17 Issues for Support Providers with Procurement Not outcomes based, or personalised, often about time and task, minutes of support Price based, increases competition Impacts on quality, continuity of service provision Negative impact on workforce planning, development, pay and conditions Often ignores service users wishes I am not a 3 year contract Does not fit well with Self-directed Support and individuals choosing and commissioning own support

18 Procurement Reform Scotland Act 2015 A new policy: Nicola Sturgeon committed at Stage 1 to exempt contracts for health and care services from the requirement to advertise and compete. Image: microsoft clipart

19 Procurement Reform Scotland Act 2015 Contracts under 750,000 euros are exempt from the duty to advertise, compete or tender. Option 2 of SDS S.6.11 of the Statutory Guidance: no legal requirements that stipulate a contracting authority must follow a procurement process to meet their obligations under Option 2 Contracting authorities are now free to put choice and control for supported people above procurement considerations.

20 Promoting a Diverse Market SDS Act (section 19) Places a legal duty on local authorities that they must, in so far as reasonably practicable, promote: a) The availability of providers of support and b) The variety of support provided by it and other providers.' Image: microsoftclipart

21 The Social Care Market Self-directed support brings greater choice, a new social care market and more decision making and control for individuals. 1. What are the benefits and risks for supported people/providers with having greater choice? 2. How does competition, procurement, contracts and hourly rates fit with SDS? 3. How do we support diversity, support innovation, sustainable services and real choice in the market?
