Refer to Attendance List for all Other Attendees (Attachment 5A) The meeting was held at 10 AM in the Department of Public of Work Riva Road 3 rd floor - Annapolis Maryland The prepared Agenda was read out loud and discussed as follows: 1. The PM, A/E, Recreation & Parks DPW Management Staffs, were introduced and their roles in this contract were explained. 2. The bidders were advised to use Anne Arundel County forms and proposals as included within the Specification and to not alter the language. 3. Bids are due on February 7, 2017 by 1:30 P.M. at the Office of Central Services, c/o the Purchasing Agent. His address is 2660 Riva Road, Annapolis, Maryland The project has bond requirements, e.g., bid bond, material and labor bond, performance bond, and maintenance bond. If maintenance bond is not provided, the County will retain 5% of the contract cost for one year 5. The working hours will be 7:00 AM to 4:00 P.M. hours unless arranged earlier with the inspector. 6. The contractor is required to keep the job site clean during and after construction. 7. The present contract time is 270 calendar days. Liquidated damages are $500 per day. 14 8. A Notice to Proceed, will be issued in late March/ April Bids should reflect that time period. 9. There will be a full time inspection for the project. 10. Damage to any area will be restored back to the original condition. 11. The contractor must call for all inspections from State and County. 12. Call Miss Utilities before digging. 13. The successful bidder will submit the progress schedules within 30 days of the NTP. 14. If any item is missing from the Specifications and it is required to complete the project, it shall be provided without cost to the County. 15. Pay period for the County is 30 days. 16. Contractor must do quality control for the submittals before sending to the County or it s representative. 17. The project must comply with all contract document including Anne Arundel County Specifications and Details. The website address is County has obtained a building Permit; all other permits are the contractor s responsibility, e.g., trade, fire protection, utilities connection and any other work. 19. Since this is a County Capital Project, permit fee will be waived for all trade permits. 20. N/A. 21. The proposal form and basis of award were explained. Refer to pages 13 to 22 of the Project Manual for the Anne Arundel County Proposal form, A4-1. This document must be submitted with the Bid. The award will be based on lump sum bid including Base Bid, Contingency Items and Allowance, as noted on page 22. Clarification regarding documents in the Proposal Form Packet Federal, pages of the Project Manual: This document includes required DBE participation for the project. MDOT DBE Form A (pages 41-42) and MDOT DBE Form B (pages 43-49) must be submitted with the Bid. If the contractor is not able to demonstrate the contract s DBE % goal utilizing MDOT certified DBE contractors, MDOT MBE/DBE Form E (pages 50-51) demonstrating good faith effort must also be submitted with the bid. Additional SHA documents MDOT DBE Form C, MDOT DBE Form D and the Experience and Equipment Certification are to be provided in Addendum No. 1. These documents must also be completed but may be submitted within 10 days of notification of being the apparent low bidder for the project. 15 Federal Wage Rates apply to this project. It was noted that the wage rates contained in the Project Manual will be replaced by current 2017 wage rates which will be issued in Addendum No All questions shall be submitted to architect, Lynette Pinhey of Human Rohde in writing and CC to Project Manager, Rich Osborn. Questions will be accepted until 12:00 P.M. January 24, As deemed appropriate, responses will be provided in an Addendum. 24. The County has set up the contracts with Comcast & Verizon to lower their cables in Waterbury Road, however, the contractor will be responsible to coordinate and schedule work with them. Work by Comcast has been completed. Work to be done by Verizon is still pending. In regards to other utilities that may be impacted by this Project, BGE is proposing a duct bank beginning at Route 3 and running eastward to Cecil Avenue. A portion of the duct bank is directly beneath the trail in the vicinity of the parking lot at the Board of Education property and the parking lot is slated as a staging/stockpile area for their work. Consequently, some coordination with BGE may be necessary depending on their construction schedule. The schedule for BGE s work is unknown at this time, but the County expects to have more information prior to start of construction of the trail project. 25. List of sub-contractors form shall be submitted with bid. 26. This is a wage rate contract if over $500, The County encourages the use of DBE/ MBE / WBE Contractors. On this project there is an eleven percent (11%) requirement goal for DBE / MBE / WBE. The WBE / MBE must be approved by the MDSHA if the bid is over $500, Go on line if requesting a Plan Holder s list. 28. County Executive Order #14, regarding contractor s employees being legal citizens, (incorrectly referenced as #24 in the Agenda) is a part of this contract. 29. See A-2-1 Bid Date is February 7, Human & Rohde described the scope of work: The project consists of approximately 1.8 miles of 10 wide asphalt hiker-biker trail, beginning approximately 600 feet east of the intersection of Millersville Road and Route 3, traveling east through County-owned right-ofway, and ending at Waterbury Road near Route 97. There is a paved parking lot at the beginning of the trail on the Board of Education Property and another small parking lot at the far end of the trail at Waterbury Road. There are several road crossings along the length of the trail. The project includes roadway work at Waterbury Road to lower the road for the purpose of improving sight distance for the trail crossing at this location. 16 access restrictions are clearly noted on the plans, and it is stressed that access is prohibited at Arundel Station (more or less midway) unless the contractor can work something out with the adjacent homeowner. The work also includes storm drainage structures and piping, sediment control measures, extensive retaining walls, fencing, landscaping, signage and pavement markings, and site furnishings. 31. The contractors were asked to visit the site after the meeting. 32. The Floor was then opened for questions from the Attendees: 1) Q: Is the prime coat shown on the asphalt trail detail (1/D-1) necessary? A: No. The prime coat is omitted. 2) Q: Regarding traffic control for the road work for Waterbury Road, it would be less expensive to do a complete road closure with detour and perform all of the road work at one time. Would this be permitted and could the project be bid this way? A: The project should be bid as currently designed. It is too late in the process to design and have a detour plan approved. After award, the contractor may apply for a revised Traffic Control Plan to detour traffic at their own expense. 3) Q: On Sheet 77, Retaining Wall C, there is a note regarding sheeting and shoring if needed, but there is no bid item for this. A: Clarification of what was discussed at the Pre-Bid: The Temporary Sheeting & Shoring Note on this sheet states that The contractor is responsible for all engineering and design of the sheeting and shoring system. All costs associated with the temporary sheeting and shoring design, etc., shall be incidental to the retaining wall pay item. This applies to all of the retaining walls, as noted under Payment on each of the Retaining Wall Plan & Elevation sheets. Refer also to the Measurement and Payment sections in Special Provisions 451- Retaining Wall Segmental Block MSE Wall, 452- Retaining Wall Segmental Block Gravity Wall, and 453- Temporary Sheeting and Shoring for Wall Excavation. Should an unforeseen condition be encountered beyond the limits shown on the plans where temporary sheeting and shoring would be necessary and its use approved by the County Inspector, then this work would be measured and paid for under Contingent Item 9 (refer to page 21 of the Project Manual). 4) Q: Can alternative wall block systems be proposed for each wall type? What about wall block texture and color? A: Yes, alternatives complying with the Special Provisions will be considered during shop drawing review. Texture and color are noted on the wall plans and in the applicable Special Provisions. It was further noted that the contractor is to submit completely designed retaining wall drawings for the specific wall products proposed, signed and sealed by a professional engineer, during shop drawing review. Block color samples are also to be submitted at this time for selection by the Owner. See also response to Q-4 below. 17 33. Questions obtained prior to the Pre-Bid Meeting and responses were read to the attendees: Q-1 Is the Contractor responsible for the Inspector s trailer? A-1 No, the specifications do not call for a trailer for the Inspector. All the temporary power and phone services are the Contractor s responsibility. The Contractor must get the building permit for any trailers they may need for their use from the County s Inspection and Permit Department. Q-2 Are all testing to be done by the County? A 2 The County will have a consultant do soil, compaction, proctor, concrete testing. Anne Arundel County will have an agreement with SHA- Office of Material Testing to provide all Lab Testing for this Project. Q-3 Is this job taxable or not? A-3 Yes, you will have to pay taxes. Q-4 What is the material spec d and are alternate or equal substitutions permitted? Nothing for the retaining wall is called out on the bid form in sections A through E what is the length of the retaining walls? A-4 The bidders are directed to review the construction documents pertaining to the retaining walls for all information, specifically the following: Retaining Wall Plans and Profiles, sheets Retaining Wall Cross Sections, sheets Special Provisions: 451- Retaining Wall Segmental Block MSE Wall 452- Retaining Wall Segmental Block Gravity Wall 453- Temporary Sheeting and Shoring for Wall Excavation. 34. Question received following the Pre-Bid Meeting: Q-5: A-5: All of our employees are E-verified, but not all are U.S. citizens, does this comply with executive order #24? (note: Executive Order is now #14) To comply with Executive Order #14, each bidder must comport with the United States Code. Bidders cannot employ an unauthorized alien. However, if they comport with the documentation requirements in 8 U.S.C.S. 1324(a) that should suffice the Code Provision. E-verify, as operated by USCIS, should be a sufficient method to check if an employee is authorized to work in the United States. Bidders, however, must still comport with the terms of 8 U.S.C.S. 1324(a) if they are notified that an employee is not eligible at any point.
