Your first bill will include a pro-rating charge Just like your previous telephone service provider, TOUCHBASE bills monthly (recurring) service charges one month in advance. Your first invoice will include charges for the month in which service was activated and for charges for the following month in advance. Go paperless..save a tree (and it s free)! TOUCHBASE will handle the cancellation of your previous local telephone service. However, if your long distance service is also being switched to TOUCHBASE, you will need to contact your previous long distance provider to cancel existing service. Unfortunately, FCC regulations prohibit TOUCHBASE from acting on your behalf. Otherwise, your previous long distance provider may continue to bill you for monthly recurring fees. Why is there partial month activity on my first invoice? As with your previous telephone service provider, TOUCHBASE bills monthly (recurring) service charges one month in advance. Your first invoice from TOUCHBASE includes charges for the month in which service was activated as well as for charges for the following month in advance. 2. What is the FCC Line Charge? The FCC line charge is an FCC regulated fee that you pay to your phone company to connect you to the telephone network. 3. What is a PICC Charge? The Presubscribed Interexchange Carrier Charge (PICC) is a fee that long distance companies pay local telephone companies to help them recover part of the costs of providing the local loop. Please call us at: Refer to this general account information when corresponding with TOUCHBASE regarding your bill. This is the total outstanding balance after payments, credits and adjustments have been applied to your previous bill. The Total Amount Due equals Total Current Charges plus any remaining charges from your previous bill. This section includes totals for your local, regional and/or long distance calls. It also includes monthly recurring charges, PICC charges, one-time charges, any finance charge for past due balances and applicable taxes and surcharges. Monthly bill message. This is a detailed summary of monthly recurring charges including billing date, the quantity of items, the pro-rated amount (where applicable), the monthly recurring rate and the total charges per item (monthly rate x quantity of items). This section summarizes all calls (usage) made during the current billing cycle. Local and Regional usage indicates the time of day the calls were made, the number of calls, the total minutes billed and the total charges. Long Distance usage summary includes total number of calls, total minutes billed and total long distance charges. This section details taxes, surcharges and other fees. Active Service numbers are all of your telephone numbers serviced by TOUCHBASE on this account. 7 Popular Calling Features Popular Calling Features Three Way Calling Caller ID with Name Call Forwarding Three Way Calling Three Way Calling lets you add a third person to your conversation on either a local or long distance call. To add a third person to an ordinary call To put the first call on hold, press and quickly release the hookswitch/flash Listen for three tones followed by dial-tone. Dial the number of the person you are adding to the call. You can talk with this person without immediately including the first call. (If the line is busy or there is no answer, press and quickly release the hookswitch/flash twice to return to the person on hold). To bring the first call back on the line, press and quickly release the hookswitch/flash. All three parties will be on the line. If either person hangs up, you can continue a two-way call or you can add a different \ third party. To Disconnect Either person you re talking to can leave the conversation by hanging up. You will still be connected to the remaining person. You can disconnect the second number you called by pressing the switch hook, the recall button, or the flash key. If you want, you can then call a new number. To end the call completely, just hang up. Please note: Caller ID with Name requires a display unit or display telephone, which must be purchased separately. The manufacturer will provide information on how to set up the display, its storage capacity, and information about how to retrieve, review and delete stored telephone numbers. When a call is coming from outside your Regional Calling Area, a special message appears on the display. See the manufacturer s instructions for information on display messages. Some older models of Caller ID equipment do not display all Caller ID information. Certain telephone numbers displayed by Caller ID cannot be called because they are not designed to accept incoming calls. One example is Wide Area Telephone Service (WATS) numbers. Call forwarding Call Forwarding lets you forward your incoming calls to any phone number you can dial directly. To use this feature 0 SEC. Lift handset and listen for dial-tone. Press *72 (rotary phone dial 72) and wait a moment for second dialtone. Dial the number to which your calls are to be forwarded. When the forwarding number is answered keep the connection for 0 seconds to establish call forwarding. To confirm that Call Forwarding is turned on To confirm Call Forwarding is on, press *72 (rotary phone dial 72). If it s on you ll hear a fast busy tone. If it s off, you ll hear a normal dial-tone. To turn off Call forwarding Lift handset and listen for dial-tone. Press *73 (rotary phone dial 73) When you hear two short beeps and then dial-tone. Call Forwarding is cancelled. Caller ID with Name When the phone rings, you see the number, or the name and number, of the person calling. If the line is busy or not answered, repeat steps -3. When you hear two short tones, Call Forwarding is in effect. To use this feature The unit will display either the number of the incoming call, or the number and the name of the calling party, as they appear in public directory listing records. Most units store this information, so, if a call comes in while you are out, you can see the name and number later. When you are on the phone, this feature shows you the number of the waiting call and the name of the calling party. To use this feature By dialing *67 (67 on rotary phones), you can prevent your number from being displayed. With many display units, you will see a Private or P message. See the manufacturer s instructions. Please note: You cannot answer a call when Call Forwarding is on. However, a short reminder tone will signal you that a call has been forwarded. If a forwarded call is completed, and it is a toll call, the customer will be charged for that call. 0

8 Inside Wiring Terms & Conditions Inside Wiring Terms & Conditions PLEASE NOTE: The Inside Wiring Maintenance Plan is not available in all areas. If you have questions, call TOUCHBASE (TOUCHBASE may be referred to as TOUCHBASE, or we or our ) offers an Inside Wiring Maintenance Plan (sometimes collectively referred to hereinafter as Wiring Maintenance Plan or Plan ) only to residential and business plain old telephone service ( POTS ) and Centrex local exchange telephone service customers (hereinafter referred to as Customers or you ). The Inside Wiring Maintenance Plan is optional. The following Terms and Conditions will govern the provision of the Plan IMPORTANT NOTE: Read these Terms and Conditions. Your agreement to these Terms and Conditions is indicated by your payment of the relevant charges on your bill Note: If your phone service is located in a multi-unit building (rented/leased facilities, dormitory, military housing, condominium, cooperative dwelling, nursing home or other group living facility) you should determine whether you or your landlord/manager is responsible for repairs to your telephone inside wiring prior to subscribing to this service DESCRIPTION OF INSIDE WIRING MAINTENANCE PLAN: damage or vandalism, deliberately or intentionally cut wire, excessive repair requests (as may be reasonably determined by TOUCHBASE); flood, earthquake, acts of war, fire, lightning or other acts of God affecting a large number of premises Repair or replacement of inside wiring or jacks that do not meet electrical codes or applicable standards and regulations as outlined in the National Electrical Code; the Electronic Industry Association Standards and Part 68 of the Federal Communications Commission rules For multi-unit dwellings, problems occurring in horizontal and/or riser cable or problems we are prevented from accessing, for example, by the owner of the property, by governmental or military authorities (i.e., the Customer lives on a military base), or by your landlord Repair or replacement of inside wiring or jacks rendered impossible due to lack of access to premises Repair or replacement of wiring or jacks in boats, boat docks or marinas The provision and installation of additional wiring and jacks at existing or new premises Restoration of your premises if you ask TOUCHBASE to replace concealed wire Repair or replacement of outside wiring (whether aerial or buried) connecting a detached structure on the same premises The Inside Wiring Maintenance plan is an optional plan that provides diagnosis and repair of inside wiring for a monthly fee. Under this plan, we will repair or replace the defective standard inside wiring at no cost to you Inside wiring is defined as wiring from the local telephone company demarcation point to the telephone jack at the customer premises. Unless specified otherwise, the term Inside Wire or Inside Wiring when used in these Terms and Conditions, shall include inside telephone wire and jacks Surface mounting is the standard for replaced wiring and jacks. Requests for replacement of concealed wire requiring extra work will be subject to time and material charges. Trouble isolation can often be accomplished through office testing facilities. We reserve the right to dispatch at our discretion to isolate service problems To request maintenance service you should call TOUCHBASE Customer Care at The following services are INCLUDED in the Inside Wiring Maintenance Plan: Diagnostic and repair of jacks and inside wiring (from the demarcation point) that is connected to the network and subsequently cease to function due to normal wear and tear or accidental damage Diagnostic and isolation of trouble caused by terminal equipment; namely phones, faxes, and modems The above services will be performed during normal business hours PLAN ELIGIBILITY: The Plan is only available to customers who subscribe to TOUCHBASE local voice service A customer that subscribes to the Inside Wiring Maintenance Plan for a location must do so for all the telephone lines at that location CUSTOMER S RESPONSIBILITY: You are responsible for re-establishing the connection to and reprogramming and testing of any telephone equipment or other CPE (Customer Premise Equipment) as required. Such equipment includes automatic dialers, fire and burglar alarms, meters, sensors, answering devices, and telephones TOUCHBASE will schedule an appointment with you. Customer must be available and must grant access to the demarcation point at the scheduled time. If you are not available or miss 2 consecutive appointments, TOUCHBASE reserves the right to charge for any additional dispatches or cancel the Inside Wiring Maintenance Plan You are responsible for timely payment of your telephone bill. Inside Wiring Maintenance dispatches will only be made if your account is current and is in good standing The following services are EXCLUDED from the Inside Wiring Maintenance Plan: Repair of complex inside wiring associated with multiple lines that use common equipment This includes telephone stations that are part of a key or PBX telephone systems and lines connected to coin telephones CHARGES, TAXES AND FEES: You agree to pay our current charges for the Wiring Maintenance Plan, as well as taxes and fees assessed against either you or TOUCHBASE on the charges and all late payment, interests or other fees as stated on your telephone bill. For current prices for services described in these Terms and Conditions, taxes and other applicable fees, check your telephone bill or call Customer Care at the number listed on your telephone bill. Repair or replacement of telephone sets or other telephone equipment at your premises Pre-existing conditions and problems with your inside wiring or telephone jacks Repair or replacement of inside wiring or jacks rendered necessary due to negligence, willful DATE OF EFFECTIVE COVERAGE: The Wiring Maintenance Plan goes into effect one month after sign up 2 3

9 Inside Wiring Terms & Conditions (cont.) Customer Rights CANCELLATION OF SERVICE: Minimum period of the Plan is year. The Inside Wiring Maintenance Plan cannot be cancelled less than 2 months after the start date (the minimum period). If service is discontinued within one year, there is a $35.00 early termination fee. TOUCHBASE will automatically bill a cancellation fee of $35.00 if the Inside Wiring Maintenance Plan is cancelled before the expiration of said 2-month period. After the 2-month minimum period, the Inside Wiring Maintenance Plan will continue to be provided under the same terms and conditions until modified or terminated by TOUCHBASE or terminated by you. Should you decide to cancel the Inside Wiring Maintenance Plan after the 2-month minimum period, no cancellation fee will apply. You must contact TOUCHBASE to terminate your coverage. Termination will take effect following verbal or written notice thereof. LIMITATION AND EXCLUSION OF LIABILITY: Under no circumstance will TOUCHBASE be liable for any indirect, incidental, special, exemplary or consequential damage, such as, but not limited to, loss of profits, data, or expected savings, even if TOUCHBASE was advised of the possibility thereof. TOUCHBASE s total liability arising out of or in connection with the Inside Wiring Maintenance Plan and your exclusive remedy is limited to the amount you paid for the Inside Wiring Maintenance Plan over the previous 2 months. CHANGES TO TERMS AND CONDITIONS: Charges for the plan are subject to change with 30 days notice. Notice may be in the form of a bill insert or other written notification. The payment of applicable charges by you or a request for services under the plan, after receiving such notice of change will be deemed agreed to by you to the changes in the charges, terms or conditions. TOUCHBASE reserves the right to charge additional fees and/or immediately terminate the Inside Wiring Maintenance Plan should TOUCHBASE determine that you are acting in an abusive manner, are not fulfilling your obligations under the Inside Wiring Maintenance Plan or are not paying the monthly fee when due. TOUCHBASE may terminate this agreement upon 30 days notice to you if Inside Wiring Service is or becomes uneconomical or if TOUCHBASE determines, at its sole discretion, that it no longer desires to offer Inside Wiring Service at your location. GENERAL PROVISIONS: In the event that any of the provisions of his Agreement shall be invalid or unenforceable, such invalidity or un-enforceability shall not invalidate or render unenforceable any other provision of this Agreement. This Agreement shall be construed as if it did not contain such invalid or unenforceable provision. We will not be liable for any delay or failure to perform our obligation. ENTIRETY OF AGREEMENT: NO REPRESENTATIVE OF TOUCHBASE HAS THE AUTHORITY TO MAKE ANY REPRESENTATION,PROMISE, GUARANTEE, OR WARRANTY TO YOU OTHER THAN THAT STATED IN WRITING IN THIS AGREEMENT. THIS AGREEMENT SUPERSEDES ANY PREVIOUS AGREEMENT WITH RESPECT TO THE PROVISION OF INSIDE WIRING MAINTENANCE SERVICE BY TOUCHBASE TO YOU. THIS AGREEMENT CONSTITUTES THE COMPLETE EXCLUSIVE AGREEMENT AND UNDERSTANDING BETWEEN TOUCHBASE. AND YOU CONCERNING THE PROVISION OF THE INSIDE WIRE MAINTENANCE PLAN. Description of the Bill The company (TOUCHBASE) is required to provide a bill (via mail or ) for telephone service every month. The bill separates the monthly charges into three general categories: Basic Monthly Service (Dial Tone Line charges, additional line features) Local and Regional Usage Long Distance Service Billing Errors If you think there is an error on your bill, call the business office at There is no charge for calls to the business office. Payment Requirements and Procedures We offer automatic monthly payments by both credit card and electronic funds transfer. In addition, we offer online billing payment options. If you would like to sign up for these options, please call our Customer Service Department. There are no additional charges associated with this service. Security Deposits and Guarantee Requirements A security deposit will be required if You have unsatisfactory credit or Your account had more than 2 returned checks in 2 months or [ coming soon ] Your account has been suspended for non-payment within the previous six months. The deposit will be equal to two month s average billing. The security deposit will earn interest at the mandated rate and will be applied to your account after one full year of ontime payments. If payments are not made in a timely manner, the deposit will be retained until twelve consecutive timely payments are made, at which time you may request that the deposit be applied to your account. If you leave TOUCHBASE s service your deposit, less all outstanding balances, will be refunded. 4 5

10 Customer Rights Business Calling Solutions Procedures for Suspension, Disconnection and Re-connection of Service If a payment has not been received by the due date, a suspension letter will be sent to you. It will notify you that you have an additional 8 business days to pay your bill in order to avoid suspension. Once an account is suspended, an additional fee will be added to the account. Suspended accounts must have all past due amounts paid in full, including suspension fees, prior to restoration of service. Restoration of service may take 48 to 72 business hours. If you wish to restore service after your account has been disconnected for non-payment, you must: Pay all balances in full Pay all installation charges for line(s) in advance and Provide a deposit equal to two months of service Dishonored Checks For each check, electronic funds transfer or other remittance that is not honored because of insufficient funds or closed account, you will be charged a $25.00 Returned Check Fee plus any re-deposit charges. The credit cards accepted are: Visa, MasterCard, American Express, Discover Contacting the Company with a Dispute You have the right to question or dispute any telephone problem you may have. You should file a written dispute before your service is suspended or disconnected. Disputes should be sent within 90 days of the billed date. Calling features can be added to your line for an additional monthly charge.
