6 MINERAL REGULATION Mining law Mineral law based on the French civil law Mining Code: Law n of November 24, 2003 and Regulations (Decree) n of May 17, 2004 Mining Convention the enactment of a new mining code that offers many incentives and easiness to mineral investors 6

11 GEOLOGICAL INFRASTRUCTURES " Creation and maintenance of a comprehensive, reliable mineral inventory (Sysmin Project) the main achievements are : the geological mapping of the Sedimentary Basin, the airborne geophysical survey of southeastern Senegal, implementation of the Mineral Documentation Centre and the Mining Cadastre, " Data generated in previous projects are at some point made available to third parties. 11

14 MINING INDUSTRY: EXPLORATION Mul$ple deposits and zones of orogenic gold situated in an emerging Sabodala gold- mining district, where almost ten million ounces of gold resources have been found by Oromin, MDL and Randgold, with geological and structural similari$es to known gold mines and deposits in neighboring Mali and elsewhere in West Africa. 14

18 CONCEPT Concern shared by the State and the mining investors to establish a policy of good governance of the mining sector Make the Local Authorities sheltering the projects to benefit of the fallout from the exploitation of the resources PSM PSM is an exercise of Corporate Social Responsibility of Companies (CSE) wich depend of contractual commitment of mining companies

19 APPROACHES In its standardized shape, PSM in Senegal is the result of specific commitments for social investments with two approaches : Spontaneous: voluntary Approach(Initiative) of social responsibility of companies: example of the Chemical Industries of Senegal (Example : ICS) Contractual : a commitment for an annual subsidy (endowment) intended for the expenses with social character : Example (MDL, Oromin and ArcelorMitall in Kedougou region)

20 PSM OF KEDOUGOU REGION Context and justifications Dynamism of the Senegalese mining sector mainly concentrated the region of Kédougou The region of Kédougou : an important mining potential (gold, iron, uranium, copper, marble, etc.) important mining projects (now Sabodala, Iron Falémé) and paradoxically is one of the most underprivileged region of Senegal

21 PSM OF KEDOUGOU REGION Several reports Several reports Insufficient accesses of the populations to basic social services Incapacity of the income of the populations Weakness of the agricultural productions in spite of the resources and the enormous potentialities of the region The enclosing of the region which limits the development of the resources The limited financial and technical means of the Local authorities Several mining companies(societies) which intervened with a risk of doubloons

22 PSM OF KEDOUGOU REGION General objective Contribute to the economic and social development of zones impacted by the mining activities by the improvement of the living conditions of the populations. Specific objectives: Develop infrastructures and social basic equipments Make sensitive the local actors and strengthen their capacities Value the resources and the potentialities Develop the AGR Open up the region

23 PSM OF KEDOUGOU REGION Implementation The mining Administration and the Companies has: Associated all the institutional actors concerned in the definition and in the elaboration of the projects and the activities to be scheduled (programmed) Privileged the dialogue and the participative method for the elaboration of a quinquennial program Implement a workgroup in October, 2006 coordinated by Governor of the former Region of Tambacounda and in connection with the Direction of Mines and Geology, including the Regional Agency of Development, the representatives of the structures decentralized by the State, the Local authorities

24 PSM OF KEDOUGOU REGION Implementation Elaboration of a quinquennial document of planning Participative and decentralized approach; Dialogue and implication of all the actors of the region (Local authorities, decentralized Services, mining companies, NON- GOVERNMENTAL ORGANIZATIONS Validated at the local level in February, 2008

25 PSM OF KEDOUGOU REGION Implementation Prioritisation of the activities and the imputation to the various companies according to several criteria: Nature of the actions :Education, hydraulics, road infrastructures The amount of the budget assigned to the PSM by company : directly connected to the size of the project

26 Scheme of implementation Master Plan: The state control: subsidy(endowment) managed directly by the company(society) mining and dedicated to the realization of infrastructures and activities with social character according to the document of orientation validated (road, sanitary, school, hydraulic, electric infrastructures etc.)

27 MAJOR REALIZATIONS Actions in key sectors : education, training, health The support for the implementation of the sector(network) Appearances(Mines) - Geology in the Industrial and mining Secondary school for vocational training of Kédougou; The special program mining for scholarships : 17 scholarships offered since 2006 in France, in Morocco, in Tunisia and in Senegal); Rent of a building in Dakar for the benefit of the national students of Oriental Senegal
