4 A brief discussion rwfd/ TEEP and the MRF regs Quick bit of background for you to read at leisure!!!: Collectors must comply with the law. Regulation 13 says that, from 1 January 2015: Every collector (Waste Collection Authority or establishment or undertaking collecting waste) must, when making arrangements for the collection of waste paper, metal, plastic or glass, ensure that those arrangements are by way of separate collection. The requirement to separately collect applies when: (a) it is necessary to ensure that waste undergoes recovery operations in accordance with Articles 4 and 13 of the Waste Framework Directive, and to facilitate or improve recovery; [the necessity test] and (b) it is technically, environmentally and economically practicable ('TEEP') [the TEEP test] Collectors who do not have separate collection arrangements should review their collection practices and consider carefully if and how they comply. They should rigorously apply the Necessity and TEEP tests. (Not TEEP alone) Collectors who have concluded it not necessary or not TEEP to operate separate collection arrangements should keep, and be able to provide for inspection, an audit trail which will help the Environment Agency to understand the basis of their decision-making. Records should be such that, if necessary, they could demonstrate compliance with the regulations in a court of law. Collectors should consult their lawyers to ensure they are compliant with this legislation. rwfd/ TEEP and the MRF regs
5 Legislation and official guidance The Waste (England & Wales) Regulations Note that Regulation 13 was amended in Part 5 of the Regulations. See Annex 1. European Commission guidance on the Waste Framework Directive (see pages 53-57). It includes guidance on what 'practicability' and 'necessity' mean. The Minister s letter of October 2013, which reminded local councils of their obligations from Separate Collection Separate collection is defined in Article 3(11) of the Waste Framework Directive as a 'the collection where a waste stream is kept separately by type and nature, so as to facilitate a specific treatment'. Technically, environmentally & economically practicable Guidance is provided in the European Commission guidance (para 4.4). High quality recycling High quality recycling is not defined, but Article 11(1) of the Directive states that collections should '...meet the necessary quality standards for the relevant recycling sectors'. 6 What do trends in collection show about impact of rwfd and TEEP requirements? Not very much! It is hard to tell what is affecting trends, how much was already planned as part of large/ PFI type projects Latest analysis of collection methods has not yet been completed by WRAP Previously it had shown: TEEP and MRF regs

8 What is collected? Glass affected by TEEP? PTTs Welsh policy and infrastructure? How can this be improved? Textiles not a local authority specialism?
9 Regulations are substantial and positive step in. Supporting economic growth by maximising the value of the recycled material collected; Promoting higher income from sale of quality recyclates; Delivering confidence about reliable stream of recovered material and may encourage investment in the sector; Allowing local authorities and waste management companies to demonstrate the level of quality of recycling available from co-mingled streams. TEEP and MRF regs
10 What do the returns show? The first set of data covering the final quarter of 2014 was released by WRAP in July MRFs have notified the Environment Agency (EA) in England in accordance with the regulations there was surprise at this number with most observers, and Defra, anticipating that several dozen more should have registered (over 1,000 tpa) TEEP and MRF regs
11 86 provided data all data had to be queried The latest data on the new sampling regime for MRF operators in England and Wales shows a slight fall in the number of English facilities reporting. This quarter, WRAP says 87 English MRFs had notified the EA, with all but two submitting their returns. These reporting MRFs provided data based on 7,878 samples of input and output material, up from 6,864 previously. In Wales, as last time, nine MRFs notified Natural Resource Wales (NRW) with seven submitting data. TEEP and MRF regs
12 In terms of input, WRAP s summary shows that, by weight, 86.8% (86.6% previously) of material received by English MRFs was target, meaning it was identified by the operator to produce bulk quantities. The non-target material figure was 5.6% (5.9%), while material considered non-recyclable remained at 7.7%. That is a total of 13.3 % contamination In Wales, the target material was down to 88.3% from 90.6%, with 6.4% (4.9% previously) non-target and 5% (4.5%) non-recyclable. That is a total of 11.4% contamination WRAP noted that the regulators (EA and NRW) raised queries on 82 of the returns for England and seven for Wales. Queries have been raised by the regulator, however not all have been resolved. Consequently we would discourage users of the portal, at this stage, from isolating individual responses and comparing these to other sites. MRF Portal TEEP and MRF regs
13 Opinion: WRAP states that A large number of queries is to be expected as the reporting is a new requirement, with specific data required. It will take time for the sampling and reporting processes to bed in. Ray Georgeson, chief executive of the Resource Association, said it was too early to seek trends or patterns in the data but there was a continuing concern about the low levels of compliance in terms of data submission. The failure of a significant part of the industry to move into compliance runs the risk of seriously undermining the value of the regulations, even at this early stage. Urgent action is needed by the regulators to address this, he said. (Reported in MRW) Conclusions very hard to draw, probably another year before this is possible. What does the NERF think? TEEP and MRF regs
14 Consistency project Representatives from ADBA, ADEPT, BRC, CIWM, ESA, FDF, Green Alliance, LARAC, LGA, NAWDO, Resource Association, Resource London, DCLG, DEFRA and WRAP. A DEFRA-driven project. Rory Stewart at the RWM last week pointed to: standardisation of recycling as a way of making collections cheaper and better for local authorities and residents in England. He cited over one hundred different collection models currently running in the country, which he would like to get down to five or six. Consistency of Collections project
15 With regards to the England s flat-lining recycling he again pointed to standardisation of collections, and voluntary agreements as tools to help push the rate up. He says this will simplify things for the public But. What does consistency or standardisation mean? Consistency of Collections project
16 A vision for greater consistency but assess costs, benefits and time-scales for implementing such a vision (contract periods, equipment/ vehicle depreciation timescales taken into account etc.) A single solution not desirable or practical Although front-end focussed also must look at value chain, quality of materials, markets and what they want, and packaging design Customer support and convenience (but my question - does too easy change behaviour?!) 18 Known issues: deprivation transience of population limited access to recycling services and physical restrictions on space for storing recyclable materials prior to collection data is limited given the constraints of housing types: absence of collections data at a property level collection rounds are deployed to service the properties efficiently but hard to abstract hard stats Need to be able to measure effectiveness of pilot interventions Findings will be disseminated target date next Autumn. 31 Knowledge does make a difference those receiving information about services and how to use them have a higher level of confidence. 64% of householders who were confident reported having received information on how to recycle, compared with 34% who had a 50:50 confidence level and 21% who were not at all confident. The more confident a consumer is the more effective they will be at recycling Addressing the Knowledge Barrier
