1 STANDARD TO TRACE WOOD LEGALITY (VERSION 3.2) OUTCOME OF WORKSHOP ON 15 JUNE 2006 Wood is called legal if the justness of wood origin, felling permit, felling system and procedure, transport administration and documentation, processing, and its trade or transferal can be verified as complying with all applicable legal requirements. A.1 STANDARD FOR WOOD ORIGIN FROM MANAGEMENT UNIT BASED STATE FOREST (HA, HT) Principle Criteria Indicator Verifier P1. Area certainty and utilization right K1.1 Forest management unit (HPH, IUPHHK-HA, IUPHHK-HT, HPHTI or area managed by Perum Perhutani) is located in the production forest area Management unit is able to show the IUPHHK permit legality. a. HPH/HTI/IUPHHK-HA/IUPHHK-HT Decree document, temporary or definitive. b. Compatibility of UM location with the Forest and Waters Area Map (Area which process has not been completed uses the TGHK Compatible-integrated Map with RTRWP). c. Show the contribution settlement evidence of the wood forest product utilization permit/iuphhk and PBB (Land and Building Tax) of the running year. d. Border Structure Minutes, by taking account of the community opinion consideration records concerning such management unit forest area. e. Checking of the area function shift document in case an area function change takes place.

2 K1.2 Management unit is in possession of the felling permit at the felling area legalized by the authorized official Annual work plan (RKT work chart) has been legalized by the authorized official and can be proven in the field. a. RKT/work chart document and its appendix, which show that the following areas are not felled: buffer zones, steep areas, critical habitats, and areas with cultural values, such as traditional areas, sacred places, or those identified as areas of cultural value. b. The applicable RKT composition technical instructions are fulfilled Management unit is not felling outside the permitted area, as shown by the legal Felling Plan. a. RKT document with its Map appendixes. b. Clear marking of the felling block location/rkt block on the map, and can be proven in the field. P2. Comply with the legal felling system and procedure K2.1 Legal Work Plan is available The forest management unit has a legal plan according to the applicable regulations. a. RK-UPHH document (still in process is possible) and its appendixes. b. RKL-UPHH (still in process is possible) and its appendixes. c. RKT-Work Chart and its appendixes. K2.2 Management unit complies with the requirements, which are aimed to ensure the Forest Product Conservation The felling operation complies with the requirements mentioned in the applicable silviculture system directive. a. The felling administration documentation (measurement book, LHP) proves that: - Felling of restricted types is not carried out. - Felling is not exceeding the permitted allocation.

3 b. Data on the measurement book and LHP are according to LHC. c. Identity/permanent marking on felled wood (stump and trunk for natural forest) /for this plant forest is not applicable (See 3.2d). d. SOP RIL and felling SOP are according to the implementation in the field. e. Legal documents for types included in the CITES Appendix All equipments used in the permanent activities have possessed the equipment utilization permit, and the physical conformity can be proven in the field. a. Master List of equipments. b. Equipment import and utilization permit. c. Equipment utilization extension permit. d. Equipment transfer permit. K.2.3 The management unit guarantees that all wood transported from TPn to TPK and from TPK to IPKH/market has physical identity and legal documents Transportation of wood from the Wood Collection Place (TPn) to the Wood Accumulation Place (TPK) uses legal transportation documents. a. Measurement Book. b. Log Transportation List (DP). c. DK (from the intermediary TPK to the TPK uses skshh files/archives and attached DHH).

4 2.3.2 Logs have permanent physical marks, which contain sufficient information to trace to the stump, and for plant forest to trace to the smallest felling unit. a. Trunk permanent identity, indicated on both ends of trunk (base and top). The permanent identity on trunks for wood from the natural forest includes: - Management unit identity - Trunk number according to tree number on LHC. - Number of trunk piece. - Number of felling plot. - RKT year or Work Chart. - Type of tree. - Dimension (diameter and length) of trunk. b. The management unit identity, LHC tree number, type of tree, number of felling plot, and RKT year/work Chart are indicated on the stump. c. Trunks at TPK or intermediary TPK are marked with palu tok DK on both ends. d. Identity of wood, produced from the IUPHHK-HT, is consistently applied by the management unit The management unit is able to prove the availability of records for transportation of wood to outside the TPK, including to the facilities of the Wood Forest Product Primary Industry (PHHK), using legal documents as regulated in the PUHH. a. LHP. b. Attached skshh files/archives and DHH (for natural forest); delivery invoice for transportation of wood from plant forest are proven. c. Other legal documents.

5 K2.4 The management unit has paid off the government retribution requirement related to wood The management unit shows the settlement evidences of the reforestation fund (DR), forest resource provision (PSDH) and PPh-21. a. DR and PSDH payment evidences (for natural forest management unit). b. PSDH payment evidence (for plant forest management unit). c. Document of PPh-21 payment evidence of the running year. P3. Taking account of the environment and social aspects related to felling. K3.1 The management unit has possessed the AMDAL (Environment Impact Analysis) and implemented the obligations required in the AMDAL document The management unit has possessed the AMDAL document (ANDAL, RKL, RPL), which is legalized according to the applicable regulations, covering its entire work area. a. AMDAL document (ANDAL, RKL and RPL) The management unit is required to draw up the Monitoring Report based on the RPL AMDAL, which shows the actions to overcome environment impacts and to provide social benefit. a. Current RPL AMDAL document. b. RPL AMDAL monitoring and evaluation document. c. PMDH document. d. Diagnostic study or others on the social condition of the community in the surroundings of the UM location The management unit fulfills the obligation to reduce physical impacts toward the hydrology structure. a. Current RPL AMDAL document. b. RPK AMDAL monitoring and evaluation document. c. Availability of SOP RIL documents.

6 3.1.4 The management unit applies the identification procedure and protection of protected and extinct threatened species, which habitat and exploration space is within the management unit. a. Available pf CITES document. b. Location of the identified protection strategy. c. Availability of felling SOP RIL/SOP document. d. Topography map and tree position for the application of RIL. K3.2 The management unit shows commitment toward welfare of the local community and guarantees the safety and welfare of workers The management unit has conducted public consultation to the local community, which will be affected by the activity impact and takes account (including protects) of its interest. a. Public consultation minutes document. b. Documentation of traditional rights claimed by the local community. c. Documentation of agreement with the legal community in the framework of increasing the welfare of the local community (which clearly mentions social welfare and the community development activities to be handled). d. Document of problem solving in the area and/or natural resources with regard to the traditional rights of the local community affected by the impacts. e. Minutes of meeting/consultation with the community. f. RKT work map, which has accommodated the interest of the community.

7 g. PMDH document. h. Document of the outcome of study on the social condition of the community in the surroundings of UM The management unit has applied the manpower regulations, which are relevant to wood legality. a. KKB document/or company regulations on manpower. b. Existence of trade union. c. Implementation of UMR policy and provision of in kind benefit. d. Documents of agreements as result of negotiation between the management unit and the trade union. e. Level of work accident and health of workers. f. Availability of Emergency Rescue Equipment (APD) and First Aid (P3K), which are usable and within easy reach. g. Records of employee working hours.

8 A.2 STANDARD FOR WOOD ORIGIN FROM STATE FOREST BASED ON MANAGEMENT BY THE COMMUNITY (INCLUDING MANAGEMENT BY THE TRADITIONAL COMMUNITY) Principle Criteria Indicator Verifier P1. 9 2.1.2 Management unit is able to prove the wood origin from the determined felling area a. Felling arrangement plan. b. Felling records. c. Applied wood tracing system. d. Physical marks on wood and its origin Management unit applies efforts to protect agreed forest resource. a. Records or regulations on efforts to protect agreed forest (including local). b. Application of such agreement in the field. K2.2 Payment of government retribution obligation in the forestry sector Management unit settles government retributions in the forestry sector Management unit is able to prove legal wood transportation documents. a. PPh-21 b. DR c. PSDH a. Sales invoice b. Skshh c. Other transaction evidences.

10 B. STANDARD FOR WOOD ORIGIN FROM STATE FOREST NOT BASED ON MANAGEMENT UNIT Principle Criteria Indicator Verifier P1. Other legal permits on wood forest product utilization. Permit to borrow for use the forest area for non-forestry activities in the legal production forest. b. Appendix map of permit to borrow for use. c. IPK permit for the area borrowed for use. d. IPK appendix map for the area permitted to borrow for use. e. Legal document of area status change (refer to 1.1.2b. Status change and forest area allocation (besides HPK) into nonforest area should be through an integrated research; and upon the approval of DPR for certain matters that are very important, have a wide scale and impact, and have a strategic value). f. 11 1.3.2 The entire IPK location is located in the conversion area, which is inside the HPK area. (P2) Conformity with the felling and wood transportation system and procedure. K2.1 Conformity of IPK plan and implementation with the land planning allocation IPK/ILS has a legalized work plan Business actor is able to show that large logs, produced from ILS/IPK can be traced until the stump, and can be traced until the felling block for other wood. a. Documentation of IPK plan. b. Plan map for land allocation (landscaping) c. Annual work plan for forest clearance. a. The documentation system of log tracing ( lacak balak ), applied by the IPK permit holder, is available. b. Document of stand potential at the conversion area. c. Document of wood production. K2.2 Complies with obligation to pay government retribution and legality of wood transportation Business actor shows settlement evidence of government retribution in the forestry sector IPK/ILS permit holder should be able to prove legal wood transportation documents. d. Conformity of heavy equipment amount and types used in the field. a. DR and PSDH payment evidence. b. Document of PPh-21 payment evidence of the running year. a. Transportation invoice (for KBK and BBS) for pulp industry. b. Skshh (KBB, KBS) completed with DHH for IPHHK.

12 C. FOR PROPRIETARY RIGHT FOREST AND NON-FOREST AREA Principle Criteria Indicator Verifier P1. 13 D. STANDARD TO TRACE WOOD LEGALITY FOR TRANSPORTATION, PROCESSING AND TRANSPORTATION OF PROCESSED PRODUCTS. Principle Criteria Indicator Verifier P1. The Wood Forest Product processing industry supports the implementation of legal wood trade. K1.1 Business unit: (a) Intermediary traders, (b) Processing industry, and (c) Processed product exporters, have legal permits The intermediary trader business unit has a legal permit The processing industry has a legal permit. a. In possession of the Industry Raw Material Compliance Plan (RPBBI) The processed wood product exporter is a producing exporter is in possession of a legal permit. a. Company Establishment Deed b. 14 K1.2 Business actor guarantees that the origin of all transported, controlled or owned wood can be identified, accompanied by legal documents All wood transported, owned or controlled by the business unit have legal wood origin evidences. a. The business unit has and applies the system to trace wood, which guarantees tracing of wood from its origin. K2.1 Existence and application of the system to trace wood and its processed products IPHHK is able to prove that the received raw materials originate from legal sources IPHHK owns and applies the system to trace wood and its processed products. a. Sales and purchase document (including contract). b. Wood handover minutes (invalidates skshh). c. Imported wood with legal certificate. a. RPBBI for primary industry. b. Production tally sheet. c. Report of processed products. d. IPHHK production is not exceeding the permitted production capacity. P3. Legality of processed wood trade or transferal K3.1 Inter-island transportation and trade Business actor who transports forest products inter-island possessed the PKAPT permit. a. SIUP b. Company Establishment Deed c. Company Registration d. NPWP e. PKAPT document.

15 3.1.2 The inter-island transportation of wood or wood processed products should use an Indonesian flag carrier and has a legal permit. a. Skshh/Invoice document, which indicated the processed wood origin identity. b. Ship transportation document, according to what is indicated in the skshh/invoice. c. File of Fixture Note. d. SIUPAL/SIOPSUS/PELRA K3.2 Shipment of wood processed products for export Wood transported by PKAPT is equipped with legal documents and the wood physical characteristics are according to the applicable forestry regulations Shipment of wood processed products should comply with the conformity of PEB and skshh documents The exported wood product type complies with the export legality. a. Skshh and DHH b. Invoice indicating origin information (skshh and DHH origin) c. Other legal transportation documents. d. Wood physical characteristics. a. PEB b. Packing list c. Invoice d.
