Ecology will review the work pursuant to Section 1 of the CWA, with applicable provisions of State water pollution control laws and the Coastal Zone Management Act. APPLICANT: Attention: Mr. Sean Quarrie th Avenue Northeast, Suite 5 Bellevue, Washington 4 Telephone: (425) LOCATION: In wetlands, ditches, Johns Creek, May Creek, Unnamed Tributary (UNT) to Gypsy Creek (UNT 08.LW.0283), and Streams/Drainages 7.7A, 7.7, 7.8, 8.05, 8.7, 8.12, 8.15, 8.22, 8.31, 8.9, and 9.9 between the Cities of Bellevue and Renton, in King County, Washington. WORK: The (WSDOT) proposes to make several roadway, stormwater treatment, drainage, and fish passage improvements, and will add transit and high occupancy vehicle (HOV)/express toll lanes (ETL) in each direction of Interstate 5 (I 5) between Renton and Bellevue. The work will occur over an 8 mile section of I-5 from State Route (SR) 169 to the Interstate (I-) interchange in King County, Washington. The proposed project includes one new lane in each direction between SR 169 in Renton (milepost [MP] 4.0) and the northern on-and-off ramps of I- (MP 11.9). The project would impact 44 wetlands. They include permanent, direct impacts to acres of wetland; longterm temporary impacts to acre, and short term temporary impacts to acre of wetland. Permanently impacted wetlands include Department of Ecology Category II (0. acre), III (2.515 acres), and IV (2.827 acres); depressional and slope; and palustrine forested, scrub shrub, and emergent systems. Permanent stream impacts total acre which includes fill for new culverts and excavation to remove fill for habitat

2 NWS , WA St Dept of Transportation improvements (see In Water Work summary below). Permanent wetland buffer impacts are acres and temporary buffer impacts are acre. Buffer impacts are to forested, shrub, and herbaceous vegetation. The impacted wetland functions include flood flow alteration, sediment removal, nutrient and toxicant removal, organic matter production and export, general habitat suitability, aquatic invertebrate habitat, amphibian habitat, and wetland-associated mammal habitat. The project proposes the following improvements: Northbound and Southbound I-5 (MP 3.8 MP 11.9): Widen I-5 from SR 169 to just north of I- to accommodate an additional lane both northbound and southbound. The additional lane will be coupled with the existing northbound and southbound HOV lane to create two express toll lanes (ETLs). Where feasible, the additional lanes will be developed by restriping instead of roadway expansion. Sunset Boulevard N (MP 4.53) and NE Park Drive (MP 5.42) Interchanges: At Sunset Boulevard, widen the I-5 northbound and southbound bridge structures. At NE Park Drive, widen the I-5 southbound bridge structure. NE th Street (MP 6.52): Replace the local road overpass abutment slopes with retaining walls on both sides of I-5 to accommodate widening. Lower the southbound I-5 roadway. Add an auxiliary lane on southbound I-5 just north of NE th. NE 44th Street Interchange (MP 7.48): Replace the local road bridge structure and reconstruct the interchange. Construct new direct access ramps for transit and ETL users in the I-5 median. Reconstruct Lake Washington Boulevard NE between NE 44th Street and SE 76th Street, and realign the northbound on-ramp to I-5 toconnect to Lake Washington Boulevard NE. Construct an at-grade Park-and-ride lot on the corner of LakeWashington Boulevard N and NE 44th Street. The park-and- ride will have a minimum of 200 parking stalls. 112th Avenue SE Interchange (MP 9.25): Replace the local road bridge structure over I-5. This interchange includes a design option to reconfigure the interchange, replace bridge structures, and construct new ramps for transit and ETL users in the I-5 median. The Newport Hills park-and-ride lot would be reconfigured. Coal Creek Parkway Interchange (MP 10.2): Construct a new southbound I-5 bridge on a new alignment. Convert the existing southbound I-5 bridge to northbound ETLs. These improvements convert four local roadway intersections along Coal Creek Parkway to roundabouts. I- Interchange (MP 11.1): Reconfigure the I-5 southbound to I- eastbound ramp from one- lane to two lanes. Realign the I-5 northbound to I- eastbound ramp. Part of this work will require constructing two new bridges over the eastbound I- ramp to Factoria Boulevard and over Factoria Boulevard. Lake Washington Trail (MP 7.35 MP 10.25): Realign and reconstruct the existing trail west of its current location to reside within the Eastside Rail Corridor from Ripley Lane in Renton to Coal Creek Parkway in Bellevue. The proposal is to construct a bike and pedestrian trail within the Eastside Rail Corridor. This portion has been open to the public as a trail even with the rails intact. At this time, King County is in the process of removing the existing rails and creating a gravel path on the existing railroad ballast. May Creek Trail: An extension of the City s May Creek Trail will be constructed on the north side of May Creek parallel to the channel and above the -year floodplain. The trail will be eight feet wide and will extend from the end of the existing May Creek Trail (which currently ends approximately feet east of the eastern boundary of the WSDOT right-of-way) to Jones Road. However, only the portion of the trail within WSDOT right-of-way is being permitted as part of this application. The portions of the trail outside of WSDOT right-ofway will be permitted separately and are not part of this application. Noise Walls: Construct up to three new walls and relocate two existing noise walls. Stormwater: Construct stormwater management and water quality facilities to treat all of the new impervious surfaces, and a portion of the existing non-treated surfaces. The additional stormwater treatment will improve water quality in the basin. 2

3 NWS , WA St Dept of Transportation In Water Work: Fish Passage Barrier Correction Culverts: Construct new fully fish passable crossings to eliminate existing fish barriers under I-5 and NE 44 th Street. The fish corrections include five culverts: three culverts in the UNT 08.LW.0283 (Gypsy Creek subbasin) and one each in streams 7.7A and 7.8. The new culverts on Streams 7.7A and 7.8 may include removable flow constriction devices, which may be needed to protect downstream private properties from increased flood risk. The project has the potential to provide increased access to additional habitat in these streams for resident fish only. There are downstream barriers on all three streams that prevent upstream passage from Lake Washington. The new fish passable culverts in UNT 08.LW.0283 will provide additional open channel habitat for resident fish by replacing the culvert under NE 44th Street and under I-5, and opening up the median between Lake Washington Blvd and northbound I-5. The new culverts will be sized appropriately according to Washington Department of Fish and Wildlife (WDFW) Water Crossing Design Guidelines published in These culverts are located near the I-5 and NE 44th Street intersection, and range from 1,200 to 2,200 lineal feet from Lake Washington.. Stormwater Conveyance Culverts and Non-Fish Bearing Streams: Other culverts that convey stormwater will be inspected during construction, and those that are worn or in need of repairs may need replacement. Some of these culverts will be extended. May Creek Bridges (MP 7.18): Replace the northbound and southbound I-5 bridge structures over May Creek and provide habitat improvements along the creek by removing the existing piers that are constricting the channel, removing angular rock fill material from the channel and bank, improving fish habitat along the stream channel, and providing buffer enhancement. Work includes excavation of 1,3 cubic yards of rock over 3,058 sf of channel. All of the proposed work in this location is excavation. Fill is not proposed. Johns Creek: Rock will be placed over 4 sf of the channel to protect the streambed from erosion from the outfall from the stormwater conveyance culvert. To improve safety and relieve congestion on I-5. ADDITIONAL INFORMATION: If issued, this permit would be valid for 5 years. The wetland boundaries and location of the ordinary high water marks shown on the project drawings have not yet been verified by the U.S. Army Corps of Engineers (Corps). If the Corps determines the boundaries of the wetland/waters are substantially inaccurate a new public notice may be published. MITIGATION: WSDOT minimized wetland impacts through highway alignment adjustments, steepening side slopes, adding retaining walls, reducing lane widths from 12 to 11 feet, adjusting on and off ramp alignments, working in the median, and changes to roadside barrier and wall types. To compensate for unavoidable wetland impacts, WSDOT proposes to mitigate for stream impacts on site by removing fill from May Creek and enhancing 0. acre of stream buffer. New culverts at UNT 08.LW.0283 will create new stream channel and riparian buffer habitat as mitigation for impacts. WSDOT has proposed to mitigate wetland impacts by debiting 3.91 acre credits from the Springbrook Creek Wetland and Habitat Mitigation Bank (Springbrook Bank) located in the City of Renton, and debiting 1.00 acre of advance credits from the WSDOT owned Kelsey Creek Mitigation Site located in the City of Bellevue within Kelsey Creek Park. This includes the mitigation for Wetland 10.8L, a Category II wetland located within the Mercer Slough Wetland Complex. As the impacts occur to primarily roadside ditched wetlands, or impacted wetlands within the highway right of way, the impacted functions would be replaced and improved at the Springbrook Bank and Kelsey Creek Mitigation Site at equivalent or higher levels than the impacted functions. Buffer impacts will be mitigated by improving the buffer at the Mercer Slough Wetland Site by planting native woody species for improved cover and at the Medium Stream Enhancement Site. ENDANGERED SPECIES: The Endangered Species Act (ESA) requires federal agencies to consult with the National Marine Fisheries Service (NMFS) and/or U.S. Fish and Wildlife Service (USFWS) pursuant to Section 7 3

4 NWS , WA St Dept of Transportation of the ESA on all actions that may affect a species listed (or proposed for listing) under the ESA as threatened or endangered or any designated critical habitat. The Federal Highway Administration (FHWA), as the lead agency for ESA consultation, has consulted with the NMFS and the USFWS as required under Section 7 of the ESA. They have determined that the project will adversely affect listed species and their designated critical habitat. Separate Biological Opinions were issued on January 3, 2007 and March 12, FHWA has reinitiated consultation to address effects to species listed after March 12, 2008 and a Letter of Concurrence was issued on December 11, ESSENTIAL FISH HABITAT: The Magnuson-Stevens Fishery Conservation and Management Act, as amended by the Sustainable Fisheries Act of 1996, requires all Federal agencies to consult with the NMFS on all actions, or proposed actions, permitted, funded, or undertaken by the agency, that may adversely affect Essential Fish Habitat (EFH). The proposed action would adversely affect Pacific Coast Salmon EFH in the project area. The FHWA, as the lead agency for a determination regarding EFH, has consulted with the NMFS, who concurred with their determination on March 12, CULTURAL RESOURCES: The FHWA, as the lead agency for determining compliance with Section 106 of the National Historic Preservation Act, has consulted with the State Historic Preservation Officer (SHPO) and Native American Tribes. The FHWA determined the project would have "No Adverse Effect" to the historic properties within the Area of Potential Effect (APE) that are eligible for listing in the National Register for Historic Places. The SHPO concurred with FHWA s determination on June 26, PUBLIC HEARING: Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearings shall state, with particularity, the reasons for holding a public hearing. EVALUATION CORPS: The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered, including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. The Corps is soliciting comments from the public; Native American Nations or tribal governments; Federal, State, and local agencies and officials; and other interested parties in order to consider and evaluate the impacts of this activity. Any comments received will be considered by the Corps to determine whether to issue, modify, condition or deny a permit for the work. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the activity. The described discharge will be evaluated for compliance with guidelines promulgated by the Environmental Protection Agency under authority of Section 4(b)(1) of the CWA. These guidelines require an alternatives analysis for any proposed discharge of dredged or fill material into waters of the United States. SOURCE OF FILL MATERIAL: The applicant has not yet identified the source of the fill material. All fill material would come from a WSDOT-approved source. 4

5 NWS , WA St Dept of Transportation EVALUATION ECOLOGY: Ecology is soliciting comments from the public; Federal, Native American Nations or tribal governments, State, and local agencies and officials; and other interested parties in order to consider and evaluate the impacts of this activity. Ecology will be considering all comments to determine whether to certify or deny certification for the proposed project. ADDITIONAL EVALUATION: This proposal is inside the Shorelines Management Act jurisdiction. The proposed project is under review for a Substantial Development Permit from both the City of Bellevue and the City of Renton. King County is reviewing the proposal to determine if a Shoreline Permit is needed.
