1 ARLINGTON COUNTY, VIRGINIA County Board Agenda Item Meeting of July 18, 2015 DATE: July 9, 2015 SUBJECT: U , USE PERMIT AMENDMENT for an amendment to Condition #12.A.5) to permit construction to begin at 7 a.m. on weekends and holidays to facilitate completion of Discovery Elementary School; located at 3600 N. Harrison St. (RPC# ). Applicant: Arlington Public Schools 1426 N. Quincy Street Arlington, Virginia C.M. RECOMMENDATION: Approve the subject use permit amendment subject to all previously approved conditions and the amended Condition #12.A.5. ISSUES: This is a request to amend the use permit to allow for earlier construction hours for the contractors working on Discovery Elementary School, and no issues have been identified. SUMMARY: This is a request to amend the use permit for Discovery Elementary School to permit construction to start at 7 a.m. on weekends and holidays so that construction is completed in time to allow the school to open for the upcoming school year. No issues have been identified. Therefore, staff recommends approval of the subject use permit amendment subject to all previously approved conditions and the amended Condition #12. BACKGROUND: The use permit for a new elementary school at the Williamsburg Campus was approved by the County Board on September 24, Condition #12, which provides for construction site maintenance, also permits on-site construction during certain hours. 2 The following provides additional information about the site and location: Site: The site is bound on the east and north by North Harrison Street, on the south by 36 th Street North. The site borders Fairfax County on the northwest. Zoning: The site is zoned S3-A Special District. Land Use: The site is identified on the General Land Use Plan (GLUP) as Public. Neighborhood: The site is located within the Rock Spring Civic Association. Staff contacted the Rock Spring, Yorktown, and Williamsburg Civic Associations for comment, but has not received correspondence as of the date of this report. Discovery Elementary School Site N O R T H Source: Bing Maps 2015 DISCUSSION: Arlington Public Schools (APS) has been constructing the new Discovery Elementary School since the spring of 2014, and intends to open the school for the school year. In order to finish construction on time, APS requests an amendment to Condition #12.A.5 to permit construction starting at 7 a.m. on weekends and holidays. Currently, Condition #12 permits construction starting at 10 a.m. on weekends and holidays; it also allows for the applicant to submit for an administrative change to request construction hours beyond those specified in Condition #12, but provided that the additional construction activity involves utility work or street closures that are not possible to complete within the specified hours. Given that APS does not meet this criteria, approval of the request is not permitted administratively. U , Discovery ES Construction Hours - 2 -
3 Staff supports the request for extension of construction hours given that this is an important public project that is on a firm deadline for completion. The additional noise impacts of the earlier start is offset by the general contractor being able to complete work earlier than would be possible if the hours are not extended. CONCLUSION: Therefore, staff recommends approval of the subject use permit amendment subject to all previously approved conditions and the amended Condition #12.A.5). Amended Condition # Construction Site Maintenance Agreement (First Building Permit) A. Approve Agreement (First Building Permit) Arlington Public Schools agrees to submit to and obtain the Zoning Administrator s approval of a Construction Site Maintenance Agreement prior to the issuance of the First Building Permit, which will provide information regarding how Arlington Public Schools will meet the following requirements: 1) That the site and any buildings located within it are secured and kept in a wellmaintained condition throughout construction, consistent with the requirements outlined below in this condition, and the requirements contained in Condition #17.C. This shall include, but not be limited to, maintaining landscaping, keeping the grass mowed, removing litter and debris from the site, and properly disposing of recyclable materials. 2) Maintain access on the site for fire emergency vehicles including access to existing fire hydrants and fire department connections. 3) Address sites that have been cleared, but construction has either ceased for a period of time or not yet begun. The Plan shall include an interim site maintenance plan that provides details on interim landscaping, site screening and site maintenance. 4) At the end of each work day during construction of the project, any streets used for hauling construction materials and entrance to the construction site shall be free of mud, dirt, trash, allaying dust, and debris, and all streets and sidewalks adjacent to the construction site shall be free of trash and debris. 5) On-site construction activity, including, by way of illustration and not limitation, delivery of materials and equipment, except for construction worker arrival to the construction site and indoor construction activity, shall commence no earlier than 7:00 a.m. and end by 6:30 p.m. on weekdays, and shall commence no earlier than 10:00 a.m. and end by 6:30 p.m. on Saturdays, Sundays, and holidays. Indoor construction activity defined as activity occurring entirely within a structure fully enclosed on all sides by installed exterior walls, windows, and/or doors shall end at midnight each day. Arlington Public Schools may submit to the Zoning Administrator, as an administrative change to the use permit, a request to permit construction activity during hours other than those identified above. 4 Administrator may approve such request only if Arlington Public Schools can show that the construction activity requires certain utility work and/or street closures outside the hours stated above. Holidays are defined as New Year s Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving, and Christmas. Arlington Public Schools agrees to place a minimum of one sign per street front around the construction site, indicating the permissible hours of construction, to place one additional sign within the construction trailer containing the same information, to provide a written copy of the permissible hours of construction to all subcontractors, and to require its subcontractors to observe such hours.
