2 INTRODUCTION Port Metro Vancouver s new Truck Licensing System (TLS) takes effect on February 1, This handbook contains everything you need to determine your eligibility to participate and to assist you in submitting a complete and compliant application. Port Metro Vancouver will begin processing applications the week of December 15, Applications will be processed weekly. This handbook is divided into three sections: Section 1: Background and Entry Criteria Section 2: Application User Guide Section 3: Sample PDF Application Forms Please note that all efforts have been made to capture relevant, accurate, and necessary information to assist applicants. However, this document is for informational purposes only and in no way shall be interpreted or construed to create any representations or warranties of any kind, either express or implied, regarding the information contained herein. Please note that information herein is subject to change, and may not be current. Therefore, it is recommended that you refer to the most recent version of the handbook at the time of your application. It does not apply to exclusively long haul providers and also does not apply to companies or drivers that do not require access to port marine container terminals. Port access for companies that provide only long haul service is provided under a separate program. 1

3 SECTION 1: BACKGROUND AND ENTRY CRITERIA Background The new TLS was developed in consultation with Port Metro Vancouver s drayage stakeholders and has been endorsed by Transport Canada and the Province of British Columbia. It is designed to deliver a sustainable and more accountable drayage sector with fewer trucks, and with fewer, more efficient, and financially invested trucking companies. The new TLS, combined with other aspects of Port Metro Vancouver s Smart Fleet Program, will help maintain the competitiveness of the Vancouver Gateway. About the New TLS The goal of the new TLS is to balance the number of registered trucks with the amount of available work and bring stability to port operations. The new TLS includes new entry standards, a new fee structure, performance standards and reporting, an enhanced provincial audit program, and a new trucking commissioner to provide oversight. The new TLS program is provided on a cost recovery basis. Port Metro Vancouver will provide annual updates on the costs of various aspects of the program, to demonstrate cost recovery and will revise the annual charges as appropriate. Key Dates 9 Dec 2014 TLS Handbook and sample Licence and Access Agreement released 10 Dec 2014 Port Metro Vancouver s TLS Administrator begins pre-qualifying applications for assessment by the TLS Contract Manager Week of 15 Dec 2014 Port Metro Vancouver s TLS Contract Administrator begins reviewing and assessing applications. No further TLS applications truck tag requests will be permitted How to Apply 1. Read this handbook 2. Confirm that you meet the mandatory entry criteria, which of the supporting entry criteria you meet, and compile any relevant mandatory and supporting documentation (please refer to the following Entry Criteria below) 3. Complete the required application forms (see Section 3 of this handbook) 4. Submit the required application forms and copies of relevant documentation by to tls@portmetrovancouver.com or by CD or memory stick, delivered to Port Metro Vancouver, Canada Place, Vancouver, BC V6C 3T4, Attn: TLS Administrator 5. You will receive a notice of receipt from Port Metro Vancouver within one business day of receipt, prior to any review. Please keep this on file. Entry Criteria All current licence holders have the opportunity to seek participation in the new TLS. Specifically: Existing Full Service Operators (trucking companies) holding valid TLS Licences can apply for a number of truck tags up to the total number they had in the previous TLS (including company trucks and claimed Independent Owner Operators holding valid TLS Permits). Owner operators must now be sponsored by a trucking company through the new application process, which will allocate one truck tag to each of its sponsored owner operator s trucks and/or to a company truck that meet the new entry requirements. Employee drivers will continue to participate as they do today. It is likely that the number of applications meeting the minimum standards will exceed the truck tag target. To assist in evaluating trucking companies applications, Port Metro Vancouver has established mandatory entry criteria, which companies must meet as well as additional criteria, which will be taken into consideration as part of the selection process. For this reason, it is important to include all of the information from the checklist (see Section 2, Part 2 of this handbook) when submitting your application. Because Port Metro Vancouver will process applications on a weekly basis, we encourage companies to submit complete and compliant applications as soon as possible. Port Metro Vancouver is committed to ensuring the selection process is consistent, fair and transparent, while meeting the TLS reform objectives. 2

4 Entry Criteria For Trucking Companies: MANDATORY ENTRY CRITERIA Size and Structure Minimum number of trucks Maximum number of companies Applicants must have at least five currently TLS-licensed trucks, either company-owned and/or sponsored. If you do not meet this criteria, you may opt to align with another company to sign a Joint Licence and Access Agreement. Up to two companies can jointly apply. These companies are jointly and severally liable under the Licence and Access Agreement that they sign with Port Metro Vancouver. Only one company will be the designated point of contact for the TLS Administrator, and both companies would share joint access to terminal reservation systems. Financial Access Agreement Charge Damage Deposit Insurance Compliance/ Surety Bond You must be able to pay the Annual Agreement Charge applicable to your company size (see Table 1 in Appendix A). Annual Agreement Charges can be paid in quarterly installments. You must pay a damage deposit equal to 10% of your Annual Agreement Charge, up to a maximum of $10,000 (see Table 1 in Appendix A). This is a one-time deposit that must be replenished in the event it is drawn upon. You must secure sufficient insurance (see Table 1 in Appendix A). You must provide proof of your ability to secure a compliance bond in accordance with PMV s requirements and the number of trucks for which you are applying (see Table 2 in Appendix A). Other Truck Age Owner Operator Notification Safety Plan Required Forms Sponsorship Secure Parking Business Need The new TLS has a minimum age of 2007 or newer for any new fleet additions or replacements. Older trucks that are approved for use within the existing TLS may be accepted during the transition period. If you have a truck that is 2005 or older, you must provide evidence that it has been retrofitted with a diesel oxidation catalyst (DOC) prior to the application date, as per existing environmental requirements. Note that by 2019, all trucks must be 10 years of age or newer for annual approval. As early as possible, notify any TLS Independent owner operators holding valid TLS Permits with whom you currently work and do not intend to work with under the new TLS policy. This will give them the opportunity to seek sponsorship from another trucking company as soon as possible or commit to the Transition Support Program. You must provide a copy of your Fleet Safety Plan, as required by your NSC provisions. Please submit the required forms as described in Part 2 and included as Part 3 of this handbook. Complete all sections in full. Trucking companies must sponsor all owner operators. Please ensure you provide the following information as part of the application package: Owner Operator s full legal name Port Pass number Vehicle Identification Number Truck Licence plate number, model, make, colour and year Unit number (as indicated on insurance papers and the body of the truck) Provide evidence of ownership or availability of land assets or a defined plan for providing secure parking for truck, trailer and chassis assets after hours. Provide at least one supporting document to demonstrate need. Port Metro Vancouver gives preference to companies that show proof of business. ADDITIONAL ENTRY CRITERIA Past TLS History Certificate of Recognition (COR) Workers Compensation Board (WCB) Status SmartWay Partner No additional information required. Past TLS history is a consideration in the application process and will be reviewed as part of the application process. Provide copy of Certificate of Recognition (COR) recognizing significant safety practices and procedures by carrier if applicable. Provide a copy of annual WorkSafeBC statement detailing confirmation of a surcharge or discount position with WorkSafeBC premiums. Provide confirmation of registration with Natural Resources Canada for this voluntary environmental standard. 3

5 ADDITIONAL ENTRY CRITERIA (cont) Safety & Hazard Management Evaluation Services NSC Standing Average age of fleet Size of fleet Structure Provide proof of participation in the ICBC Safety & Hazard Management Assessment Program prior to the TLS application date. OR Provide a letter of intent to participate in this ICBC program prior to 1 October Instructions regarding how to apply to ICBC and obtain a letter of intent are included with this User Guide as Appendix C. No additional information required. Port Metro Vancouver will give preference to companies with Satisfactory and Satisfactory Unaudited standings as compared with those who have a Conditional status. No additional information required. Port Metro Vancouver will give preference to companies with newer fleets. A calculation of the average age of your fleet will be based on the information you provide in your application form 2.1. No additional information required. Port Metro Vancouver will give preference to companies with larger fleets. No additional information required. Port Metro Vancouver will give preference to Single License and Access Agreement applicants over Joint License and Access Agreement applicants. Entry Criteria For Owner Operators: MANDATORY ENTRY CRITERIA Sponsorship You must be sponsored by a trucking company. Please ensure to provide this company with the following information: Your full legal name Port Pass number Vehicle Identification Number Truck Licence plate number, model, make, colour and year SECTION 2: APPLICATION USER GUIDE There are four parts to a completed application. These include: PART I: MANDATORY FORMS FOR COMPLETION PART II: DOCUMENTATION: MANDATORY & SUPPORTING PART III: SUBMISSION OF APPLICATION PACKAGE PART IV: THE REVIEW PROCESS Each part is described in the subsections that follow. PART I: MANDATORY FORMS FOR COMPLETION You will be required to submit the following four forms and documentation required for your company to be eligible to apply for a TLS License. Details and definitions for each are described below. 1. Local Drayage: Company Information, Contact Information & Truck Tag Allocation Form There are four sections on this form. The sections and brief descriptions are outlined as follows: 1.1. PRIMARY COMPANY INFORMATION The purpose of this section is to collect the COMPANY information of the single applicant or one of the two joint applicants. For Single (one) trucking company applicant: Must be completed in full for single-company applicants. For Joint (two) trucking company applicants: Must be completed in full for two-company applicants under one Licence and Access Agreement SECONDARY COMPANY INFORMATION The purpose of this section is to collect the COMPANY information of the second of the two joint applicants. Single-held (one) trucking company applicant: This section does not apply. For jointly held (two) trucking company applicants: must be completed by the second of the two TLS Licence trucking company applicants. 4

6 1.3. LICENCE AND ACCESS AGREEMENT CONTACT INFORMATION The purpose of this section is to collect the information for the SINGLE POINT OF CONTACT for the TLS Licence and Access Agreement on all administrative matters. IMPORTANT NOTE: The contact information provided here will be the single point of contact for Port Metro Vancouver regarding this application or, in the event the applicant is successful, future License and Access Agreement administrative matters. This contact is responsible to ensure correspondence is distributed to appropriate parties, such as the joint applicant/holder TRUCK TAG ALLOCATION ELIGIBILITY AND REQUEST The purpose of this section is to ensure that the number of truck tags the applicant is applying for is within the maximum allocated (as outlined in a letter addressed to all existing TLS Licence holders on December 8, 2014 letter), and, in the event that more truck tag allocations will be offered, how many additional truck tags does a company foresee adding to their fleet. Please see the required field definitions as follows: Company Name: the legal name of the applying company. SCAC Code: The Standard Carrier Alpha Code, a unique 4-character code used to identify transportation companies; this code is used to facilitate computerization in the transportation industry. If you do not have a SCAC Code you can apply with the National Motor Freight Traffic Association. DBA is Doing Business As : A legal term used in Canada, meaning that the trade or brand name, under which the business or operation is conducted and presented, is not the legal name. The desired name may not have been available, or the business may be owned by another company/franchisee/sole proprietor. If your company does not use DBA please indicate N/A on the form. British Columbia Corporate Registration Number ( Business Number ): A unique number assigned to a corporation, business or society when registering with a participating agency. Corporations, businesses or societies use this number to identify themselves when in contact with many federal, provincial or local government program. The National Safety Code (NSC): a set of national standards supported by provincial regulations. The program establishes management and performance requirements for commercial carriers. The NSC standards establish minimum safety standards for commercial vehicles and drivers. 2. Truck Detail Information 2.1. TRUCK REGISTRATION FORM : A detailed registration form for every truck owned by the company/companies and sponsored owner-operators to which the applicant intends to assign a truck tag is required. Section A: Truck Details Section B: Truck Ownership 3. Driver Detail Forms 3.1. COMPANY DRIVER PORT PASS INFORMATION FORM : A list of all company employee drivers SPONSORSHIP AGREEMENT FORM : A signed agreement between the Licence applicant(s) and the intended Sponsored Owner Operator, listing all of the Sponsored Owner Operator s drivers. 4. Consent Forms These forms are not to be submitted as part of the application package, but must be completed by every driver, employee or sponsored owner operator, and retained in your records in the event you are required to provide them at a later date. 4.1 CONSENT (LICENCE): A signed and witnessed consent form from the Licensee and both of them (if applicable) and for each driver for the Licence Agreement must be provided. 4.2 CONSENT TO DISCLOSE (ACCESS AGREEMENT): A signed and witnessed consent to disclose from the user and both of them (if applicable) and for each driver for the Access Agreement must be provided. 5

7 PART II: DOCUMENTATION: MANDATORY & SUPPORTING Please carefully review this checklist and ensure you provide all mandatory documentation as well as any relevant supporting documentation. Mandatory Documents (to be provided by each applicant company) Company-related documents National Safety Code (NSC) Certificate National Safety Code (NSC) reports showing good standing for previous 3 years Copy of your Fleet Safety Plan as required by NSC Workers Compensation Board (WCB) Certificate, showing Company is in good standing Copies of a valid Collective Agreement (for Unionized trucking companies) Applicant to ensure that the company is in Good Standing with the BC Corporate Registry (no document required; will be verified by TLS Administrator online) Written documentation confirming Compliance Bond in the value required by the applicant s fleet size; Final form of documentation to be determined by December 15, 2014 Valid Motor Truck Cargo Insurance Certificate with minimum of $100,000 coverage Business Case including: Nature of the business A minimum of at least one supporting document (i.e. customer service contract) or business reference justifying business need Evidence of secure land for truck/chassis storage Truck-related documents Proof of ownership or lease agreements for trucks Includes a transfer tax form, bill of sale, or lease agreement Lease Agreement must clearly display: o Vehicle Information Number (VIN); o Applicant s name as the lessee; o Duration of lease; and o Lease payment amounts. Valid truck insurance documentation submitted for every truck owned by the company/companies and sponsored owner-operators must also show: Licence Plate, VIN and Fleet and Unit number Insurance documentations must be valid (i.e. NOT EXPIRED) Minimum Automobile Liability: $5,000,000 Minimum General Liability: $5,000,000 NSC number of all trucks including sponsored OOs MUST belong to the applicant(s) Valid Rate Class Additional Recommended Documents to Support the Application Certificate of Recognition (COR) Workers Compensation Board (WCB) statement detailing surcharge or discount rate position SmartWay Partner Registration or Certificate Evidence of active participation in the ICBC Safety & Hazard Management Assessment program OR a signed Letter of Intent (as issued by ICBC) to participate in the Program before 1 October,

8 PART III: SUBMISSION OF APPLICATION PACKAGE Upon completion of the mandatory forms and coordination of all relevant documents, the applicant must submit the full application package to for review. All documentation and application package must be submitted in electronic format. Requirements: 1. All fields on mandatory forms 1, 2.1, and 3.1 MUST BE TYPED. Handwritten responses on these forms will not be accepted. 2. Handwritten responses permitted on forms You must ensure forms 4.1 and 4.2 are filled in by every driver who works for you, employees and sponsored owner operators. You must keep copies of these signed forms in case you are asked to provide. Please do not provide these at the time you submit your application package. 4. All copies of required and supporting documents must be clear and legible. Options for Submission: 1. One single , with all documents attached (Zip-File); or 2. One disc with all documents delivered to: PORT METRO VANCOUVER CANADA PLACE VANCOUVER, BC V6C 3T4 ATTN: TLS ADMINISTRATOR DOCUMENTS WILL NOT BE RECEIVED BY FAX. PART IV: THE REVIEW PROCESS Port Metro Vancouver aims to the fullest extent possible to select only those carriers that meet the outlined minimum entry standards outlined during the TLS reform process. Given the current state, Port Metro Vancouver anticipates the number of applications received that meet the minimum standards will exceed the targeted number of truck tags, and in that case additional considerations as outlined earlier in the User Guide will also be taken into account, and will contribute towards the ranking and selection process. Port Metro Vancouver is committed to ensuring the selection process is consistent, fair and transparent, while ensuring the objectives of the TLS reform are met and the integrity of the process maintained/preserved. The complete review and assessment process includes both a TLS Administrator and a TLS Contract Manager, roles outlined as follows: STEP 1: TLS Administrator Package Verification a. Confirm receipt via (same day); b. Within three (3) business days: i. Review application for completeness of forms; ii. Verify validity of mandatory documents; iii. Coordinate other supporting documents; iv. Ensure all intended sponsored owner operators have valid TLS Independent Operator Permits; and v. Communicate via to applicant(s) advising of application status c. In the event of completed application: The TLS Administrator will generate an Application Intake Number, will advise the applicant and forward the package to the TLS Contract Manager for Step 2. d. In the event of receiving incomplete applications: The TLS Administrator will advise the applicant of any missing, incomplete, and/ or invalid documents. ALL documents as advised must be corrected and received by the TLS Administrator within five (5) business days, without further notice period. Failure to do so may result in the default of the application. Should the applicant want to reapply, a resubmission of all documents and forms may be required Step 2: TLS Contract Manager review a. Reviews and assesses completed applications in order of Application Intake Number in weekly batches; b. Advises the TLS Administrator of final decision to pre-approve Licence and Access Agreement application, pending truck approvals, or to disapprove application. c. Please note: Review and decision by TLS Contract Manager may take up to twenty-one (21) days. 7

9 Step 3: TLS Administrator Communications a. In the event of a Disapproved application, a notice will be sent to the applicant advising of the disapproved application with reasons outlined. b. In the event the TLS Contract Manager pre-approves a Licence and Access Agreement, pending truck approval, the applicant will be advised as early as possible, and will: i. Confirm the truck tag allotment, and ii. Request the following documents be submitted within five (5) business days (if required per Port Metro Vancouver s Environmental Standards): Opacity Test with a reading no greater than 20%; Age Exception Application Submission for every truck, as required by the TLS Environmental Requirements, including evidence of payment. NOTE: If you are submitting a deposit for parts on order and/or awaiting installation, the truck may be conditionally approved and will require a completed Age Exception Application prior to April 1, 2015 Step 4: TLS Administrator Contract Administration a. In the event all trucks have been approved, the TLS Administrator will: i. Will send a pre-populated TLS Licence and Access Agreement with invoice for: Total Licence Charge Total owing Damage Deposit ii. Will request TWO (2) separate Certified Cheques made payable to the Vancouver Fraser Port Authority for: Cheque 1: Full Damage Deposit and Cheque 2: First installment of ¼ amount of total Licence Charge iii. Expect signed TLS Licence, Access Agreements, and two cheques within five (5) business days. Failure to do so may result in the default of the application. Step 5: TLS Administrator Arranging Decals, GPS Installation and Final Approval a. Upon receipt of payment and the applicant-signed documents, the TLS Administrator will contact the applicant to set up appointments for new decal application and in the event that a truck does not already have a Port Metro Vancouver issued GPS locator, an appointment for installation of a GPS locator. ALL trucks require GPS and decal installation to finalize approval and will only be then granted access to Port Metro Vancouver property after February 1, b. Upon completion of the decal and GPS installation processes, the successful applicant will be mailed a signed contract. 19 FORM 4.1 CONSENT I, (please print clearly), effective as of the date set out below, hereby acknowledge and agree that: (1), (the Licensee ) has been issued a licence by the British Columbia Container Trucking Commissioner (the Commissioner ), appointed under the British Columbia Container Trucking Act (the Act ), to carry out container trucking services as defined and prescribed pursuant to the Act and its regulations or a licence has been deemed (the Licence ). (2) In order to apply for the Licence, and periodically during the term of the Licence, the Licensee must provide certain information, which may include personal information, respecting companies, vehicles and vehicle operators and related activities to the Vancouver Fraser Port Authority (the Authority ) and/or to the Commissioner (the Required Information ). (3) The Required Information is collected and may be used by and disclosed to the Commissioner, the Authority and/or Her Majesty the Queen in right of the Province of British Columbia, represented by the Minister of Transportation and Infrastructure (the Province ), for the purpose of stabilizing the container trucking industry in the Lower Mainland of British Columbia, and enhancing safety, security, order, and operational efficiencies within that industry, and ensuring compliance with the Act, and the regulations and orders of the Authority or the Commissioner made under that Act (the Purpose ). 25 APPENDIX C: ICBC SAFETY & HAZARD MANAGEMENT EVALUATION SERVICE Port Metro Vancouver Endorsement Port Metro Vancouver, a major stakeholder in the Lower Mainland s transportation and logistics network, enthusiastically endorses ICBC s Safety & Hazard Management Evaluation Service and encourages its drayage sector fleets to receive an Evaluation. Participation in the Service is voluntary. However, TLS license applications will garner special consideration should licensees have received an Evaluation. Background and Program Objectives ICBC launched its Safety & Hazard Management Service in October The free Service is provided by professional Fleet Safety Coordinators to ICBC customers in the commercial trucking, taxi, and municipal transit sectors. The program aims to understand commercial customers needs and provide assistance in helping commercial customers understand their cost of risk. The service will help commercial fleets identify ways they can improve safety and reduce risks for their operations and drivers. ICBC initialized the program with a test phase that allowed for the collection of customer feedback to optimize the service offering. ICBC has received positive feedback from all the fleets who have participated in the program to date. How It Works The Evaluation is delivered utilizing a collegial, collaborative and consultative approach and includes: An initial meeting with management to understand business goals and expected outcomes; The assessment of a trucking fleet s operational safety practices using an evaluation framework which includes recognized industry basic, better and preferred practices; The Evaluation focuses on primary components of the company s operational safety system including Driver Management, Safety Systems Management, Equipment Management, Cargo Management and Compliance Management; Interviews with key fleet personnel, including drivers and/or owner operators; The delivery of a report to management which includes observations made during the Evaluation and a quantitative scorecard for fleet and industry benchmarking purposes; If requested by the fleet, targeted recommendations for improvement The Service aims to equip fleets with the tools to manage their costs of risk to better outcomes.
