COPIES OF ALL DOCUMENTS CONSIDERED ARE IN THE MINUTE BOOK 90/16 MINUTES That the minutes of the meeting held on 13 September 2016, having been printed and circulated, be taken as read and be confirmed and signed by the Chairman as a correct record. 91/16 PUBLIC QUESTIONS/STATEMENTS A statement was read out by a representative from the Association of Rural Communities regarding accreditation of small campsites by the Camping & Caravanning Club and retrospective planning applications. Application [Plans List No Application No - Proposal] and Decision [Note: These decisions are recorded in the order in which they appeared in the Schedule of Planning Applications NOT the order in which they were considered by the Committee.] Application: List No 1: R/49/59; Application for full planning permission for conversion of barn to form a local occupancy dwelling, Barn, Red Gate Lane, Askrigg. Decision: That, subject to the receipt of satisfactory amended plans showing window and door details, permission be granted subject to completion of a S106 agreement restricting occupancy of the dwelling to local people in housing need (as defined in the emerging local plan) and conditions to include the following: - Standard three year implementation - Development to be constructed in accordance with the approved plans - Provision of parking spaces to be available prior to first use - Works in accordance with structural survey and methodology - Retention of architectural features (specified) - Submission of pre-conversion photographic record (a) Sample of walling and pointing (b) Sample of roof material (c) Windows and doors (including recess), rainwater goods, cills/lintels/jambs, flues, boundary treatment, bin storage, etc. - Restriction on external lighting - Approval of hard landscaping and planting - Provision of bat/bird boxes - Removal of permitted development rights -Extent of residential curtilage Application: List No 2: R/56/474; Application for full planning permission for demolition of modern extensions and conversion of barn to form a three bedroom dwelling for holiday accommodation, Bands Lane, Gayle. Decision: That planning permission be granted subject to a S106 legal agreement to restrict the occupation of the building to holiday letting (or local occupancy if requested by applicant) and conditions based upon the following:

Decision: That planning permission be refused for the following reasons: 1) In the opinion of the local planning authority the proposed rear extension would, by reason of its siting, scale, design and appearance, result in substantial harm to the architectural and historic interest of the grade II listed building. The form of the extension would be harmfully discordant with the character, scale and architectural special interest of the overall building and the extensive harmful loss of the outshot and external walling has not been justified as being exceptional. The works are therefore considered to be contrary to saved policies GP1 and B13 of the Yorkshire Dales Local Plan (2006) and paragraphs of the National Planning Policy Framework (2012). 2) In the opinion of the local planning authority, the proposed rear extension would, by reason of its scale, height and projection, have a harmfully discordant impact on the northern elevation of the cottage, which is prominent within the Arncliffe conservation area. The proposal would therefore neither preserve nor enhance the character and appearance of the conservation area, contrary to saved policies GP1, GP2 and B8 of the Yorkshire Dales Local Plan (2006), and paragraph 31 of the National Planning Policy Framework. Application: List No 4: C/03/56/LB; Application for listed building consent for erection of extensions to the rear elevation, High Green Cottage, Monks Road, Arncliffe. Decision: That full planning permission be refused for the following reasons: 1) In the opinion of the local planning authority the proposed rear extension would, by reason of its siting, scale, design and appearance, result in substantial harm to the architectural and historic interest of the grade II listed building. The form of the extension would be harmfully discordant with the character, scale and architectural special interest of the overall building and the extensive harmful loss of the outshot and external walling has not been justified as being exceptional. The works are therefore considered to be contrary to saved policies GP1 and B13 of the Yorkshire Dales Local Plan (2006) and paragraphs of the National Planning Policy Framework (2012). AND Submission of archaeological watching brief Application: List No 9: S/03/41F; Application for full planning permission for change of use of existing building to a live work unit (part retrospective), Builders Yard, Millthrop, Sedbergh. Decision: That permission be granted subject to the completion of a Section 106 Agreement to restrict residential use of the live/work unit (including land within the curtilage and floorspace within the building) and occupation to a person working full time in the business, and also to conditions including the following: -time limit for reducing the area of the living accommodation -approved plans and details -the building be limited to the storage of building materials, reclaimed materials, plant, tools and equipment associated with the applicant s business -control of electrically powered tools -hours of use of electrically powered tools -removal of permitted development rights -control over external lighting

6 96/16 ENFORCEMENT ITEM UNAUTHORISED USE OF GARAGE AS A SEPARATE DWELLINGHOUSE, HAWTHORN HOUSE, KETTLEWELL (REF EC/46/101) CONSIDERED the report of the Enforcement Officer. That consideration of enforcement action be deferred for a further month, pending the submission of a planning application. In the event that an application is not received, then a further report will be brought back to the Planning Committee in November for Members consideration. 97/16 REPORT OF HEAD OF DEVELOPMENT MANAGEMENT CONSIDERED - the report of the Head of Development Management.
