1 SECTION ABESTOS ABATEMENT PART 1 - GENERAL 1.1 SCOPE OF WORK A. The following asbestos-containing materials is known to be present on the First and Second Floor classrooms of the North Wing of the West Essex College Campus. 1. Multi-Layers of Floor Tile and Mastic: a. Content: 1.1 to 6.5% Chrysotile b. Other Component: Binders B. If other materials are found which are suspected of containing asbestos, notify the Project Manager Immediately 1.2 CONTRACTOR RESPONSIBILITY A. Prior to commencement of any work, make a complete inspection of all of the facilities listed in this specification B. Prior to commencing any asbestos abatement, the contractor shall isolate the corridor from the remainder of the building by sealing the doors and windows, all duct work openings, and any penetration to outside from the above mentioned locations that may be occupied, with two layers of six mil fire rated plastic. The contractor will be required to complete the preparation work prior to removing any floor tile from the work areas. C. Construct a decontamination chamber adjacent to each floor corridor near the classrooms. The decontamination chamber shall be construction in accordance with the procedures established by current Local, State and Federal regulations. D. All asbestos work shall be performed by a New Jersey Department of Labor Licensed Asbestos Abatement Contractor. All workers shall hold a valid permit issued by the New Jersey Department of Labor. No work will be authorized unless requested 48 hours in advance in writing to the Asbestos Consultant for weekends or holidays. E. The following is a list of the asbestos-containing materials that will need to be abated by the contractor: Asbestos-Containing Approinate Location Materials Amiuntn 1" Floor: Classrooms 102, Multi Layers of 12" x 12" Floor Tile 103 and 105 and 9" x 9" Floor Tiles with associated 2,700 sq. ft. Mastics and Multi Layers of Plywood

Fiber Boards Note: The contractor is responsible to field verify all quantities prior to submitting a bid. The building's owner or consultant is not responsible for extra compensation if the contractor does not verify the quantities. F. All non-friable floor tile removal listed in the above table will be completed in accordance with the requirements of the "Recommended Work Practices of Resilient Floor Covering" (latest edition) by the Resilient Floor Covering Institute, utilizing electric heat machines with critical barriers and negative air. The contractor will consider all layers of floor tile and mastic listed in the table above as testing positive for asbestos. If during the non-friable removal the floor tile becomes friable or is deemed friable by any inspector or any state agency, the contractor must stop work until plans and specifications are developed for full containment removal and a construction permit has been obtained from the local code official. All expense's associated with the floor tile being deemed friable including project design, project management, additional air sampling, fines and project monitoring costs will be deducted from the contractor's contract prior to final payment. G. The removal of any glue dots located behind the caulk boards or fiber board will be removed by non-friable procedures. All caulk boards and fiber boards that contain glue dots will be disposed as asbestos containing debris. H. The floor tile located on the first floor has been placed over a sheet or sheets of plywood. The abatement contractor shall remove all plywood sheeting and additional layers of floor tile and plywood completely to the original floor boards. All layers of plywood and floor tile identified will be removed intact and disposed of as asbestos containing waste. I. All asbestos removal and decontamination shall be performed in accordance with the guidelines and regulations of the responsible state agencies: Occupational Safety and Health Administration (OSHA), New Jersey Department of Health (NJDOH), New Jersey Department of Labor (NJDOL) and the New Jersey Department of Environmental Protection (NJDEP). J. Assume full responsibility and liability for the compliance with all applicable Federal, State, and Local regulations pertaining to work practices, hauling and disposal. The Contractor is responsible for providing medical examinations and maintaining medical records of personnel, as required. The contractor shall hold the Owner and the Owner's Representative harmless for failure to comply with any applicable work, hauling, disposal, safety, health or other regulation on the part of himself/herself, his/her employees, or his/her subcontractors

Except to the extent that more explicit or more stringent requirements are written directly into the contract documents, all applicable codes, regulations, and standards have the same force and effect (as if copied directly into the contract documents, or as if published copies are bound herewith). L. Strictly adhere to all precautions necessary for the safety and health of the work person in accordance with provisions of OSHA Standards, 26 Code of Federal Registers C.F.R., Part Constructions Standards, and Section , Industry Standards. M. Properly contain, transport, and dispose of all contaminated wastes and materials at a site approved for asbestos disposal. The dumpster may be stored on-site as per the Building Owner/Owner's Representative. The dumpster shall be completely enclosed and locked. N. Clean, dismantle, remove, and replace all items and equipment which should be moved prior to asbestos cleanup. 0. Dismount all fire, electrical, and mechanical fixtures and appurtenances required for proper execution of this contract. A licensed electrician is required and shall be trained on use of a respirator and handling asbestos materials. P. Required pre-abatement documentation shall include all of the following: 1. Documentation that the firm and its employees are familiar with the following regulations of the United States Department of Labor (USDOL), (OSHA) and the USEPA relating to the application, removal, disposal and treatment of asbestos: a. USEPA Regulations for Asbestos (C.F.R., Title 40, Part 61, Subparts A and M National Emissions Standards for Hazardous Air Pollutants (NESHAPS). b. USDOL OSHA Asbestos Regulations (C.F.R., Title 29, Part Section 1910 and 1926). c. American National Standard Practices for Respiratory Protection (ANSI) Z d. Any other applicable Federal, State, County or Local. rules or regulations. 2. Furnish proof that all workers on the job (supervisors and asbestos workers) have been given medical examinations within the past year as required by OSHA regulations, 29 C.F.R At a minimum, the examination should include a chest X-ray interpreted by a B-reader, a medical history with specific reference to respiratory disease and pulmonary function tests. 3. Contractor will provide the names, addresses, license numbers, NJDEP placards and any other related information for each and every transporter that is contracted to remove any waste material (asbestos and other) from the subject site. No waste removal will be allowed until the information is provided to, and reviewed by, representatives of NJDEP and the Project Manager. Q. The contractor shall notify the proper agencies in writing prior to the start of an asbestos removal project in accordance with current Local, State and Federal Regulations

4 R. Documentation to be available at the job site shall include: 1. A sign in black letters greater than four inches (4") in height stating the following: "LICENSED BY THE STATE OF NEW JERSEY FOR ASBESTOS WORK" 2. The sign shall be readily visible to the outdoors at the work site. 3. An official copy of the Contractor's license obtained from the New Jersey Department of Labor. 4. List of emergency telephone numbers to include: The monitoring firm employed by the Building Owner, EPA, OSHA, DOH, DCA, fire, police, local hospital, and emergency squad. 5. The contractor shall establish work area emergency procedures and shall have such a plan posted in view. In case of an emergency, decontamination procedures shall not impede emergency procedures. 6. List of personnel including all new employees. S. The Owner, Owner's Representatives, Project Manager, and the representatives of agencies having lawful jurisdiction shall at all times have access to the work area whether work is in preparation or progress. T. Throughout the removal and cleaning operations, monitoring for airborne asbestos fibers shall be conducted to ensure that the contractor is complying with all codes, regulations, ordinances, and requirements of this specification. U. Listed below are materials, equipment, and tools generally used in asbestos removal operations. It is not inferred; however, that all materials listed are necessarily required in every asbestos removal project and, in some instances, materials required to complete the work may not be listed. 1. Protective Clothing: Shall be fire retardant manufactured of "Tyvek" by DuPont (or approved equal) consist of disposable full body coveralls, head-covers, and boots as required by the most stringent OSHA standards applicable to the work. 2. Plastic Film: All plastic film used on this project shall be fire retardant. Provide a minimum six (6) mil thickness fire rated polyethylene. The plastic sheeting shall be taped securely in place or stapled or fastened by spray-on adhesives, glue beads, horizontal wood battens, or the equivalent. Where work procedures are in view of the public, black or opaque six (6) mil thickness fire rated polyethylene shall be utilized. 3. Adhesives: Tape shall be high quality tape (asbestos tape, duct tape, or approved equal) in 2" or 3" widths with an adhesive formulated to aggressively stick. 4. Disposal Bags: Shall be six (6) mil polyethylene bags of a sufficient size for the application. The bags shall be printed with letters of sufficient size and contrast to be

5 readily visible and legible. Each bag shall contain the US DOT Class 9 (miscellaneous) hazardous material label. The label shall state as a minimum: DANGER Contains Asbestos Fibers Avoid Creating Dust Cancer and Lung Disease Hazard Avoid Breathing Airborne Asbestos Fibers And Asbestos NA 2212,RQ 5. gns: Provide caution signs (14" x 20") with red background, lettered in black. It shall be displayed at all routes of access and all visual and physical barriers as follows as a minimum: Legend Notation - Danger 1" Sans Serif Gothic or Block - Asbestos 1" Sans Serif Gothic or Block - Cancer and Lung Disease Hazard %" Sans Serif Gothic or Block - Authorized Personnel Only V2" Gothic - Respirators and Protective Clothing are Required in 4" Gothic this Area a. The sign shall meet OSHA Standards 29 C.F.R It is the contractor's responsibility to verify the detailed requirements of all codes, standards, and regulations to verify that the items procured for use in this work meet or exceed the specified requirements. V. Post-Removal Sampling: The release criteria for the floor tile asbestos abatement project at the North Wing shall be <70 s/mm 2 by the average concentration of asbestos of five (5) air samples collected within the affected work areas and analyzed by the Transmission Electron Microscopy (TEM) Method. W. If the post-removal air tests or final inspections fail to meet the evaluation criteria, the contractor shall be liable for the cost of additional air tests and inspections conducted by the asbestos safety technician to verify compliance. X. Asbestos abatement work is complete upon meeting the work area clearance criteria and fulfilling the following: 1. Remove all equipment, materials, and debris from the work site. 2. Dispose of all asbestos-containing waste material

6 3. Repair or replace all interior finishes damaged during the course of the asbestos abatement. 4. Fulfill project closeout requirements. Y. The contractor shall submit a report to the Owner upon completion of the removal project. The report shall contain: 1. All Daily Logs 2. Operational Data 3. Summary of all daily OSHA compliance test results. 4. Any updated medical reports. 5. Proof those employees were notified if exposure levels exceeded current standards. 6. Documented proof (receipts) that all asbestos materials have been properly disposed of in a legal, regulated landfill. Z. Request for payment shall be withheld if all reports are not complete. AA.
