17 Attachment 1: Summary of existing Legislation National/ State Outcome Sought Act Provisions Extent of provision Prevention of the spread of declared pest plants Territory wide Land (Planning and Environment) Act1991 Section 254 (1b) Applications to planning and land authority for orders (1) A person may apply to the planning and land authority for an order directed to 1 or more of the following: (b) Anyone by whom or on whose behalf a controlled activity was, is being, or is to be, conducted. A controlled activity being - using or managing land in a way that fails to control the propagation of a pest animal or pest plant. (2) A person shall not sell a parcel of seeds containing prohibited matter of any class or kind unless: (a) A maximum proportion has been prescribed in respect of prohibited matter of that class or kind, and (b) The proportion of prohibited matter of that class or kind to seeds in the parcel does not exceed that maximum proportion. (2) A person does not commit an offence against subsection (1) if the person proves that - (a) He or she was instructed to move or drive the animal or vehicle; and (b) He or she could not reasonably have known that the animal or vehicle contained or carried the declared weed. 15. Releasing fish, &c., or polluting waters, &c., without permit (1) Subject to this Act or to an instrument of a legislative or administrative character made under it a person shall not (a) Bring into, or release in, the Territory any live aquatic life, live fish, or any live eggs, fry, spat, or larva of fish; (b) Possess or sell noxious fish or noxious aquatic life; unless the person does so under and in accordance with a permit. & regions Prevention of Land Protection declared weeds being (Pest and Stock supplied. Regulated Class 2 weeds: Parthenium, prickly acacia, giant rat s tail grass, American rat s tail grass, giant Parramatta grass, Parramatta grass 46 Moving or transporting vehicles and other things on roads (1) This section applies to a person who moves or transports a vehicle or other thing on a road if the person knows, or ought reasonably to know, soil or other organic material in or on the vehicle or thing is likely to contain the reproductive material of a declared pest plant. (2) The person must not, without reasonable excuse, move or transport the vehicle or thing unless the person has taken reasonable steps (a) To restrict the release of the reproductive material when the vehicle or thing is moved or transported; or (b) To ensure the vehicle or thing is free of the reproductive material. 8 Control over introduction of pests (1) The Governor in Council may by regulation, or, if the Minister considers urgent action is needed, the Minister may by notice (a) Prohibit the introduction into Queensland of any plant, soil, appliance or other matter or thing if it is in a condition of pest infestation prescribed therein or upon failure to comply with conditions prescribed therein reasonably necessary to prevent, control or eradicate pest infestation of crop plants; (b) Prohibit the introduction into Queensland of any pest; (c) Authorise the introduction into Queensland of any such matter or thing as is referred to in paragraphs (a) and (b) upon such conditions imposed under a regulation as are reasonably necessary to prevent, control or eradicate pest infestation of crop plants.
