A (Filed February 3, 2017) S (U 338-E) NOTICE OF EX PARTE COMMUNICATIONS Pursuant to Rule of the Rules of Practice and Procedure of the California Public Utilities Commission (Commission), Southern California Edison Company (SCE) gives the following report regarding its August 9, 2017 ex parte communication with Elizabeth Podolinsky, Advisor to President Picker and its August 9, 2017 ex parte communication with Sean Simon, Chief of Staff for Commissioner Rechtschaffen, and Travis Foss, Advisor to Commissioner Rechtschaffen, in the above-referenced proceeding. On August 9, 2017, Lisa Swenerton, Director and General Manager of SCE s Edison Carrier Solutions (ECS), and Dawn Anaiscourt, Director, CPUC Regulatory Affairs for SCE, met with Ms. Podolinsky from 1:30 pm to 1:50 pm. On that same day, Ms. Swenerton and Ms. Anaiscourt also met with Mr. Simon and Mr. Foss from 4:00 pm to 4:30 pm. The meetings took place at the Commission s San Francisco offices. The communications were initiated by SCE and no written materials were provided. 1 The Commission s current Rules do not define Commissioner advisors as decisionmakers subject to ex parte reporting. However, Public Utilities Code (e)(2), effective January 1, 2017, requires the Commission to adopt a definition of decisionmaker that includes the personal staff of a Commissioner. Therefore, SCE is treating advisors as decisionmakers for purposes of Rule 8.3(c)(2). 1

3 In both meetings, SCE explained that ECS is a business unit within the company, that SCE received its Certificate of Public Convenience and Necessity (CPCN) a number of years ago, and that the transaction contemplated by the proposed lease agreement is normal course of business for SCE with respect to its telecommunications services. SCE also discussed the proceeding history and its hope for a swift resolution. Additionally, during the 4:00 pm meeting with Commissioner Rechtschaffen s office, SCE provided more detail on the gross revenue sharing mechanism applicable to the lease transaction; the use, function, and funding of its fiber optic network, and the structure of the master lease transaction.
