17 CENF 100 TARIFF Original Page 7 ITEM NO. 75 DEFINITION OF TECHNICAL TERMS ABSOLUTE MINIMUM CHARGE means the minimum charge after discount. ACTUAL PLACEMENT means the placing of a vehicle at site designated by the consignor or consignee for loading or unloading. ANY QUANTITY OR AQ means any quantity of the same commodity or commodities less than the lowest of other stated minimum weights covered by the applicable class or commodity rates. CARRIER Central Freight Lines, Inc. CARRIER S EQUIPMENT means any motor truck or other self-propelled highway vehicle, trailer, semi- trailer or any combination of such highway vehicles, operated by the CENF. COMPONENT PART means any part of a shipment separately received by the Central whether or not such part is separately delivered by the CENF; and any part of a shipment separately delivered by the CENF whether or not such part is separately received by the CENF. CONSIGNEE means the person, firm or corporation shown on the bill of lading as the party to whom the property is physically delivered by the CENF. CONSIGNOR means the person, firm or corporation shown on the bill of lading as the shipper of the property received by CENF for transportation. CONSTRUCTIVE PLACEMENT means the holding of a vehicle at a place other than the designated loading or unloading site due to the inability of consignor or consignee to accept the vehicle for actual placement after its tender. DEBTOR means the person obligated to pay the accessorial or freight charges to the CENF, whether consignor, consignee, or other party. DISTANCE TABLE means the Governing Distance Table as described in Governing Publications. ESCORT SERVICE means the furnishing of pilot cars or vehicles by CENF as may be required by any governmental agency to accompany a shipment for highway safety. ESTABLISHED DEPOT means a freight terminal owned or leased and maintained by CENF for the receipt and delivery of shipments. EXCEPTION SHEET means as described in the Governing Publications. EXTRAORDINARY VALUE means articles exceeding $50.00 per pound per package or a carrier liability exceeding $100,000 per incident per shipper whichever produces the lesser charge. Revised Page 8 ITEM NO. 75 DEFINITION OF TECHNICAL TERMS HAZARDOUS MATERIALS means articles described in the Hazardous Materials Tariff as set forth in the Governing Publications. HOLIDAY means: New Year s Day (January 1) Memorial Day (Last Monday in May) Independence Day (July 4) Labor Day (First Monday in September) Thanksgiving (Fourth Thursday & Friday in November) Christmas Eve and Christmas Day (December 24 and 25) When a holiday falls on Sunday, the following Monday shall be considered as a holiday; when a holiday falls on Saturday, the preceding Friday shall be considered as a holiday or any other day generally observed as a holiday by CENF at the point at which the service is performed. IMMEDIATELY ADJACENT freight shall be considered to be immediately adjacent to a parking space for carrier to place its vehicle for loading and unloading if separated therefrom only by an intervening public sidewalk If a parking space suitable for carrier to place its vehicle for loading or unloading is occupied or city ordinance prohibits its use, the nearest available parking space may be used. IN BULK means not in bags, sacks, package, or other containers, except bins, or except containers otherwise specified. INDEPENDENT-CONTRACTOR SUBHAULERS means any carrier who renders service for a principal carrier, for a specified recompense, for a specified result, under the control of the principal carrier as to the result of the work only and not as to the means by which result is accomplished. JOINT-LINE - Traffic moving between stations/terminals located on one transportation line and stations/ terminals located on another transportation line. LESS-THAN-TRUCKLOAD (LTL) - Shipments weighing and rated as weighing 19,999 lbs or less. LOADING BY CARRIER means freight tendered for loading shall be situated by the consignor as to be directly accessible to the vehicle, or it shall be immediately adjacent to a parking space suitable for carrier to place its vehicle for loading. Loading includes stowing and counting of freight in or in the carrier s vehicle, furnishing the carrier with forwarding directions or other documents necessary for forwarding the shipment and the execution documents necessary for forwarding the shipment and execution of the bill of lading. The carrier will furnish only one person per vehicle for loading, be they the driver, helper, or other carrier employee. 19 CENF 100 TARIFF Original Page 9 DEFINITION OF TECHNICAL TERMS ITEM NO. 75 NET CHARGE is defined as net dollar amount billed to the debtor after reduced rates or charges through the application of governing discounts, allowances, commodity rates, exception ratings, or any other reduction have been applied. NORMAL BUSINESS HOURS: Normal business hours shall mean 8:00 AM to 5:00PM, excluding Saturdays Sundays and legal holidays except that the consignee may designate his normal business hours to be other than 8:00 AM to 5:00 PM provided that such designation is made in writing in advance of delivery and that such designated hours include at least six hours all of which are between 8:00 AM and 5:00 PM. PALLETIZED SHIPMENT means a shipment tendered to and transported by Central on pallets (elevatingtruck pallets or platforms or list-truck skids, with or without standing sides or ends, but without tops). PERMIT SHIPMENT means a shipment which because of its width, length, height, weight or size requires special authority from a governmental agency regulating the use of highways, roads or streets for the transportation of such shipmen in whole or in part. PICKUP and DELIVERY CHARGE means the full charge applicable without the deduction otherwise authorized in this tariff. PIECE - For counting purposes, the definition of a single piece shall be unitized quantities prepared in any shipping form including articles secured to elevated truck platforms, lift skids, or pallets. POINT OF DESTINATION means the precise location at which property is tendered for physical delivery into the custody of the consignee or his agent. All points within a single industrial plant or receiving area of one consignee shall be considered as one point of destination. An industrial plant or receiving area of one consignee shall include only contiguous property which shall not be deemed separate if intersected only by public street or thoroughfare. POINT OF ORIGIN means the precise location at which property is physically delivered by the consignor or his agent into custody of the carrier for transportation. All points within a single industrial plant or shipping area of one consignor shall be considered as one point of origin. An industrial plat or shipment area of one consignor shall include only contiguous property which shall not be deemed separate if intersected only by public street or thoroughfare. POWER EQUIPMENT means any gasoline, diesel, electric or gas driven equipment including electric powered cranes and lift truck equipment. 20 CENF 100 TARIFF Original Page 10 DEFINITION OF TECHNICAL TERMS ITEM NO. 75 PRIVATE RESIDENCE refers to the entire premises on which a dwelling for living is located and included apartments, churches, schools, camps or other such locations. The term Private Residence will not apply to that portion of the premises where commercial or business activity is conducted that involves the sale of services, products or merchandise to the walk-in public during normal business hours. PUP means one trailer not to exceed 29 lineal feet of loading space. RATE means the figure stated in cents, dollars and cents, or fractions thereof, including the charge and, also, the ratings, minimum weight and rules governing and the accessorial charges applying on connection therewith, to be used in computing the charge on property transported. SAME TRANSPORTATION means transportation of the same kind and quantity of property between the same points and subject to the same limitation, conditions and privileges, but not necessarily in an identical type of equipment. SET OF TRAILERS OR SET OF PUPS - Two trailers each not exceeding 29 lineal feet of loading space. Single Shipment Minimum Charge (SSMC) SINGLE SHIPMENT - When a single shipment is tendered at one time and place, the shipment will be subject to the Single Shipment Minimum Charge. SPLIT PICKUP SHIPMENT/STOP OFF means a shipment consisting of two or more component parts picked up by carrier within a period of one day for one person, firm or corporation at more than one point of origin, the composite shipment weighing (or transportation charges computed upon a weight of) not less than 10,000 pounds, said shipment being consigned and delivered to one consignee at one point of destination. (a) One consignee at more than one point of destination, or (b) More than one consignee at one or more points of destination, the composite shipment weighing (or transportation charges computed upon a weight of) not less than 10,000 pounds, said shipment being shipped by one consignor from one point of origin. NOTE: All transportation charges must be prepaid and, except as provided in items subject to this tariff. Charges shall be billed to and collected from only one debtor. TAILGATE LOADING means loading of the shipment from carrier s equipment and placing it at a point at street level not more than 20 feet distant from said equipment or at other than street level when vehicular elevator service or vehicular ramp is provided and made available to the carrier. TAILGATE UNLOADING means unloading of the shipment from carrier s equipment and placing it at point at street level not more than 20 feet distant from said equipment or at other than street level when vehicular elevator service or vehicular ramp is provided and made available to the carrier. TEMPERATURE CONTROL SERVICE means the protection from heat by the use of ice (either water or solidified carbon dioxide), delivery by mechanical refrigeration, or by release of liquefied gases. TRAILER - One unit of equipment not exceeding 29 lineal feet of loading space. TRUCKLOAD RATE - Rates on shipments weighing or assessed on the basis of 20,000 pounds or more. UNIT OF CARRIER S EQUIPMENT - A unit of carrier s equipment will consist of one or more semitrailers, not to exceed 56 lineal feet of loading space, which may be lawfully operated over the public highways without special permit. UNLOADING BY CARRIER means freight will be unloaded at the delivery site immediately adjacent to the delivery vehicle. Unloading includes the payment of all lawful charges due and payable when required as prerequisite to delivery, counting and removal of the freight from the position in which it was transported, in or on the carrier s vehicle, and execution of the delivery receipt. Carrier will furnish only one man per vehicle for unloading, be he the driver, helper or other carrier employee. 29 CENF 100 TARIFF th Revised Page 17 CREDIT TERMS - COLLECTION OF CHARGES ITEM NO. 208 Once credit has been established with Central Freight Lines, the debtor for freight charges must pay all freight bills within fifteen (15) calendar days after the billing date shown on the invoice copy of the freight bills. Payment of charges listed on the original Central Freight Lines invoice that have not been received within 30 calendar days of the date of invoice issuance by Central Freight Lines, or within a time period agreed to within a written contract, will be considered a late payment. Late payments shall be subject to a charge of 1.5% per month added to the outstanding amounts beginning after the passage of the payment due date. If Central Freight Lines is forced to utilize an outside source to collect overdue or unpaid charges, Central Freight Lines shall have the right to: Revoke all applicable discounts and allowances, and collect the gross charges for services plus any delinquency fees; and, Recover all reasonable costs arising out of the use of a collection agency, including but not limited to all attorney s fees and costs and, if Central Freight Lines institutes legal action in a court of competent jurisdiction or demands arbitration to recover any overdue or unpaid charges, Carrier shall be entitled to recover all attorney s fees and costs arising out of the initiation of legal action or arbitration. The debtor will be the consignor for prepaid shipments, the consignee for collect shipments, or a third party as defined in Item 401 of CENF 100. Unless otherwise stated in a specific discount item or contract, accounts having any type of off bill pricing mechanism or incentive of any type[loading or unloading allowance, pallet allowance, off bill discount of any type, volume incentive program, etc. or any freight payment fees] that have any invoices unpaid beyond 30 days from date of pick-up, will cause such off bill pricing mechanisms to cease. Accounts associated with a parent organization will need to be current in order for any of the checks to be paid to an individual account associated with the parent organization. Credit Qualifications- Third Party Logistics Companies ITEM NO New customer request that are in the 3PL business will require the following before setting up an open credit account. A) Sales must secure a completed credit application signed by the responsible principal(s) of the company. No application will be processed if 3PL has been in business less than a year under the current doing business as company name. B) A credit report will be pulled from Dun & Bradstreet and must have a Credit Appraisal Score of 2 or better with no unfavorable suits or judgments from other transportation companies. 30 CENF 100 TARIFF Original Page 17A COMBINED SHIPMENT RULE ITEM NO. 209 When during one calendar day, two or more shipments are received from one consignor at one origin address, destined to one or more consignees at the same destination delivery address, that combined will be greater than 750 cubic feet and has an average density of less than six (6) pounds per cubic foot, the shipment will be combined as one shipment on one bill of lading and will be subject to Item and Item When two or more shipments are shipped from one consignor at one origin address destined to one or more consignees at the same destination delivery address on the same day and the two or more shipments fill the full visible capacity of the vehicle as defined in Item 406, the two or more shipments will be rated as a single shipment under the capacity load rule (Item 406) as a minimum. ITEM NO. 211 CONTAINERS - SHIPMENTS TRANSPORTED IN OR ON SHIPPING CARRIERS OR CONTAINERS (Except marine type or intermodal containers designed for highway use on wheels) Except as otherwise specifically provided when shipments are tendered to carrier and transported in or on shipping carriers, containers, pallets, platforms, racks, reels or skids, such carriers, containers, pallets, platforms, racks, reels or skids constitute an integral part of the shipment and are to be delivered to and receipted for by the consignee(s) named on the Bill of Lading covering the loaded movement. Any request or provisions noted on the Bill of Lading or shipping order at the time of movement requesting the return of these shipping devices, forms or packages, shall be deemed to be for informational purposes only, and it will not be binding upon the carrier to accomplish or comply with such request or provisions to complete the contract of carriage on the shipment. Except as otherwise provided, a $30.00 (A) charge will be assessed when the bill of lading or other document(s) integral to the transportation of the shipment require corrections of any type, including but not limited to the following: 1. Central Freight Lines will change the freight bill to a third party which did not appear on the original bill of lading if the shipper so instructs in writing within (5) days from the date of the original bill of lading or prior to delivery, whichever comes first. 33 CENF 100 TARIFF Original Page 19 DEFINITION OF EXPORT TRAFFIC ITEM NO. 212 Except as otherwise provided in tariffs made subject hereto, Export Traffic is freight consigned to points outside the Continental Limits of the United States of America (Except Alaska), and will only apply on traffic which does not leave the possession of the carrier and is delivered direct to the steamer or steamer s dock or steamship terminals upon arrival at the port, except shipments ordered into public or private warehouses and subsequently exported within the next 12 month period and on which required proof of exportation is submitted. Shipments not consigned on Shipping Orders or Bills of Lading for export, which are ordered for export, after arrival at the United States Port, will be subject to the rates, rule and regulations applicable to Export Traffic or the same as would have applied had the shipment been originally consigned for export, so long as the freight has not passed from possession of the carrier. Export rates will also apply on shipments consigned on Bills of Lading for export to foreign countries or foreign possessions in the United States, handled through United States Navy Yards, Naval Bases or Army Bases or delivered to United States Government Vessels docked thereat on presentation of proper evidence of exportation. All freight charges on shipments for export, except to points in Canada, must be prepaid; however charges may be billed for collection from an agent, broker or similar party when such charges are guaranteed by the shipper. The Bill of Lading must specify such guarantee and provide a specific mail address for the agent, broker or party from whom the collection is to be made. A Shipment of export freight means any freight received at one time on one Shipping Order or Bill of Lading which is covered by not more than one dock receipt from one shipper at one point of origin to be delivered to one consignee at one destination (See Note A). Unless otherwise provided, any weight or articles received as one shipment on one shipping order, one Bill of Lading and one dock receipt in excess of a full truckload will be charged on the same basis as for the full truckload. (b) When CENF is requested to furnish equipment or provided help in performing the loading or unloading of commodities of unusual size, bulk or weight, the charges otherwise provided in tariffs made subject to this tariff for such service will apply. (c) CENF s obligation to accept shipments, which on account of length, width, height or weight, require special permits from municipal or other authorities to permit their transportation, shall be subject to the suitability of carrier s equipment. LIABILITY - PERISHABLES ITEM NO. 219 The provisions of this item apply as stated in the following paragraph which must be annotated on the CENF bill of lading or shipping order: CENF provides no protective services within the states it serves and therefore assumes no liability for damage to perishable commodities, including but not limited to wilting, freezing, heat damage, burning, disease, and any and all damage related to the perishable nature of the commodity or commodities which may occur while the shipment is in the carrier s possession. CENF 100 TARIFF Original Page 25 LOADING BY CONSIGNOR - UNLOADING BY CONSIGNEE ITEM NO. 221 Rates subject to provisions that consignor is to load and/or consignee to unload the shipment are subject to the following additional provisions: (a) At time of shipment, a notation must be made on the bill of lading and the shipping order by the consignor, that consignor is to load and/or consignee is to unload the shipment (subject to NOTE 1). (b) The complete loading and/or unloading of the freight, including the count thereof, must be performed by the shipper and/or consignee at his expense without any assistance from the carrier. CENF employee and power unit are to be released while loading and/or unloading is performed. At carrier s option, the carrier s employee and power unit may remain during loading or unloading but will render no assistance in loading or unloading. (c) The complete loading service includes the loading of the freight into or on the carrier s vehicle and the stowing and arranging thereof. Any temporary blocking, flooring or lining, racks, standards, trips, stakes or similar bracing, dunnage or supports not constituting a shipping carrier, container or package, or part of the vehicle when required to protect and make shipments secure for transportation must be furnished and installed by the shipper. The complete unloading service means that the consignee must remove the freight from the position in which it is transported in or on the CENF vehicle. (d) On mixed shipments, when any portion of the freight is required to be loaded or unloaded by shipper and/ or consignee as a condition precedent to the application of the rate, the entire shipment must be loaded and/or unloaded by the shipper or consignee, otherwise the rate will not apply and rates otherwise published will be assessed. (e) In event the shipment is stopped-off for partial loading or partial unloading, the party or parties tendering or receiving any portion of the shipment will be subject to the requirements as to loading or unloading. (f) If the consignor or any party tendering any portion of the shipment refuses to perform the loading, or if the consignee or any party receiving any portion of the shipment refuses to perform the unloading, the rate will not apply and rates otherwise published will be assessed. NOTE 1 - The requirement that notation must be placed on bill of lading and shipping order at time of shipment will not apply when entire shipment consists of freight in a single container, or freight secured to pallets, platforms or lift truck skids, or freight in any other authorized form of shipment, each unit weighing 500 pounds or more as tendered for shipment (loading required by consignor and unloading by consignee per NMF 100, Item 568). 41 CENF 100 TARIFF rd Revised Page 26 ITEM NO LIABILITY - PUBLISHED TRANSIT TIMES Central will make a diligent and concerted effort to at least meet our published transit times on every shipment tendered for transportation. In those instances where the transportation of an individual shipment does not meet our published transit times, however, Central will not be liable to the shipper, consignee or their agents for any and all direct or incidental damages or costs claimed to result from this failure to meet the transit times. ITEM NO MISDESCRIPTION OF FREIGHT All shipments tendered to Central Freight Lines require the correct NMFC Item and class to be provided on the bill of lading at the time of shipment, regardless of applicable FAK or exception ratings. Bills of Lading for shipments tendered to the carrier, which contain improper commodity descriptions or incomplete commodity descriptions, whereby a proper NMFC (National Motor Freight Classification) class rating cannot be determined will be rated at class 125. Freight bills rated under the terms of this item can be corrected by the Shipper providing to the Carrier a proof of proper NMFC description and class within 30 days from the date of pick up. 42 CENF 100 TARIFF th Revised Page 27 PAYMENT OF CHARGES ITEM NO. 224 (a) All rates, charges, or other amounts are stated as US currency and all rates, charges, or other amounts are payable in lawful money of the US. (b) All charges accruing under the provisions of this tariff must be guaranteed to the satisfaction of the carrier before the service will be performed unless otherwise stated in specific items. PAYMENT OF CHARGES ITEM NO REGULATIONS GOVERNING THE PAYMENT OF CHARGES ON INTERNATIONAL FREIGHT SHIPMENTS (a) Except as provided in Note A, all rates and charges provided herein are stated in money of the United States, 49 USC (a)(2), 49 CFR (a). When charges are paid in equivalent Canadian currency, the rate of exchange that determines the amount of the equivalent payment shall be as follows: (1) The rate of exchange quoted for New York funds by the Bank of Montreal at noon in Montreal, on the last of each month will govern from the first to the fourteenth (inclusive) of the following month; similarly, such quotation at noon on the fourteenth will govern from the fifteenth to the last day (inclusive) of such month. Should the governing date fall on a Saturday, Sunday or Canadian or United States legal holiday, the quotation at noon of the preceding day will govern. (2) Where the fluctuation in the rate of exchange during the periods outlined above is two(2) or more percent, that new rate of exchange will apply. 43 CENF 100 TARIFF Original Page 28 ITEM NO. 226 PICKUP OR DELIVERY SERVICE Except as otherwise provided, rates in this tariff include one pickup and loading and one delivery and unloading or one tender for delivery of a shipment at one site by the carrier during business hours subject to the provisions indicated below. (a) PLACEMENT OF VEHICLE FOR LOADING: At the request of the consignor, CENF will furnish and place a vehicle at the loading site designated by the consignor to pick up a shipment there tendered for transportation. (b) PLACEMENT OF VEHICLE FOR UNLOADING: The delivery of a shipment by CENF to the place of delivery specified on the bill of lading will include the placing of a vehicle at the delivery site designated by the consignee. (c) LOADING BY CARRIER: Freight tendered for loading shall be so situated by the consignor as to be directly accessible to the vehicle, or it shall be immediately adjacent to a parking space suitable for carrier to place its vehicle for loading. Loading includes stowing and counting of the freight in or on the carrier s vehicle. CENF will furnish only one man per vehicle for loading, be he the driver, helper, or any other carrier employee or its designated agent. (d) UNLOADING BY CENF: Freight will be unloaded at the delivery site immediately adjacent to the delivery vehicle. Unloading includes the counting and removal of the freight from the position in which it is transported in or on the carrier s vehicle. Carrier will furnish only one man per vehicle for loading, be he the driver, helper, or any other carrier employee or its designated agent. (e) RESTRICTIONS ON LOADING OR UNLOADING BY CENF: Loading or unloading service does not include assembling, packing, unpacking, dismantling, inspecting, sorting or segregating freight EXCEPT as provided in paragraph (1) below. (1) When a shipment is tendered to the carrier in lots according to size, brand, flavor, or other characteristics and is so identified on the bill of lading or accompanying papers, normal delivery service includes delivery of the shipment to the consignee in the same manner, including the placement of such sorted or segregated lots on the platform, dock, conveyor, pallet, dolly, buggy or similar device provided by the consignee for the receipt of freight within or adjacent to the vehicle without additional charge to the extent such service is performed within the free time period allowed by the applicable detention provisions. If delivery is not completed within the allowable free time, carrier will continue to unload the vehicle subject to applicable detention charges. 44 CENF 100 TARIFF Original Page 29 ITEM NO. 226 PICKUP OR DELIVERY SERVICE The provisions of this paragraph will not allow for the opening of packages or unitized shipments, including shrink wrapped or banded freight on pallets or skids. Loading or unloading service does not include furnishing by the carrier of rigging or special winches cranes, jacks, blocks or falls, chain falls or other special equipment used in hoisting, lowering, handling or placing freight in position. When such equipment is used in loading or unloading, the consignor or the consignee, as the case maybe, shall furnish same and the necessary labor to operate such equipment at its expense, and shall also assume responsibility for safe loading or unloading, except carrier s employee may use hand trucks or four wheeled hand carts and hand or electrically operated pallet jacks (non-riding type) when furnished by the consignor or consignee. (f) LOADING BY CONSIGNOR OR UNLOADING CONSIGNEE: The consignor or consignee may elect to waive the loading or unloading of freight by the carrier as provided in this item by performing at his own expense the loading or unloading of the shipment on or from the carrier s vehicle. (g) WAIVER OF DELIVERY RECEIPT: When consignor or owner has made written arrangements with CENF, freight consigned to construction sites (or other places where no representative of the consignee is present or available to receipt for the shipment) will be delivered and unloaded by CENF and left unattended at the place designated. Roadside deliveries will be made without a receipt from the consignee if so directed by the shipper but only at the shipper s risk and such shipments must have freight charges fully prepaid. Bill of lading in such instances must carry notation as follows: Deliver without receipt from consignee. There shall be no liability upon carrier for any loss or damage to said shipment after such delivery. 52 CENF 100 TARIFF Original Page 36 WEIGHTS - GROSS WEIGHTS ( Charges on Gross Weights, Exception to Item 995 of the NMF ) ITEM NO. 248 (a) Unless otherwise provided, charges shall be computed on gross weights, excluding the weight of any temporary blocking, flooring or lining, racks, standards, strips, stakes or similar bracing, dunnage or support not constituting a shipping carrier, container or packages, or a part of the vehicle, when such materials do not exceed three percent of the total weight of the shipment will be charges for at the lowest rate applicable on any article in the shipment. (b) Subject to Notes 1, 2 and 3, when freight which moves on rates subject to a minimum weight of 20,000 pounds or more is prepared for shipment in conformity with packing requirements, and, in addition, is loaded on pallets, platforms or skids, with or without standing sides or ends, but without tops, no charge will be made for the transportation of the pallets, platforms or skids, provided the shipper specifies the weight of the pallets, platform or skids on the straight bill of lading or order bill of lading. (c) The destination weights, as ascertained at the smelter, will govern in the assessment of freight charges upon shipments of ores or ore concentrates. Shipments of ores and ore concentrates may be sampled at destination or at public sampler en route. 72 CENF 100 TARIFF th Revised Page 39 COLLECTION OF CHARGES - THIRD PARTY BILLING ITEM NO. 401 (a) When a party other than the consignor or consignee shown on the bill of lading or shipping order is responsible for payment the freight charges, such party s name and address must appear in the body of the bill of lading/shipping order at time of original tender. Shipments subject to the provisions of this item will be accepted only when the consignor has established credit with the originating carrier and guarantees to pay all lawfully accrued charges if the third party fails to do so within the time allowed under the credit regulations. NOTE 1 - Shipments subject to the provisions of this item must be billed as prepaid.
