we have asked you to indicate this on the TUPE Pack Form. Union subscriptions can be deducted from your pay if you wish. Please ensure you submit a new subscription form with your TUPE pack to grant permission to make deductions from your salary. Subscription forms are available from your TU representative and/or local office. Will there be an induction programme when I transfer to Interserve and will I be trained? Yes you will receive an induction programme when you join Interserve which will give you more information on us. Training programmes will be developed for all staff. Will I have the opportunity to have a one to one meeting with Interserve? If you require a one to one meeting please contact the helpline on or via Hr.leicester@interserve.com or your local Line Manager. Please also discuss your request with your line manager as you will need their approval to attend to ensure there is no disruption to the delivery of services. When I transfer will I still be able to use the Hospital Hopper for free? Discussions on this are still taking place. Will I still be entitled to a car park permit post-transfer? Car parking permits will not expire, discussions on this are still taking place to ensure we have the correct processes in place. I currently don t pay for car parking will I have to post-transfer? Discussions on this are still taking place to ensure we have the correct arrangements in place from 1 March Do Interserve provide a childcare voucher scheme? Yes Interserve offers a salary sacrifice childcare voucher scheme through Sodexo. We can provide further details upon request/at the Company Induction you will receive when you transfer over to Interserve. You must ensure your childcare provider is registered with Sodexo before vouchers can be issued. Please telephone our hotline for more information. Will we still have to complete timesheets when we transfer over to Interserve? We envisage that timesheets will still need to be completed post-transfer. We will also be using a Time & Attendance system.
