Position Description Ensure that the corporate, operational, and strategic objectives of the Cairns Regional Council and the Planning & Environment Department are met through competent and professional fulfilment of assigned duties. KEY DUTIES AND RESPONSIBILITIES: Duties and responsibilities shall include but not be limited to: Investigation, enforcement and prosecution of matters in a timely manner and professional manner as required by Supervisor and/or Coordinator Regulatory Compliance in relation to: Planning Act 2016. Building Act 1975. Environmental Protection Act 1994. Local Government Act 2009. Other legislation as directed by the Manager Regulatory Services. Assessment of development applications against the Environmental Protection Act 1994, Planning Act 2016, Council Planning Scheme and Council policy for Environmentally Relevant Activities. Issue development approvals and environmental authorities for devolved Environmentally Relevant Activities under the Environmental Protection Act 1994. Carry out inspections and assess the compliance with conditions on development permits issued by Cairns Regional Council and take action accordingly. Action complaints related to devolved responsibilities under the Environmental Protection Act 1994, Planning Act 2016 and breaches of the Planning Scheme. Notify administering authority of incidents constituting serious or material environment harm. Advise the public on, and assess submissions in relation to the Environmental Protection Act 1994 and Council Local Laws. Gather evidence for further enforcement action including interviewing alleged offenders, preparing statements, taking and storing photographic evidence as well as collection and storage of physical evidence. Issue formal Notices and Affidavits to obtain Warrants, Summonses and Court Orders in relation to investigation and prosecution of offenders in accordance with Council s powers under relevant legislation. Execute warrants and Court Orders and serve Summonses as required by law. Document evidence and prepare detailed reports, notices, recommendations and correspondence in relation to compliance issues, briefing of Council s solicitors and for prosecution of offenders.
