7 Athens-Hocking Joint Solid Waste Management District Plan Update 2012 I. Introduction A. Plan Approval Date, Counties in District and Planning Period Length 1. Under the current approved plan: Date of Ohio EPA approval: December 12, 2005 Counties in the District: Athens County and Hocking County Years in the planning period: 15 years 2. Plan to be implemented with approval of this document: Counties in the District: Athens County and Hocking County Years in the planning period: 15 years Year one of the planning period: 2012 B. Reason for Plan Submittal This plan is submitted for approval as required for the mandatory five year plan update. C. Process to Determine Material Change of Circumstances Ohio law [ORC Section (D)] requires district plans to be updated when the District Board of Directors 1 determine that circumstances are materially changed from those addressed in the approved plan. If a plan update is required due to a material change in circumstances, the plan update must address those portions of the plan that need to be modified due to the change. A plan amendment involving fees or designation that does not require modification of any other part of the plan requires ratification, but not Ohio Environmental Protection Agency approval. However, if any other portion of the plan is modified, the entire plan must be updated. Moreover, the updated plan must be ratified, submitted to Ohio EPA, and obtain Ohio EPA=s approval prior to becoming effective. 1. Determination Criteria In determining whether a material change has occurred, the Board of Commissioners will consider the following: a. Waste generation; including the addition or loss of industrial waste generation, commercial waste generation, and/or residential waste generation. b. Change in the availability of capacity, causing a capacity shortfall prior to the next planned five-year update to the District Plan. c. Strategies for waste reduction and/or recycling, limiting the ability of the district to honor the reduction goals itemized in the State Plan. d. The availability of revenues for plan implementation. e. Changes in the procedures to be followed for plan implementation; f. Changes in the timetable for implementation of programs and/or activities; g. Any other factor that the Board considers relevant. 1 The three Athens County Commissioners and the three Hocking County Commissioners serve as the Athens-Hocking Joint Solid Waste Management District Board of Directors. 8 Athens-Hocking Joint Solid Waste Management District Plan Update Monitoring Procedures The Determination Criteria will be evaluated on the basis of information obtained through the District Policy Committee=s annual review of the approved plan, and/or the District Staff=s monitoring programs. The staff monitoring program includes the following: a. Quarterly analysis of District revenues; b. Analysis of information acquired by District Staff for preparation of the District's Annual Report for Ohio EPA; c. Information acquired by District Staff through follow-up investigations of citizen complaints which indicate the existence of deviations from or noncompliance with the District plan; and d. Analysis of information voluntarily provided to the District Staff by state or local officials and employees, or owners and operators of solid waste collection, disposal, transfer, or recycling operations, which indicate the existence of deviations from and/or noncompliance with the District's plan. The Policy Committee or the District's staff will immediately notify the Board of Commissioners of any reliable information that is likely to establish that a significant or substantial change from the circumstances addressed in the District's approved plan has occurred. 3. Timetable for Making the Material Change Determination Within 10 days from receipt of notification from the District Staff under paragraph 2, above, the Board of Directors shall request the District Staff to prepare a report which discusses the effects that the changed circumstances identified in the District s Staff notice to the Board of Directors may have on the criteria listed in Section C.1. of this chapter, The District Staff shall prepare the report and submit it to the Board of Directors within thirty days of the Board s request. Within ten days after the receipt of the District Staff s report, the Board shall decide whether additional information is necessary for the Board to determine whether a material change has occurred. If the Board determines that additional information is required, the District Staff shall revise its report to include such additional information and submit its final report within twenty days from the Board s request for additional information. Within sixty days after the Board's receipt of the District Staff's final report, the Board shall make a determination of whether the changed circumstances are material pursuant to the criteria listed in paragraph 1, above. During that time, the Board may obtain such information from sources other than the District Staff as the Board deems necessary and proper to making its determination of whether a material change has occurred. 4. Notification Procedure After Making Determination Upon the Board's determination that a material change has occurred, the Board shall notify the District Policy Committee, in writing, within ten days of the Board's determination. The Board's notice shall request the District Policy Committee to prepare a draft amended solid waste plan, pursuant to ORC (D), that amends the district plan to address the direct and indirect effects of any such material change in circumstances. The Board of Directors will also notify Ohio EPA of its determination. D. District Formation and Certification Statement The District s configuration has remained the same since the submittal of the District s approved Plan. A copy of the resolution of District formation is found in Appendix A. I - 2

Appendix C includes the resolution signed by the Policy Committee members asserting that the contents of the draft Plan are true and accurate, a resolution adopting the Plan prior to ratification, and a resolution certifying that the Plan has been properly ratified. This is the draft Athens-Hocking Joint Solid Waste Management District Plan Update for OEPA review and non-binding opinion. This is the five year update of a plan which was approved by the Ohio Environmental Protection Agency December 12, This plan has been submitted to the Ohio EPA for an advisory review. Following the review by Ohio EPA, revisions were made to respond to OEPA s comments. The revised plan is now available for a thirty-day public review and comment period. Following the public comment period, a public hearing will be held to give interested parties and the public an opportunity to ask questions and make comments regarding the plan. The District Policy Committee will review the comments and will, if they identify a compelling reason, make changes in the plan based on the public comments. Once the Policy Committee has approved the revised Plan, it will be delivered to the legislative authority of each municipal corporation and township in the district for review and ratification. During the 90-day ratification period, each county and political subdivision within the two counties will be asked to vote on the plan by means of a resolution or ordinance. The ratified plan will be sent to the Ohio Environmental Protection Agency for final review and approval. The District was assisted in the preparation of this plan by Waste Alternatives, Inc. of Mount Vernon, Ohio, solid waste and recycling planning consultants. The majority of the data regarding solid waste generation, waste flow patterns, recycling, and waste reduction is data for calendar year 2009 and was collected by the District and Waste Alternatives, Inc. in This plan provides direction to the District for reducing waste and increasing recycling by continuing and expanding participation in the programs and activities the District has already initiated. Overview of Existing Program and Facilities The reference year for the inventories and projections in this plan is calendar year The first year of the planning period is 2012 and the last year is In 2009, the Athens-Hocking District utilized one in-district, six out-of-district, and one out-of-state landfill for the disposal of solid waste. There was one in-district publicly available landfill accepting municipal solid waste in 2009 Athens-Hocking Reclamation Center. II-1

13 Athens-Hocking Joint Solid Waste Management District Plan Update 2012 There are no resource recovery (Incineration with energy recovery) facilities for the disposal of solid waste in the District and no waste from the District was disposed of in a resource recovery facility in There are no transfer facilities operating in the District. Solid waste from the District was taken to four out-of-district transfer facilities. The center of Athens-Hocking Solid Waste Management District=s recycling program is the non-profit Athens-Hocking Recycling Center. The Recycling Center processes and markets recyclable materials collected from all of the residential curbside and most of the drop-off programs operating in the District. The Center also processes some materials from commercial and industrial sources.. The Athens-Hocking Recycling Center provides pay-as-you throw 1 waste collection and curbside recycling services to residents of the City of Athens through a contract with the city of Athens. In the reference year, weekly or bi-weekly residential curbside recycling coupled with pay-as-you-throw waste collection was offered to residents in Albany, Amesville, densely populated areas surrounding Athens City, and The Plains. These programs continue. There were a few residential curbside subscribers in Nelsonville and Logan. The District operates several drop-off recycling sites including two full-time drop-off sites, one at the Athens County material recovery facility and one in Logan. Rural areas are served by a drop-off program using compartmentalized trailers or trucks, and bins which are, at a minimum, available for 4 hours a month at a specific time and at set locations. In the reference year, 2009 and continuing in 2010, the following sites were available in Athens County (additional information regarding the site locations is included in Table III-5): Buchtel Villages, Glouster Village, Guysville Village, Lee Township, Lodi Township, and Waterloo Township. The sites in Hocking County are Haydensville, Marion Township, Murray City, and Starr Township. The District is in the process of adding additional drop-off sites in both counties in order to expand access to recycling. The sites that will be used to provide access during the planning period are listed in Table VII-2.A. (page VII-6.) of the Plan. In addition to the programs provided by the District through Athens-Hocking Recycling, private waste haulers, scrap yards, out-of-district recyclers, and recycling brokers provide recycling opportunities and services, which are crucial to the implementation of this Plan. The District has not held a District wide household hazardous waste collection event. In the reference year, 2009, The City of Athens held a household hazardous waste collection for city residents There were two Class IV composting facilities accepting yard waste in One was operated by Ohio University and one by a private company in Hocking County. Ohio University operates a Class II facility which composts food and yard waste. Several municipalities in the District collect leaves in the fall and spread them on farm fields with the cooperation of local farmers. 1 Pay-as-you-throw or volume based rates is a system for charging for waste collection and disposal based on the volume or weight of the amount collected. In the Athens-Hocking District, pay as you throw programs are based on the volume of material set out for collection. II-2

Waste Generation Projections In 2009, the residential/commercial waste generation in the Athens-Hocking District was 68,909 tons which is 4.09 pounds per person per day. Industrial waste generation in 2009 was 3,189 tons based on actual disposal figures plus recycling reported by industries. Industry reported 1,734 tons recycled and 206 tons reduced; 1,249 tons of industrial waste from the District was landfilled. This Plan predicts slight growth in residential/commercial waste generation and no growth in industrial waste generation. Planned Waste Reduction Strategies The 2001 State Solid Waste Management Plan encourages Districts to implement programs which will lead to compliance with goals one and two of the state plan, but compliance with only one of the two goals is required. Goal #2 states: a) 25 percent waste reduction rate for the residential/commercial sector, b) 66 percent waste reduction rate of the industrial sector. In 2009, the Athens-Hocking District recycled 8.86% of the residential and commercial waste and 60.83% of the industrial waste. The District chooses to comply with Goal #1. Goal #1 in the 2001 State Solid Waste Management Plan is as follows: To obtain an Ohio EPA approved plan, a SWMD must demonstrate that at least 90 percent of the residential population in each county comprising the SWMD will have access to waste reduction and recycling programs by the third year following approval of the SWMD's solid waste management plan. These programs can be existing or new programs, but all programs used to demonstrate 90 percent access must be in place within three years of obtaining an approved solid waste management plan. All programs and activities being used to demonstrate compliance with the residential sector component of Goal #1 must collect a minimum of five of the materials identified as highly amenable to recovery from solid waste generated by the residential sector. The SWMD must also demonstrate that generators in the commercial/institutional sector have access to recycling or other alternative management methods for at least five of the materials identified as highly amenable to recovery from solid waste generated by the commercial/institutional sector. Recycling opportunities that qualify to demonstrate access are defined as drop-off recycling, nonsubscription curbside, subscription curbside, centralized material recovery facilities, or a combination of these. A formula is provided to determine how much credit each type of recycling is assigned toward reaching the 90% access goal. The population with access as calculated using the formula in 2009 was 78% in Athens County, 69% in Hocking County. The District is in the process of II-4

16 Athens-Hocking Joint Solid Waste Management District Plan Update 2012 setting up three additional drop-off recycling sites in Athens County and two in Hocking County to bring both counties up to 90% access or above. This Plan counts on the continuation of most of the existing curbside recycling programs and the continued operation of the existing multi-material drop-off sites. When the District s material recovery facility is completed, the District will concentrate on upgrading the drop-off sites so that they are easier to access and are more user friendly. To meet the goals of the new state plan, the District s public education program will focus on changing behavior to decrease waste and increase recycling. Programs will be targeted to waste generators. Target audiences were prioritized as: 1. Residents, 2. Communities and political leaders 3. Schools and school age youth, 4. Institutions and commercial businesses, and 5. Industries. Public education and marketing activities aimed at increasing participation in waste reduction and recycling minimum requirements: Web Site. The District will continue to have a web site. The web site shall include, at a minimum, a comprehensive resource guide and an Infrastructure Inventory. It will have links to public and private sector recycling programs and services. Comprehensive Resource Guide. The District will prepare, regularly update, and make available a compilation of reduction and recycling opportunities to address the recycling of specific materials including both common recyclables and difficult to manage materials. This guide will be available on the web site and as a printable document suitable for distribution. Infrastructure Inventory. The District will maintain and make available up-to-date information about solid waste recycling and management infrastructure. This information shall include curbside recycling programs, drop-off recycling locations, composting facilities, yard waste collection programs, hauler-provided recycling programs, and scrap recyclers and other recycling opportunities. Speaker/Presenter. The District will have staff or volunteers who can speak about District programs and make presentations on recycling and waste reduction topics. Assistance to commercial businesses and industries in developing or expanding recycling programs: District staff will work directly with business and industries that need information or technical assistance to develop or expand recycling. Industrial recycling survey: The District will survey industries at least every other year and will use the survey as a chance to communicate with industries and to make them aware of the resources that are available. Waste Disposal Capacity According to the facility data reports filed at Ohio EPA, the total amount of waste landfilled from the Athens-Hocking District in 2009 was 64,565 tons. This plan does not predict growth in waste generation and in disposal needs during the planning period. There is one publicly available landfills in the District and a number of landfills within a reasonable hauling distance from the District. The expected remaining capacity of the landfills that receive the majority of the District s waste extends well beyond 205 extends well beyond II-5

17 Athens-Hocking Joint Solid Waste Management District Plan Update 2012 Cost and Financing of Plan Implementation As in the plan under which the District is currently operating, the District is planning to rely on disposal fees at the landfill located inside the District as a funding source for District programs and activities. District disposal fees for solid waste landfilled in the District are now levied as follows: $1 per ton on the disposal of waste generated in the District; $2 per ton on the disposal of solid waste generated outside the boundaries of the District where the wastes are disposed of, but inside the State; $1 per ton on the disposal of solid waste generated outside the boundaries of the State. With the approval of this Plan, the District is enacting a generation fee in accordance with Section of the Ohio Revised Code. The generation fee is paid on each ton of municipal solid waste generated in the District and delivered to an Ohio transfer facility or an Ohio landfill for disposal. Beginning July 1, 2012, the District will collect a $3.00 per ton generation fee as provided in the Plan. This Plan includes a generation fee increase of $1.00 in January 1, The $3.00 per ton generation fee and the increase to $4.00 at the beginning 2018 will be enacted with the ratification of this Plan. However, the District will prepare an updated solid waste management Plan by the end of The District may adjust the fees up or down as needed when the Plan is updated in Until the next Plan Update, fees cannot be increased without being ratified. If the increase in the generation fee to $4.00 is not necessary, it can be rescinded when the Plan is updated in Athens-Hocking Recycling receives revenue from the sale of the recyclables that are processed and marketed by the Recycling Center. All of the proceeds from the sale of recyclables are used to fund the recycling services that are provided by the Recycling Center for the District. The District receives income from miscellaneous sources which include money that is collected to defray the cost of the handling or disposal of Ahard to dispose@ of items like Freon bearing appliances. Other sources include the sale of used equipment. This Plan includes a new materials recovery facility to be built and equipped by the District. It is anticipated that the Athens-Hocking Recycling Center will operate the facility. The expected cost of site improvements and the building is approximately $2,000,000. It may be less depending on the availability of suitable land at low or no cost and the method of construction selected. The District will be seeking grant funds and partnerships with municipalities, Ohio University, and other potential large generators of recyclables to properly equip the facility to meet the specific needs of the recycling streams to be managed. It is anticipated that a loan for $2,000,000 will be required. The District plans to repay the laon over a period of twenty years. Through an agreement with the city, the Athens-Hocking Recycling Center provides volume based waste collection and curbside recycling collection services to the City of Athens. Athens-Hocking Recycling is the recycling service provider for Ohio University. Athens-Hocking Recycling also has a number of subscription waste collection and recycling customers. In order to fully understand the mechanisms for funding the various services that are available to implement this Plan it is important to understand the relationship between the District and the Athens Hocking Recycling Center. For this reason, Chapter VIII includes a revenue and expense table for the non-profit Athens Hocking Recycling Center in addition to the revenue and expense table for the District. The District does not subsidize waste collection and disposal services provided by Athens-Hocking Recycling. These services are funded entirely by the entities for which waste collection and disposal services are provided. Athens Hocking Recycling Center s primary mission is to promote recycling. II-6

The District disposal fee on materials received at the in-district landfill is somewhat dependable, but it is subject to changing waste disposal patterns which may result in less out-ofdistrict and out-of-state waste coming to the landfill. District revenue could be substantially reduced were the landfill to close. Designation Fee: As a contingent funding mechanism, the District can implement facility designation fees. To implement a facility designation fee, the District will invite any landfill, transfer station, or other solid waste facility to be designated by the District provided that the facility enters into a designation agreement that requires the facility to collect and remit to the District a designation contract fee on each ton of solid waste generated in the Athens-Hocking Solid Waste District and received by the facility. The District is authorized pursuant to Section VI.E. of this Plan to establish facility designations in accordance with Section of the Ohio Revised Code. The District is also authorized pursuant to Section IX.A. of this Plan Update to adopt rules governing the use of facilities pursuant to Section (G) of the Ohio Revised Code. Rules After this updated plan has been approved by the Director of the Ohio Environmental Protection Agency, the Athens-Hocking Solid Waste Management District Board of Directors may, as the Board deems appropriate, adopt, amend, or rescind rules to the fullest extent authorized by Ohio Revised Code Section (G) and any other provision of Ohio law. The Plan includes procedures for the adoption or amendment of District rules. II-7

The Reference Year The reference year used for the inventories and projections included in this Plan is the calendar year The Athens-Hocking Solid Waste Management District began plan preparation in late The majority of the program information and the waste generation and recycling data used in this plan is for 2009 and was collected in B. Existing Solid Waste Landfills There is one privately owned landfill currently open and operating in the District. The Athens-Hocking Reclamation Center is located on State Route 33 on the Athens-Hocking County border. The majority of the landfill is located in Athens County. The solid waste landfills used by the District in 2009 are listed on Table III-1. The disposal data for Ohio landfills entered in Table III-1 is from the 2009 Facility Data Reports submitted by the listed facilities to Ohio EPA. In 2009, 133 tons of waste was taken out of state to a landfill in West Virginia. This amount was reported to Ohio EPA by the State of West Virginia and the name of the landfill was not reported. C. Existing Incinerators and Resource Recovery Facilities During 2009, no general municipal solid waste generated in the District was sent to publicly available or captive incinerators or resource recovery facilities (incineration with energy recovery) inside or outside of the District. D. Existing Transfer Facilities The transfer facilities used by the District in the reference year are listed on Table III-3. The disposal data for 2009 for transfer facilities that is entered on Table III-3 is from the 2009 Facilities Data Reports submitted by the facilities to the Ohio EPA. To the best of our knowledge no out-of-state transfer facilities were used in E. Existing Recycling and Household Hazardous Waste Collection Activities The center of Athens-Hocking Solid Waste Management District=s recycling program is the non-profit Athens Hocking Recycling Center which is referred to in this Plan as the Recycling Center or AHRC. The Recycling Center processes and markets recyclable materials collected from all of the residential curbside and most of the drop-off programs operating in the District. The AHRC also processes some materials from commercial and industrial sources. The curbside recycling programs are listed on Table III-4. All of the other recycling activities, programs and facilities used by the District in 2009 are listed on Table III-5. Narrative descriptions of these programs are included in Chapter IV of this Plan. The Athens-Hocking County Solid Waste Management District does not hold an annual household hazardous waste collection event. In the reference year, the City of Athens held an event for city residents. A narrative description of this event is included in Chapter IV of this Plan. III-1

21 Athens-Hocking Joint Solid Waste Management District Plan Update 2012 Most of the information about community based curbside and drop-off recycling programs was supplied by the District. It was supplemented with information directly from participating communities. The AHRC provides pay-as-you throw 1 waste collection and curbside recycling services to residents of the City of Athens through a contract with the city of Athens. Weekly or bi-weekly residential curbside recycling is offered to residents in the remainder of the District. The areas served by the program and the number of participants in 2009 are listed in Table III-3. The District operates several drop-off recycling sites. Information about District drop-off sites is listed in Table III-5. The information about privately provided recycling drop-offs and private recycling businesses listed in Table III-5 was collected using mail and phone surveys. F. Existing Composting/Yard Waste Management Facilities The compost facilities listed on Table III-6 are the only registered compost facilities known to be used by the District in 2009 for the management of food waste and yard waste. Several municipalities in the District collect leaves in the fall and spread them on farm fields with the cooperation of local farmers. The communities that reported field spreading leaves are listed on Table III-6. However, only one of the communities listed reported the amount diverted by this method in G. Existing Open Dumps and Tire Dumps The open dump sites that are listed on Table III-8 were identified by the Health Departments in Athens and Hocking County. H. Ash, Foundry Sand and Slag Disposal Sites No ash, foundry sand or slag disposal sites were identified in the District. Table III-9 has been omitted. I. Map of Facilities and Sites Small fold-out maps for each county that show solid waste and recycling facilities and programs are included at the end of this chapter following the tables. Large maps meeting the requirements of the Plan Format will be included in the Plan Update copies that are submitted to Ohio EPA for review. A master copy of the map will be retained by the District. J. Existing Collection Systems - Waste Haulers Table III-10 lists all of the haulers known to be providing waste collection services in Athens and Hocking Counties in All of these haulers were sent surveys in the mail and several attempts were made to contact the haulers that did not respond. Some haulers did not respond or declined to provide some of the information requested. 1 Pay-as-you-throw or volume based rate waste collection is a system for charging for waste collection and disposal based on the volume or weight of the amount collected. In the Athens-Hocking District, pay as you throw programs are based on the volume of material set out for collection. III-2
