BID INSTRUCTIONS Montour County Courthouse Retaining Wall Repair Project The Montour County Commissioners are receiving bids for the Courthouse Retaining Wall Repair Project. The parking lot is located next to the Montour County Courthouse on Mill Street in Danville. Construction drawings and bid contract documents may be picked up at the Courthouse located at 29 Mill Street, Danville, PA 17821 during normal operating hours. Sealed BID PROPOSALS, in duplicate, will be received by Montour County at the County Courthouse. The bids need to be received by 10:00 am on Tuesday, February 25 th. The bids will be opened at 10:05 am and it will be awarded at the regularly scheduled Commissioners meeting at 7:00 pm on February 25 th. Each PROPOSAL shall be submitted with a proposal (bid) bond of 10% of the contract. All PROPOSALS shall be effective for 60 calendar days after the bid opening. Payment, Performance, and Maintenance Bonds as well as proof of worker's compensation insurance will be required within 10 days of receiving the notice of being awarded the bid. The notice to proceed will be issued on March 17 th. The project shall be completed within 60 calendar days of the notice to proceed. However, per the General Conditions, unforeseeable causes outside of the contractor's control shall not be part of the completion time so long as the conditions of this section are followed. Please refer to additional information in the bid documents for more information. Please note that Pennsylvania Prevailing Wage requirements will need to be followed for the project. Please note that the Transportation Bill (SB 1060) that recently passed changed the prevailing wage rate to $100,000 for Highway projects. The construction activities shall be coordinated with the County. The Montour County Commissioners reserves the right to reject any or all PROPOSALS, and/or delete portions thereof, in order to best serve the interest of the County. SECTION I SCOPE OF WORK I.1. GENERAL The contractor shall meet Pennsylvania Prevailing Wage requirements. The transportation bill that recently passed (SB 1060) appears to have set the Prevailing Wage threshold for this project at One Hundred Thousand Dollars ($100,000). The Construction Plans dated January 7, 2014 prepared by Rohland Engineering, LLC are hereby made part of this Contract. The work included in this Contract consists of furnishing all labor, equipment, materials, supplies, and performing all work as required by this Contract, in strict conformance with the project Specifications, Details, Drawings, Schedules and all applicable Penn DOT standards, practices, and publications, all of which are made part hereof; and including such specific detail drawings and illustrations as may be furnished by the Engineer from time to time, during the Construction, in interpretation of said design plans. The Work shall be complete and all Work, materials, and service not expressly called for in the Specifications, or specifically illustrated on the Design Drawings and which will be necessary for the complete and proper construction of the Contract in good faith, shall be performed, furnished, and installed by Contractor at no additional cost to the Owner. Any questions with regard to such work, materials, and services shall be directed to the Engineer prior to submitting the bid. Otherwise, it will be assumed that the Contractor understands the intent of the Owner and Engineer in preparing the Contract Documents, which include, Specifications, Details and Design Drawings. All Work shall be executed in the best and most workmanlike manner by qualified, careful and experienced workers.

I.2. WORK INCLUDED The Work will require all staking, erosion & sediment control, removal and disposal of the existing material, excavation, paving, and concrete work as necessary to replace and repair the existing retaining wall as indicated on the plan. The Work as described below is illustrated on the Construction Plans prepared by Rohland Engineering, LLC dated January 7, 2014 and shall include, but not necessarily be limited to, the following: 1. REMOVE & REPLACE ROONEY AVENUE ALLEY RETAINING WALL a. Replace the wall that is along Rooney Alley and around the corner to an existing large vertical crack that is approximately 10 feet from the corner with Friendship Alley. b. Remove & dispose of the existing wall & other construction waste as necessary. c. Construct new retaining wall per the grades & details shown on the plan. d. Construction shall follow PADOT 408 specifications and applicable RC details. 2. REPAIR FRIENDSHIP ALLEY RETAINING WALL a. From the 10' vertical crack, the Friendship Alley wall shall remain. b. Pressure wash the wall prior to repair. c. Repair the existing retaining wall as necessary per the plans. d. Use materials as specified in the bid documents or approved equal. 3. GUIDERAIL a. Furnish & install new weak post guiderail along side the Rooney Avenue Alley Wall per the plan and details. b. Work shall be per PADOT 408 specifications and PADOT RC 53M detail. c. The Friendship Alley side shall use the existing guiderail. It shall be removed and replaced as necessary on this side. 4. REPAIR ALLEYS a. Remove & dispose of alley material as necessary to install new wall. b. Repair alley with new paving as necessary once wall is finished. c. Paving shall be notched into existing alley per PA Dot specifications and RC details. d. Furnish materials as necessary. e. Coordinate alley work with Danville Borough.

5. EXISTING PARKING AREA a. Remove existing parking material as necessary in order to install the new wall. b. Furnish & Install 2A stone back on parking area as necessary so that it can be used. 6. TRAFFIC CONTROL a. The Contractor shall be responsible for the safe flow of traffic per PADOT regulations. b. The parking area shall be able to be used throughout the construction period unless it is absolutely necessary to close it. c. Coordinate with County the times that the parking are cannot be used (if applicable). d. Coordinate the traffic control of the alleys with Danville Borough. I.3. ADDITIONS/DELETIONS TO THE GENERAL CONDITIONS 10.1 - Deletion: Delete the 1 st sentence in this section. A line has also been drawn through this sentence. 13.3 - Add this section after 13.2: The OWNER reserves the right to delete any WORK items from the PROPOSAL at its discretion, should budgetary constraints warrant such deletions. 15.3 - Add the following after the last sentence: If all WORK is not complete within the time constraints as set forth in I.4. of these CONTRACT DOCUMENTS, liquidated damages will be assessed at a rate of three hundred dollars ($300.00) per additional working day. I.4. CONTRACT COMPLETION TIME Phase 1 - This phase shall be completed within 45 calendar days of receipt of the NOTICE TO PROCEED. Phase 2 - This phase shall be completed within 45 calendar days of receipt of the NOTICE TO PROCEED. Phase 3 - This phase shall be completed within 45 calendar days of receipt of the NOTICE TO PROCEED.

I.5. CONTRACT QUANTITIES The quantities indicated on the line item PROPOSAL FORM are estimates and are not guaranteed. All in place material and quantities shall be verified and certified by the ENGINEER. The CONTRACTOR shall notify the ENGINEER, in writing, should it be anticipated that the quantities for any single line item to be installed/constructed will exceed by ten percent (10%) or more the quantity indicated on the PROPOSAL FORM for the given item. Any such excess quantities of a given item shall not be authorized by the OWNER/ENGINEER without issuance of a CONTRACT CHANGE ORDER, prior to actual installation/construction and verification by the ENGINEER, and approval by the OWNER. At the time of construction the CONTRACTOR shall provide copies of all material delivery slips. I.6. ACT 287/187 - UNDERGROUND FACILITIES The CONTRACTOR shall, prior to performing any work, shall verify the exact location of all public and private utilities having underground facilities by contacting PA One Call System, (1-800-242-1776) a minimum of three (3) working days prior to any excavation. I.7. SERVICES AND FACILITIES All services and facilities required for construction purposes shall be furnished solely by the CONTRACTOR. All temporary services and facilities used during construction shall be removed by the CONTRACTOR at the completion of and final acceptance of the WORK. I.8. PAYMENT Quantities for payment will be determined by actual measurements taken in the field by the ENGINEER and reviewed with the CONTRACTOR, as the WORK is in progress. Payment shall be made on the basis of the field verified measurements multiplied by the UNIT PRICE bid for the specific line items provided in the PROPOSAL FORM. I.9. FINAL INSPECTION Upon completion of the WORK under this CONTRACT, the ENGINEER shall make an inspection to determine if the WORK is fully and satisfactorily complete. All WORK items found to be incomplete shall be noted by the ENGINEER and a written notification listing those items to be corrected, shall be transmitted to the CONTRACTOR for correction prior to the ENGINEERS final certification to the OWNER.

I.10. START OF WORK, (NOTICE TO PROCEED) Phase 1 - The NOTICE TO PROCEED will be issued on October 15, 2013. Phase 2 - The NOTICE TO PROCEED will be issued on April 1, 2014. Phase 3 - The NOTICE TO PROCEED will be issued on June 1, 2014. Work under this CONTRACT shall be commenced within three (3) working days following receipt by the CONTRACTOR of the NOTICE TO PROCEED, issued by the ENGINEER following verification of all required bonding and insurance coverages. ADDENDUM NO. 2 February 19, 2014 Regarding: Montour County Courthouse Retaining Wall Repair Project 1. All rebar in the wall footer are number 5. 2. Danville Borough will charge a $450 permit fee to do the work in the alley. This fee will need to be paid by the contractor. 3. Disregard the 10 paving section that is shown on the retaining wall detail. There will only be stone backfill in this area. 4. ADDENDUM NO. 3 February 19, 2014 Regarding: Montour County Courthouse Retaining Wall Repair Project 1. For clarification purposes, there is an existing telephone pole that is about 6 inches from the corner of the wall. Great care will need to be taken when working around the pole. If necessary, during the construction period, the design of the wall may need to be altered slightly in order to get past the pole. This issue will be worked out with the contractor at that time and addressed with a change order if necessary. 2. Please note that there is no plan to move the pole. However, PP&L will have a representative on site while work is being performed around it. Any cost reimbursement that PP&L may request, associated with their inspection or construction support, will be addressed at that time and is not part of this bid.

ADDENDUM NO. 4 February 20, 2014 Regarding: Montour County Courthouse Retaining Wall Repair Project 1. For clarification purposes, only the obvious repair work that is needed for the Friendship Alley Wall is part of this bid. This includes the visible spalling, cracking, and obvious areas that need to be chipped away in order to get to stable material. Any other issues that may be discovered during the repair of the wall will be addressed at that time with a change order if necessary.
