1 DRAFT 3/02/203 The Republic of the Union of Myanmar Myanmar Investment Commission Notification No. /203 Naypyidaw, 5 th Pyatho Lapyikyaw 374 (3 January 203) Stipulation of types of economic activities The Republic of the Union of Myanmar, Myanmar Investment Commission, in exercise of the powers conferred under Section 56, sub-section (b) of the Foreign Investment Law, in stipulating the applicable business under Chapter 2 of the Foreign Investment Law, and with the approval of the Union Government, prescribes the list of economic activities which are prohibited, the list of economic activities which are allowed only in joint ventures with Myanmar nationals, and the list of economic activities which are allowed in accordance with certain separately stipulated ) List of economic activities which are prohibited No Types of economic activities. Production of arms and explosives related to defence and its related services. 2. Economic activities that can damage the rain forest, religious and cultural conservation areas, raw lands, mountain farm lands, and water resources. 3. Economic activities carrying out productions in factories and workshops and carrying out agriculture that are in contradiction with the Fertilizer Law, Crop Seed Law, and any other agriculture related law promulgated from time to time. 4. Economic activities importing wastes from overseas, building a factory and carrying out productions domestically. 5. Production of prohibited substances that destroy the Ozone Layer under the Vienna Convention for the Protection of Ozone Layer and the Montreal Protocol such as Hydrobromo fluo carbon (HBFC) 34 items, Bromo chloromethane item; cholorofluorocarbon 5 items Halogenated (CFC) 0 items, Halon 3 items, Halogenated CFC 0 items Carbon Tetrachloride item manufacturing activities; 6. Production of persistent organic pollutants including 2 organic pollutants prohibited under Stockholm Convention on Persistent Organic Pollutants; 7. Economic activities bringing used factories, equipments, and businesses from overseas and economic activities producing in factories or using in businesses products that are dangerous to surroundings, which are stipulated by Environmental Conservation Law, Rules, and Procedures from time to time as those that can damage the environment profoundly immediately, in short term and in long term and not suitable for use domestically. 8. Manufacturing and distribution of malt and malt liquors and other brewery products 7. Distilling, blending, rectifying, bottling and marketing of all kinds of spirits, beverages and non-beverages 8.
