3 FDEP Division of Law Enforcement 2012 State Legislative session finalized the reorganization of FDEP Division of Law Enforcement (DLE) FDEP-DLE officers moved under FL Fish & Wildlife Conservation Commission (FWCC)

4 Bureau of Emergency Response The Bureau of Emergency Response remains with FDEP under the regulatory section and has been renamed

54 Reporting Requirement On Land Petroleum releases 25 gallons or greater to a pervious surface Hazardous Material as determined by the chemical s reportable quantity (RQ) /rqover.htm

55 Reporting Requirement Discharge Report Form Required to be submitted to FDEP within 24- hours of the discovery of the release /761_1.pdf

56 Source Removal Report The State requires releases that are larger than the RQ to be cleaned up in accordance with the SRR.

58 What is a Navigable Waterways? Surface waterways: streams, creeks, rivers, lakes, ocean Wetlands that drain to a waterway Waterways can be intermittent or seasonal Defined flow pathway to clearly navigable waterway

60 On Water Reporting Requirements Spills of any amount that impact, involve or threaten State waterways must be reported to the National Response Center and the State Watch Office

61 Storm Drains In the State of Florida most storm drains lead to a navigable waterway. Therefore, releases to storm drains should be reported.

69 Your ER Contractor Should be Capable of: Respond in a timely manner Have appropriate response equipment on-hand for your specific needs: Absorbent materials readily available Vacuum Truck(s) Boats capable of responding If not, do you have a vessel that can be utilized? Hard Boom readily available?

70 A Good ER Contractor Should be: Experienced and capable of: Cleaning up releases: Appropriate training, safety equipment and safety plans for all personnel Ensuring waste is properly identified and disposed of. Document disposal and other requirements as directed by you and the regulating entity

75 RP Responsibilities (RP = Responsible Party) Tanker Spill of Industrial Strength Drain Cleaner Insure spill is properly cleaned up. Remediation of soil, ground water, surface water, etc. Hiring cleanup contractor Reporting & related paperwork Work with authorities, contractor, insurance company, etc. If you don t, DEP/EPA can bring in their contractor, plus admin. fees, etc. Will cost more!
