1 STANDARD OPERATING PROCEDURE FOR GENERAL CERTIFICATE OF CONFORMITY (GCOC) April 2012 Legislation implemented by the Consumer Product Safety Commission (CPSC) under the Consumer Product Safety Improvement Act (CPSIA) was implemented in This legislation required that a General Certificate of Conformity (GCoC) document be issued for consumer products, including wearing apparel manufactured on or after November 12, 2008, that are subject to CPSC rules, standards, regulations or bans. Whether testing is required by CPSC or not, the GCoC document is required for those products covered by the CPSIA. If the product does not require testing, the GCoC must indicate that it is exempt from testing. The following products purchased by divisions of Charming Shoppes Inc. are covered by the CPSIA. ALL general wearing apparel adult and children s for flammability testing Children s jewelry for lead and cadmium content Toys and products with play value defined as a consumer product designed or intended for a child 12 years of age or younger Child Care articles This list is not an all inclusive list of products regulated by the CPSC. For a complete list of products currently monitored or banned by the CPSC please refer to the website: Footwear is currently exempt from the requirements. For merchandise imported in the United States, the GC0C must be completed in English by the importer of record prior to importation. For merchandise produced in the US, the GCoC must be completed in English by the manufacturer and private labeler prior to shipment. The GCoC must reference the specific rule, regulation, standard or ban that the merchandise is required to conform to (i.e. Flammable Fabrics Act) and for which testing (if required) was performed. Failure
2 to have the GCoC available at time of importation or shipment could result in significant fines issued by the CPSC (up to $100,000 per product), and the products could be detained or destroyed. All testing must be conducted by a Charming Shoppes nominated lab resource. These laboratories are listed in the Vendor Partnership Manual. All Charming Shoppes vendors are required to have processes and procedures in place with each of their factories to ensure that they have a completed GCoC, and that, if required all merchandise is properly tested. The GCoC must reference a Charming Shoppes purchase order and style number. While Charming Shoppes will not automatically require a copy of the GCoC for imported merchandise, the vendor must immediately make the GCoC and the testing report (if required) available to Charming Shoppes upon request. Charming Shoppes will conduct random sampling to ensure that its vendors have the GCoC available as well as required testing reports. For merchandise that is produced in the U. S., the vendor is required to e mail 1 month prior to the shipment the GCoC and the applicable test report (if required) to our Quality Assurance Department at the following e mail address for all our apparel brands. S. Consumer Product Safety Commission. (10) The following rules, bans, regulations, and standards are applicable to this product. Send Completed Form to: GCoC@charming.com * This information is only required if testing is required, in which case all testing must be performed by a third party. If testing is not required, the Exempt from testing option should be selected. See Instruction Sheet for more information
4 Instructions on filling out the Domestic Manufacturer General Conformity Assessment Certificate General Conformity Assessment Certificate must be in English and must be filled out electronically 1. Describe the product in enough detail to allow a match to the product. 2. The Charming Shoppes Purchase Order number. 3. The Charming Shoppes Style number. 4. Provide the date(s) when the product was manufactured by month and year. 5. Actual factory location is street address, city and country where the product was finally manufactured or assembled. Charming requires the Charming Shoppes assigned factory ID as part of the data provided. 6. The domestic manufacturer will be considered the vendor from which Charming Shoppes has purchased the merchandise. Name of vendor, their mailing address, and telephone number will be required. Additionally the name of the person responsible within the vendor s organization for certifying compliance with CPCS requirements and regulations is required. 7. Name, full mailing address, telephone number and address of individual at vendor organization who is responsible for certificate and test retention/record keeping. 8. If merchandise is subject to testing requirements, this block of fields is required. Testing lab information requires identity of the laboratory to include the name, address, telephone number of the testing lab. Block also requires the date of testing and the test report number associated with the product the subject of certification. If testing is not required, the Exempt From Testing option must be completed/selected. Exempt from testing does not exclude an item from certification. In-house laboratories may not be used to perform testing for Charming Shoppes product. 9. Private Labeler Information includes name, mailing address, and telephone number. The private labeler is the Charming Shoppes division who owns the label being placed on the finished garment. (i.e.: LA Blues is a label owned and used by our Fashion Bug division therefore the information required in this block is the Fashion Bug information as found on your purchase order). 10. The vendor is responsible for identifying all of the appropriate U.S. Consumer Product Safety Commission rules, bans, regulations and standards that apply to the product which is imported. Examples of some of these appear below. The rule, ban, or standard must be listed in addition to the exact regulatory citation (i.e. Flammability of General Wearing Apparel - 16 CFR 1610). It is important to note that if a product is exempt from testing, such as some fibers are exempt from the testing requirements under the Flammable Fabrics Act, you must still certify that the product meets the requirements of the Flammable Fabrics Act.
