5 Regulatory Issues White River Hub (WRH) is a FERCjurisdictional project Accelerated regulatory approval First introduced the project to the FERC on September 26, 2007 Filed certificate application, including a pro forma tariff, supporting exhibits and environmental reports on May 16, 2008 (eight months prep time) 5

6 Regulatory Issues Accelerated regulatory approval (continued) The FERC issued an order approving the project on August 1, 2008 the very day requested in WRH s certificate application (2 ½ months processing time) The BLM issued the ROW grant on August 28, 2008 Construction commenced on August 29, 2008 Filed compliance tariff with the FERC on September 30, 2008 Waiting for approval of tariff prior to commencing service 6

9 Regulatory Issues Transportation services (continued): RGS (continued) Available to any Gas Processing Customer that owns residue gas delivered from a processing plant directly into WRH Gas Processing Customer may elect to either contract, nominate and schedule its own gas on WRH or have the processing plant operator act as agent 9

10 Regulatory Issues Transportation services (continued): RGS (continued) Processing plant operator, acting as agent, is known as the Gas Service Administrator (GSA) GSA signs an RGS agreement for transport on WRH on behalf of its Gas Processing Customers, manages that contract by allocating daily capacity to its customers based on plant throughput and manages nomination, scheduling, billing and other transport needs The Gas Processing Customer must execute an Agency Appointment Agreement with the GSA 10

18 Scheduling Information WRH has sufficient mainline capacity to meet contracted obligations. Volume reductions will be based on interconnect confirmations. In the event nominations exceed meter capacity or pipeline throughput capacity, then WRH will schedule volumes. 18

19 Scheduling Information continued For informational purposes, the pooling meter (MAP 800) has been located on the REX side of the Hatch Gulch interconnect. The scheduling point has been located between the pooling meter and REX. 19

20 Confirmation and Balancing Operational Balancing: Because the pipeline is only 7 miles in length with approximately 22,000 Dth of line pack, nominations and actual volumes must be aligned to prevent operational problems. Gas Control will coordinate with the other pipelines via telephone call as we do now to adjust set points. Gas Control Contact: (801)

28 Interruptible Transportation Prior to the beginning of the month, through the informational postings, White River will post rates at which it is willing to transport gas on an interruptible basis between specific receipt and delivery points during the succeeding month. Interruptible Shippers paying a discounted rate are subject to allocation based on rate. Shippers may amend their Interruptible Transportation Service Agreements to request a higher rate using the contracting procedures outlined in White River s FERC Gas Tariff. Acceptance of any new rate will be confirmed and contracted through the Customer Activities web site. 28
