1 FEDERAL ENERGY REGULATORY COMMISSION ENVIRONMENTAL COMPLIANCE MONITORING PROGRAM WEEKLY SUMMARY REPORT NEXUS GAS TRANSMISSION PROJECT DOCKET NO.: CP FOR THE PERIOD: OCTOBER 23 THROUGH OCTOBER 29, 2017 On August 25, 2017, the Federal Energy Regulatory Commission (FERC) issued a Certificate of Public Convenience and Necessity (Certificate) under section 7 of the Natural Gas Act for authorization to construct and operate the NEXUS Gas Transmission, LLC (NEXUS) NEXUS Gas Transmission Project (Project). The Project consists of about miles new of 36-inch-diameter pipeline and associated facilities, including about miles of new pipeline in Columbiana, Stark, Summit, Medina, Lorain, Huron, Erie, Sandusky, Wood, Lucas, Henry, and Fulton Counties, Ohio; and about 48.1 miles of new pipeline in Lenawee, Monroe, and Washtenaw Counties, Michigan; four new natural gas-fired compressor stations, and associated facilities/aboveground appurtenances. As committed to in its application and in accordance with the Order for the above referenced docket, NEXUS agreed to fund an (Program) during construction of the Project. This report provides a summary of the FERC Compliance Monitors construction review for this reporting period. Three Program Compliance Monitors (CMs), Aric Donajkowski, Tom McDonald, and Tina Webb are conducting daily inspections documenting compliance with the Project s environmental requirements along the Project s right-of-way. The compliance monitors are responsible for reviewing NEXUS s construction and documenting compliance with the FERC Certificate. 2 COMMUNICATION REPORTS NEXUS Gas Transmission Project, Docket No.: CP Communication reports provide documentation of relevant meetings between the FERC CM and landowners, agencies, Project representatives, Environmental Inspectors, and/or Contractors. The seven communication and follow-up reports represented below capture compliance related information for keeping this weekly summary report relevant to current Project activities. Date SUMMARY OF COMMUNICATION REPORTS FOR THE NEXUS GAS TRANSMISSION PROJECT OCTOBER 23, 2017 THROUGH OCTOBER 29, 2017 Spread/ Facility 10/23/2017 CS 2 - Wadsworth Location (Milepost) Follow-up Required If Applicable (Yes or No) Communication Description 63.4 No The CM observed a minor off right-of-way occurrence at the Compressor Station (CS) 2 - Wadsworth site where a silt fence trenching machine cut a 6 to 8 -inch-deep trench approximately 5 feet beyond the limits of the workspace in an upland area. The trenching machine tracks did not leave the right-of-way. No environmental resources were impacted, and the previously disturbed area was repaired. The Lead EI documented the incident. No follow-up was needed since the issue was immediately resolved. 10/23/2017 Spread 4 Wareyard 4-7 No The CM observed that Wareyard 4-7 was not survey staked. The CM communicated that the yard required survey staking to the Lead Environmental Inspector (Lead EI). Timber mats were being delivered to the Wareyard. The CM discerned that activities were confined within the yard perimeter as shown on Project maps. The Lead EI explained that survey activities would begin on October 24, On October 25, 2017 the CM returned to the Wareyard and observed survey staking was installed, resolving the previously noted concern. 10/25/2017 Spread Yes The CM noted concerns regarding drainage and erosion and sediment control (ECD) placement. The CM stated follow up reports would be made to reassess the area as construction progressed. 10/25/2017 Spread 1 Wareyard 1-2 Yes The CM observed a small amount of gravel on the road at the entrance to Wareyard 1-2. The Lead EI was notified about the issue and he relayed a message to the crew. The CM would continue to observe the area for track-out issues. 10/25/2017 Spread No The CM observed unapproved use of driveway and vehicle parking near milepost (MP) by various Project staff. The Lead EI was notified and confirmed with the Land Supervisor that the driveway as not approved access and parking was not permissible. The Lead EI informed the Project staff not use this property for vehicle parking or use. The Lead EI also communicated the incident to the NEXUS Environmental Coordinator. NEXUS planned to retrain staff the following day (October 26, 2017) regarding using approved Project access. No environmental damage occurred. 10/27/2017 Spread Yes The CM observed an area of the right-of-way with staking which did not appear to be consistent with other areas near stream D15-25-S1 (MP 252.9). Additionally, the CM observed some small piles of brush cuttings cast aside off right-of-way resulting from survey staking. The Lead EI was notified of the concerns. The CM would follow-up on the area. 2

3 Date NEXUS Gas Transmission Project, Docket No.: CP SUMMARY OF COMMUNICATION REPORTS FOR THE NEXUS GAS TRANSMISSION PROJECT OCTOBER 23, 2017 THROUGH OCTOBER 29, 2017 Spread/ Facility 10/28/2017 CS 2 Wadsworth Location (Milepost) Follow-up Required If Applicable (Yes or No) Communication Description 63.6 Yes The CM observed a need for a rock construction entrance to be installed at the entrance of a temporary access road near MP 63.6 off Guilford Rd to prevent mixing of soils and to maintain a clean roadway. The CM informed the Lead EI. The Lead EI who spoke with construction management about installing this entrance before further use specifically after the previous rain event. No offsite sediment tracking was observed. The CM would follow-up at this location. 3

4 SUMMARY OF LEVEL 1, 2, AND 3 VARIANCE REQUESTS One Level 3 Variance Request was approved during this period. A tabular summary of the requested and approved variances for the above-mentioned reporting period is presented below. SUMMARY OF REQUESTED, PENDING, AND APPROVED VARIANCES FOR THE NEXUS PIPELINE PROJECT OCTOBER 23, 2017 THROUGH OCTOBER 29, 2017 Variance Number October 24, 2017 Request Variance Level a Date Received Location (Milepost) Description 3 10/24/2017 All Requested revision to Section of the Project s Spill Prevention, Control, and Countermeasure Plan (SPCC) clarifying that secondary containment is required for pumps and other portable fuel burning equipment operating within 100 feet of wetlands or waterbodies to prevent spills. The modifications requested are consistent with the requirements of the FERC s Wetland and Waterbody Construction and Mitigation Procedures and the Project s Erosion and Sedimentation Control Plan. Status (Approval Date) 10/25/17 a Variance Level Definitions Level 1 Variance reviewed and approved or denied by the Compliance Monitors. These requests must be within the original survey corridor or of like use and are for site-specific, minor, performance-based changes to Project specifications or mitigation measures that provide equal or better protection to environmental resources. Level 2 Variance reviewed and approved or denied by the Compliance Manager. These requests involve Project changes that would affect an area outside of the previously approved work area, but within the corridor previously surveyed for cultural resources, sensitive species, sensitive resources, etc. Level 3 Variance must be reviewed and approved or denied by the FERC Project Manager. These requests exceed the decision authority of the Compliance Manager or are denied as Level 2 Variances. 4

The trench was filled in and the impact is no longer visible.
