10 Title VI & EJ 10 Title VI Federal Statute Title VI of the 1964 Civil Rights Act. Federal Law. FTA Circular B Focus: Minority Populations Environmental Justice (EJ) Executive Order Intended to improve internal management of executive branch FTA Circular Focus: Minority & lowincome populations. EJ analysis (e.g., as part of NEPA) is not sufficient for Title VI requirements, and vice versa.
11 Reporting Follow the Funds! 11 Designated recipient: an entity designated to receive and apportion funding. Direct recipient: an entity that receives funding directly from FTA (and does not pass any along to subrecipients). Primary recipient: an entity that receives funding directly from FTA and extends federal financial assistance to subrecipients. 15 Title VI and network planning Support Social Policy Provision of service to those who cannot take private auto (captive riders) Provide minimum level of accessibility to all members of society. Provide Efficient Transport Give opportunity to choose between private auto and public transport. Reduce auto congestion in congested corridors at peak times by making transit attractive. Contribute to a sustainable city Public transport is an essential part of urban structure. Replace auto as primary mode of travel. Stimulate non-auto activity and community development. 19 Public Participation 19 FTA Circular: Recipients must promote inclusive public participation, with integration of the content and considerations of Title VI, the Executive Order on LEP, and the DOT LEP Guidance in the public participation plan or process.
20 Public Participation 20 It is very difficult to get people to public hearings unless the project is very controversial or the organization is really messing up. Connecticut RPOs tend to have small programs, which often elicit low participation. Reach out to local groups & organizations that are meaningful to protected groups. Action Item: Create a mechanism for easy sharing of public participation practices in CT.

22 Complaint Resolution 22 FTA Circular: All FTA recipients develop Title VI complaint procedures and complaint forms. Subrecipients have the option to adopt the Title VI complaint investigation and tracking procedures and complaint form developed by the primary recipient.
23 Complaint Resolution 23 Most major Title VI complaints and disputes not targeting individual RPOs or operators, but FHWA or CTDOT. Some complaints mistakenly sent to CT Commission on Human Rights and Opportunities (handles Title VII) The transportation organization involved not always alerted or involved in resolving these complaints. Centralized complaint databases (NYC OpenData) provide opportunities for improved communication. Not all complaints are Title VI
24 Complaint resolution 24 Action Items: 1) Build a common statewide complaint procedure and form 2) Develop electronic complaint submission capability 3) Establish recommended practices for complaint procedure advertising. 4) Engage CHRO in developing statewide coordinated complaint procedures.

26 Limited English Proficiency (LEP) 26 FTA Circular: Recipients must take reasonable steps to ensure meaningful access to benefits, services, information, and other important portions of their programs and activities for individuals who have limited-english proficiency (LEP).
27 LEP 27 Review the DOT s LEP guidance on Four Factor Analysis, recipients shall develop a Language Assistance Plan based on the results. Recipients should develop relationships with language minority communities to reach them effectively. 1. Go to their places of worship, community centers, and elementary schools 2. Ask schools what languages they encounter in their ESL classes
28 LEP 28 Action Items: 1) Identify a translation tool and pool resources to pursue quality, uniform Title VI document translation. 2) Coordinate efforts in identifying and mapping LEP populations.

33 Surveys & Real-time Data 33 Ridership Survey Action Items: 1) Conduct a needs assessment of rider data for Title VI monitoring and reporting and related transit operations and planning passenger data. 2) Initiate a discussion with the Bureau of Policy and Planning and the Planning Model group at CTDOT to integrate Title VI survey needs into statewide travel survey planning. Real-time Data Action Items: 1) Conduct a pilot study with GBT to examine the usage of real-time data in Title VI monitoring and reporting.
