Fencing Location RECOMMENDATION Staff recommends that City Council authorize issuance of an asbestos abatement permit to the Los Angeles County Metropolitan Transportation Authority (Metro) and its Contractor for the properties located at and Wilshire Boulevard. INTRODUCTION Metro is requesting City Council approval for an asbestos abatement permit at and Wilshire Boulevard (Attachment 1). This site will be used as a staging area for future construction for the Wilshire/Rodeo Station. This abatement work is required to be completed by Metro prior to demolition of the building and the design-build station construction activities. Because of the very limited scope of the work, all the permit conditions are included with the permit instead of developing a Memorandum of Agreement (MOA). Future work, including demolition and use of the site are expected to be part of the MOA. Page 1 of 3 5/3/2018
2 Meeting Date: May 8, 2018 DISCUSSION Metro is requesting City Council approval for asbestos abatement at and Wilshire Boulevard (Attachment 1) in preparation for the future Wilshire/Rodeo Station construction. Per Beverly Hills Municipal Code , the contractor must obtain an asbestos abatement permit to remove asbestos from a property prior to demolition of the building under the City s asbestos abatement checklist. To obtain this permit, the contractor is required to submit evidence of State certification for asbestos removal. The contractor has satisfied this requirement. Metro s contractor is required to follow survey requirements, notification requirements and work regulations set forth by the California Division of Occupational Safety and Health (Cal OSHA) and the Air Quality Management District (AQMD) Rule At completion of the work, the Contractor must submit to the City a written Certificate of Completion that the asbestos has been removed in accordance with State requirements. Construction In formation and A esthetics: The abatement work at and Wilshire Boulevard is contained within the building and on the rooftop. The work will be performed during the City s standard construction hours of 8 am and 6 pm, Monday through Friday for five weeks. Any additional time beyond five weeks will require an amendment to the permit. There will be no work on weekends or holidays. Recommended permit conditions are in Attachment 2. The contractor estimates an average of less than one truck per day will be necessary to remove the material. These trucks are required to follow the City-approved haul routes. All trucks are required to be clean and not track dirt or debris into or out of the site. Construction fencing will be placed in the alley along the property line and will be visible from the alley located between North Crescent Drive and North Canon Drive (Attachment 3). This fence will be set back from the road as far as possible and will be covered with a solid color screen consistent with the public information graphics program previously approved by City of Beverly Hills. AQMD requires fencing to be installed to deter access by the general public and enclose the area during movement of the materials. The fence will not be installed until required by the AQMD construction regulations and is intended to stay in place during the demolition of the structures. All construction vehicles will be parked on site. Construction/Permit oversight will be administered by City of Beverly Hills staff. Prior to abatement of asbestos containing materials, the contractor will establish physical barriers to isolate the work by erecting a containment area. The containment will be sealed at the perimeter of the work zone to prevent dust migration outside of the abatement area. The contractor will install air filtration units, fitted with multiple filters efficient at filtering out asbestos fibers and other particulates to continuously filter the air inside the containment. Asbestos-containing material will be wetted and removed carefully. All asbestos-containing waste materials will be promptly bagged and stored in appropriately labeled leak tight waste bags prior to transportation off site for disposal. In addition, an independent consultant will perform air sampling for asbestos at the perimeter of the abatement work areas. Air samples will be analyzed daily to ensure compliance with Environmental Protection Agency (EPA) requirements. Final air clearance sampling will be conducted by the independent consultant to verify completeness of abatement activities and prior to removing containments. Page2of3 5/2/2018
3 Meeting Date: May 8, 2018 The building itself is not anticipated to be demolished until July Staff will return to City Council before issuing a permit, unless an MOA is previously approved by City Council, for the demolition work and will develop a series of conditions to mitigate impacts associated with the demolition work. Finally, a piece of public art is currently displayed on the property, which was initially installed in satisfaction of the City s public art ordinance. The public art is expected to be stored during construction and returned upon redevelopment of the site. A covenant in favor of the City was recorded against the property to ensure the continued maintenance of the art on site. City Council will be presented with an amendment to the current covenant to ensure that the art is properly stored during construction. Community Engagement On April 4, and May 2, 2018, Metro provided an update at the monthly Beverly Hills community meeting where the abatement work was discussed. On Monday, April 16, 2018, Metro ed and hand delivered notices to the adjacent businesses/buildings and posted it on the Purple Line Extension construction notice webpage. FISCAL IMPACT All permit-related fees are to be collected in accordance with the City s approved and adopted Schedule of Taxes, Fees and Charges. Metro will reimburse the City for all other costs for additional staff and Consultants performing work on this project, including the scope described above and detailed in the permit conditions, within the total amount authorized by the approved annual Form 60 work plan, which outlines the City costs associated with each work task for the year. / han%> (,>/i.? )rpidroved By Page 3 of 3 5/2/2018
