NO. 14 Original Sheet No. 2 Rules and Regulations Rules and Remlations for the Government of Solid Waste Disposal Facilities, adopted by U the Public Service Commission of West Virginia, and now in effect, and all amendments thereto and modifications thereof hereafter made by said Commission. Operating Hours This facility will be open from 8:OO a.m. to 4:OO pm., Monday Though Friday. Free Day The first Thursday of each month shall be designated residential fiee day in compliance with West Viraa Code Hours of accepting free day residential customers will be 8:OO am. to 4:OO p.m. If the first Thursday of the month, i.e., its regularly scheduled Free Day falls on a holiday, the designated Free Day for that month shall be the following Thursday. Holidav Schedule Holidays for which this facility will be closed are as follows: New Years Day Veterans Day President s Day ThaIiksgiving Day Good Friday Christmas Eve-The LanKdl vdl close at noon Memorial Day Christmas Day Independence Day New Years Eve-The Landfill will close at noon Labor Day If any designated holiday, as currently set forth above, falls on a Monday, the landfill will be open &om 1:00 p.m. to 4:OO p.m., provided, however, that the Authority shall give notice to the public of the modifications/clarifications by posting signs thereof at the landfd gate andor printing notice thereof on its receipts. Billing and Collecting Charges for landfill use must be paid at the time of disposal unless the Authority has approved a credit agreement in advance. Delayed Payment Penaltv A delayed payment penalty of ten percent (10%) shall be added to all bills over 30 days past due. This penalty is not interest and shall be assessed as a one-time charge. NO. 14 Original Sheet No. 3 - Rates (1) MSW Disposal fee $47.50 per ton, including assessment fees $ minimum charge, including assessment fees Tires-Passenger $ 2.00 Passenger on rim $ 2.50 Truck ( ) $ 5.00 Truck on rim $ 6.00 All Others to be negotiated In addition, waste in vehicles which requires additional assistance (e.g., fkozen or hot loads) shall be subject to an additional charge, to be negotiated by the Landfill Manager. Special Arrangements The following materials to be negotiated by the Landfill Manager: (a) Materials that are identified by WVDEP as special solid waste (e.g. shredder fluff, insulation and other lightweight materials, ash, fiee liquids or containerized liquids, drums, pesticide containers, animal carcasses, contaminated soils, carbon black), which require prior regulatory approval. (b) Materials that require special handling. (c) Materials that can be reused., composted or recycled (e.g., tires and shredded rubber, asphalt, sawdust, fish by-products, yard waste, concrete and brick, other bulk organic waste. The Landfill Manager will negotiate the volume of materials to be accepted and the specific details of the disposal, including time, place, rate and conditions. All other waste will be handled and disposed of through special arrangements or special contracts with the party offering the waste for hsposal. The Landfill Manager may negotiate contracts to guarantee disposal rates. (I) Indicates increase T:\TARIFFS\LANDFILL\TUCKER -CNTY-SOLID-WASE-AUTHORITY-#I 4-(CURRENT). DOC

NO. 14 Original Sheet No. 4 Refusal of Service The Lan&ll Manager shall have the right to refuse or limit service to any customer in the following situations andlor conchtions: (a) (b) (c) (d) (e) (f) (g) (h) (I) Any material that is hazardous waste or is suspected to be hazardous waste, as defmed by WVDEPWSEPA, will not be accepted. Any load of mixed hazardous and non-hazardous waste will not be accepted. Waste that required prior or special approval by the Waste Management Section of MTVDEP will not be accepted without prior approval. Waste material requiring special handling will be rejected unless the Landfill Manager and the party offering such waste agree on the cost of accepting, handling and disposing of said waste. Materials presented for disposal containing free liquids or containerized liquids may be rejected by the Landfill Manager unless prior approval is received from the proper regulatory authority and agreements made under Special Arrangements above. Barrels, b s or waste in barrels or drurns, whether whole or crushed, may be rejected by the Lrndfd Manager. Any material which contains PCBs in a concentration of 50 parts per million or greater will be rejected. Laboratory tests are required to show a PCB concentration of less than 50 parts per million. Material containing pesticides, infectious waste or incinerator ash will be rejected. Such waste may be accepted by separate agreement after obtaining approval from the proper regulatory authority. Material containing asbestos will not be accepted.
