Executive Summary: On November 27, 2017, the Regional Board deferred staff s recommendation to amend the Regional District of Central Okanagan Solid Waste Management Bylaw until the recommended tipping fee changes could be presented to City of West Kelowna and District of Peachland Councils. On March 27, 2018 staff presented the proposed changes to City of West Kelowna and District of Peachland Councils. As a result, staff is bringing forward the deferred recommendation from November 27, 2018 for approval. Tipping fee changes will take effective June 1, 2018. Staff will advertise the changes to the general public and will inform users during the month of May. RECOMMENDATION: THAT Regional District of Central Okanagan Solid Waste Management Regulation Amendment Bylaw No. 1409, 2018 be given first, second, and third readings and adopted. The tipping fee increases at the Glenmore Landfill are expected to increase operational expenses at the Westside Residential Waste Disposal and Recycling Centre by approximately $80,000 in 2018 and an additional $60,000 by 2020. Tipping fee increases on garbage are required at the Westside Residential Waste Disposal and Recycling Centre in order to ensure the additional expenses that will be incurred are passed on directly to the users of the facility. Proposed tipping fee changes will be effective beginning on January 1, 2018. RECOMMENDATION: THAT the Regional District of Central Okanagan Solid Waste Management Regulation Amendment Bylaw No. 1409, 2017 be given first, second, and third readings and adopted. Solid Waste Management Regulation Amendment Bylaw Report Page 2 Implications of Recommendation: Financial: Accountability and transparency Background: The City of Kelowna recently amended their Solid Waste Management Regulation Bylaw which included increasing tipping fees on multiple waste materials and updating definitions to better define certain waste materials. The changes were required to ensure the financial sustainability of the Glenmore Landfill and to maintain and improve waste stream quality on certain recyclable materials such as gypsum drywall, wood waste and yard waste. The Glenmore Landfill is the only disposal option for garbage in the Central Okanagan. The tipping fee increases on garbage at the Glenmore Landfill are expected to increase operational expenses at the Westside Residential Waste Disposal and Recycling Centre by approximately $80,000 in 2018 and an additional $60,000 by 2020. The tipping fee increases on other waste materials implemented by the City of Kelowna are not expected to impact the Reginal District of Central Okanagan. Tipping fee increases on garbage are required at the Westside Residential Waste Disposal and Recycling Centre in order to ensure the additional expenses that will be incurred are passed on directly to the users of the facility. Tipping fee increases on Recyclable Gypsum and tires with rims are also proposed for the Westside Residential Waste Disposal and Recycling Centre in order to compensate for the increased cost to dispose and recycle these materials. In addition, staff also recommends the Regional District of Central Okanagan Solid Waste Management Regulation Bylaw be amended to include the tipping fee changes implemented by the City of Kelowna for the Glenmore Landfill. The City of Kelowna operates the Glenmore Landfill, however it services the entire Region and therefore it is important to harmonize the City of Kelowna s tipping fees and definitions within the Regional District of Central Okanagan Solid Waste Management Regulation Bylaw. Proposed tipping fee changes will be effective beginning on January 1, 2018. All proposed tipping fee increases are summarized in the tables below. 40

REGIONAL DISTRICT OF CENTRAL OKANAGAN BYLAW NO. 1409 A bylaw to amend the Regional District of Central Okanagan Solid Waste Management Regulation Bylaw No. 1253 WHEREAS the Regional Board of the Regional District of Central Okanagan deems it necessary to amend the Regional District of Central Okanagan Solid Waste Management Regulation Bylaw No. 1253, 2010, as amended; NOW THEREFORE the Regional Board of the Regional District of Central Okanagan in an open meeting assembled enacts as follows: 1. Regional District of Central Okanagan Solid Waste Management Regulation Bylaw No. 1253, 2010 is hereby amended by the following: a. Adding new definitions to 1.2 INTERPRETATION as follows: Biosolids means stabilized municipal sewage sludge resulting from a municipal waste water treatment process or septage treatment process which has been sufficiently treated to be deemed non-hazardous and passes the Paint Filter Test (US EPA SW-846 Test Method 9095B: Paint Filter Liquids Test or other methodology approved by the BC Ministry of Environment). International Waste means vegetative, food and other refuse left at the Kelowna International Airport which may or may not contain pests or diseases detrimental to local agriculture. Stumps means the woody part of the root system of a tree or large shrub, cut at the ground level and without attached granular soil material. b. deleting from 1.2 INTERPRETATION, Landfill means the Glenmore Landfill, located at 1595 Glenmore Road North, in the City of Kelowna. and replacing with: Landfill means the Glenmore Landfill, located at 2720 John Hindle Drive, in the City of Kelowna. c. deleting from 1.2 INTERPRETATION, Mandatory Landfill or Recycling Depot Recyclable Material being all Mandatory Residential Recyclable Material, plus leadacid batteries, White Goods, tires, asphalt, concrete, Recyclable Gypsum, and including all products listed in the Provincial Environmental Management Act s Recycling Regulation (Product Stewardship Program). 43
And replacing with: Mandatory Landfill or Recycling Depot Recyclable Material being all Mandatory Residential Recyclable Material, plus lead-acid batteries, White Goods, tires, asphalt, concrete, asphalt shingles, Recyclable Gypsum, and including all products listed in the Provincial Environmental Management Act s Recycling Regulation (Product Stewardship Program). d. deleting from 1.2 INTERPRETATION, Recyclable Gypsum means sourceseparated gypsum board or wall board, including new construction off-cuts or scraps, and old wallboard that has been painted, covered in wall paper, vinyl or ceramic tiles and is removed during renovation, but excluding lathe masonry gypsum wallboard, wallboard associated with asbestos and wallboard contaminated with any other waste. and replacing with: Recyclable Gypsum means source-separated gypsum board or wallboard, including new construction off-cuts or scraps, and old wallboard that has been painted or covered in wallpaper, and is removed during renovation, but excluding lathe masonry gypsum wallboard, wallboard associated with asbestos and wallboard contaminated with any other waste. e. deleting from 1.2 INTERPRETATION, Wood Waste means clean, organic, source-separated material including, but not necessarily limited to: kiln-dried dimensional lumber (such as wood pallets, and demolition wood waste); branches or prunings greater than 20 centimetres (8 inches) in diameter; plywood; particle board; and, pressed board and replacing with: Wood Waste means clean, organic, source-separated material including, but not necessarily limited to: branches greater than 5 centimetres in circumference; kiln-dried dimensional lumber (such as wood pallets, board ends and demolition wood waste); plywood; particle board; and, pressed board 44
f. deleting from 1.2 INTERPRETATION, Yard Waste means green waste including but not necessarily limited to grass and hedge clippings, leaves, grass, flowers, vegetable stalks, woody or herbaceous waste, fruit and vegetable waste, and prunings that can be effectively composted. Includes prunings up to 1 metre in length and 5 centimetres in circumference. and replacing with: Yard Waste means green waste including but not necessarily limited to grass, hedge clippings, leaves, flowers, vegetable stalks, woody or herbaceous waste, and prunings up to 5 centimetres in circumference. 2. Deleting SCHEDULE B in its entirety, and replacing it with a new SCHEDULE B attached hereto, and forming part of this bylaw. 3. This bylaw comes into effect on June 1, 2018. 4. All Garbage, Yard Waste and Wood Waste hauled directly to the Landfill site by customers qualifying or authorized for pick-up through the Regional District's residential collection systems established pursuant to this bylaw shall be subject to the following minimum charges: $ 5.00 per load of Wood Waste or Yard Waste for loads weighing up to and including 250kg, and as per the table below for Garbage or other billable waste streams for loads weighing up to and including 250kg: $11 per load Effective June 1, 2018 $12 per load Effective January 1, 2019 4. Owners of all parcels of land, including Owners of property who have been granted a waiver of service, pursuant to Section 2.1.1 of this bylaw, or who have been excluded pursuant to Section 2.1.3 of this bylaw, from the Regional District's residential collection systems, will be levied annually on their property tax notice a fee to cover Solid Waste Reduction Services. New accounts will be billed from the date of request for final inspection on a pro-rated basis.
