2 Safety Codes Act Creates the Safety Codes Council Sets out powers and responsibilities Minister, Administrators, Safety Codes Officers, the Safety Codes Council, Owners, Designers, Manufacturers, Contractors, and Vendors. Establishes administrative and enforcement rules Variances, Permits, Certificates, Orders, Appeals, Investigations, Offences, Penalties. The Safety System works best when the participants know their roles and the way the rules work.
3 National System Building, Fire, and Plumbing - NRC Provincial Territorial Policy Advisory Committee on Codes (PTPACC) group of regulators from across Canada who advise on code development Gas, Electrical, Elevating Devices, Boilers Standards Council of Canada National Public Safety Advisory Committee (NPSAC) for other codes Code users participate on the various code development/writing committees Leads to the publishing of a code by the Standards Development Organization Not yet enforceable
4 Provincial System Electrical, PSDS Safety Codes Council PSDS SOP, EUC, CEIOGF Code users participate on the various code development/writing committees Leads to the publishing of a code by the Standards Development Organization Not yet enforceable
5 Regulations There are 19 Regulations under the SCA Can only regulate what the Act says can be regulated. Adopt Codes and Standards Certification (PSDS installers, Master Electricians, Power Engineers) Program Management (Propane Vehicle Conversions, Pressure Equipment Safety) Administrative Procedures (Permits, etc.)
6 Non GoA Documents Municipal Bylaws The SCA allows municipalities to make bylaws related to Safety Codes issues, but explicitly states that these bylaws can not regulate anything already regulated under the SCA. Safety Codes Council Bylaws and Policy These rules or policies, insofar as they relate to safety codes issues, must function within the framework established by the Act.
7 Making Rules Legislature (house). All MLAs vote. Statutes (Acts). Any amendments to the Act need to go through the legislature. Cabinet (All Ministers vote) Most of our Regulations (including code adoption) Minister Some regulations (exemptions) Ministerial Orders (appointment of administrators, etc.) Administrator (Interpreting rules) Province-wide variances (STANDATA)
