6 Updating Stormwater Management Facilities Inventory

8 2017 SWM Inventory Total number of stormwater management facilities for 2017 annual inspections is 2, dry and wet ponds. 1,324 BMPs such as: Bioretentions, Bioswales, Infiltration Facilities, Sand Filters, Green Roofs, Permeable Pavements, Underground Systems and Constructed Wetlands.
9 What Happens Next??? Annual inspections are performed by New Castle County, Department of Special Services. Letters and inspection reports are mailed to owner/responsible party with a timeline for performing necessary maintenance. The owner/responsible party should complete all of the items noted on the inspection report. Questions about inspection reports are directed to NCC, Department of Special Services, Stormwater Management Group. Call/ the inspector on your inspection report to schedule a re-inspection within the noted timeframe.
10 Your Job as the Responsible Party!!! Find a copy of the Operation and Maintenance Plan for the SWM facilities at your site. Find a copy of the As-Built Plan as well as the Landscape Plan for those SWM facilities. Hire a professional contractor who is familiar with this type of the work. It is our recommendation to obtain at least 3 different estimates from different contractors before signing a contract. NCC, Dept. of Special Services can supply a list of contractors who have done similar work on stormwater management facilities.
11 Try Different Resources for Finding the Plans! It is difficult to find these plans for some of older the SWM facilities. Check your files, talk to the site maintenance manger or the in-house contractor. Call our office to see if we have a copy in our files. Call the engineering firm which did the original Record Plan.
12 When to Contact Our Office? If you have any questions in reference to your inspection report. If you need a copy of the Contractors List. If you need a copy of the plans. If you need an extension to get the work done. Ready for re-inspection
13 Your Job as a Contractor??? Rerun Calls Visit the site and make sure the type of the work is something that you are capable of doing. Be fair and professional when writing a proposal. Every job should be done within the timeframe noted on the inspection report. Make sure your calendrer allows you to get the work done on time.
14 Re-Engineering For performing any major repairs to the existing stormwater management facility at your site, you need to consult with NCC, Dept. of Special Services, for their review and approval process. Plans must be reviewed and approved by NCC, Dept. of Special Services before you hire a professional contractor to start the project.
15 Enforcement If the required maintenance isn't completed within the NCC timeframe on previous inspection report: A Notice of Violation (NOV) and a Correction Order will be mailed to the owner or the responsible party. You have 10 days to submit to our office a plan of action and 30 days to complete the work. If still no work is completed by the NOV deadline, a Rule to Show Cause Hearing will take place plus up to $1,000 fine/day from the initial day of violation could be issued.

17 Prohibited by Federal Law NPDES permit # DE : The discharge or disposal of used motor vehicle fluids, household hazardous wastes, grass clippings, leaf litter, domestic wastes, oil & grease, carwash waste water and etc. into the Municipal Separate Storm Sewer System (MS4) is prohibited.
18 Against the Drainage Code The Owner is in violation of Sections (B) of the Code for discharging sewage, industrial wastes, and/or other wastes into the storm sewer system, or any component thereof, or onto driveways, sidewalks, parking lots, or other areas draining to the storm sewer system. Pursuant to Section of the Code, The owner is hereby directed to complete the items listed in this Correction Order.

21 Enforcement of Illicit Discharge As soon as our office receives a tip for a PID Possible Illicit Discharge case, County personnel will be notified to visit the area to investigate the PID. A report will be mailed to us if the case was confirmed as an active ID Illicit Discharge case. The County issues a NOV Notice of Violation and Correction Order to the owner. A copy of the NOV will also be mailed to the site. Failure to complete the items in the "Correction Order" shall result in further enforcement action under Section of the Code, which includes, but is not limited to, administrative fines and investigation fees.
