Undertake duties relating to investigation of environmental and development compliance matters; where the activities are designated as Local Government s responsibilities under the Environmental Protection Act 1994 and Planning Act 2016. Apply sound technical knowledge and experience when undertaking complaint investigations in accordance with legislative requirements relating to complex, sensitive and high profile offences. Provide expert advice to Supervisor, Coordinator and Manager through sound technical knowledge and experience of relevant legislation. Ensure customers receive the highest level of service and professional advice during the compliance investigation process.

Position Description Ensure that the corporate, operational, and strategic objectives of the Cairns Regional Council and the Planning & Environment Department are met through competent and professional fulfilment of assigned duties. KEY DUTIES AND RESPONSIBILITIES: Duties and responsibilities shall include but not be limited to: Investigation, enforcement and prosecution of matters in a timely manner and professional manner as required by Supervisor and/or Coordinator Regulatory Compliance in relation to: Planning Act 2016. Building Act 1975. Environmental Protection Act 1994. Local Government Act 2009. Other legislation as directed by the Manager Regulatory Services. Assessment of development applications against the Environmental Protection Act 1994, Planning Act 2016, Council Planning Scheme and Council policy for Environmentally Relevant Activities. Issue development approvals and environmental authorities for devolved Environmentally Relevant Activities under the Environmental Protection Act 1994. Carry out inspections and assess the compliance with conditions on development permits issued by Cairns Regional Council and take action accordingly. Action complaints related to devolved responsibilities under the Environmental Protection Act 1994, Planning Act 2016 and breaches of the Planning Scheme. Notify administering authority of incidents constituting serious or material environment harm. Advise the public on, and assess submissions in relation to the Environmental Protection Act 1994 and Council Local Laws. Gather evidence for further enforcement action including interviewing alleged offenders, preparing statements, taking and storing photographic evidence as well as collection and storage of physical evidence. Issue formal Notices and Affidavits to obtain Warrants, Summonses and Court Orders in relation to investigation and prosecution of offenders in accordance with Council s powers under relevant legislation. Execute warrants and Court Orders and serve Summonses as required by law. Document evidence and prepare detailed reports, notices, recommendations and correspondence in relation to compliance issues, briefing of Council s solicitors and for prosecution of offenders. When required, prepare matters for and attend Court and/or relevant tribunal hearings. Maintain accurate and thorough records of all work carried out.

Position Description Establish, implement and review compliance procedures and policies relevant to a multidisciplinary team and report issues to Supervisor Regulatory Compliance when necessary. Comply with all relevant Council procedures and policies. Assist with the preparation and delivery of community education and promotional matters associated with Regulatory Compliance with the objective of fostering community awareness. Carry out compliance and enforcement inspections in relation to relevant legislation ensuring that legislative requirements and Council s processes are observed. Provide expert advice to internal and external stakeholders on technical matters within regulatory compliance jurisdiction to ensure an efficient response to compliance issues and investigations and implement remedial action on identified breaches. Provide and maintain a high level of professionalism and customer service when interacting with internal and external customers. Ensure all corporate information is captured within Council s business systems adhering to recordkeeping policies and procedures. Undertake training as required to ensure skills development related to the duties of the position. SELECTION CRITERIA: Essential: Qualifications Bachelor of Environmental Science or another degree in an environmentally related profession accepted by the Chief Executive Officer. Class C class driver s licence. Knowledge, Skills & Expertise Demonstrated knowledge and understanding of the Building Act 1975, Building Code of Australia, Local Government Act 2009, the Environmental Protection Act 1994, Planning Act 2016, Councils Planning Scheme and the relationship between each law and their application in the enforcement process. Demonstrated ability and experience in interpreting complex legislation and in undertaking inspections, investigations and investigative report writing in relation to complex/high risk offences within a multi-disciplinary team. Demonstrated ability of a high level of organisational skills with an ability to work at a high level of independence with minimum supervision. Demonstrated experience in compliance, inspections and complaints investigations.

Position Description Experience in use of computer records, including property and geographic information systems and the ability to interpret and apply information from those systems to the investigative process. Possess sound skills in the operation of Microsoft applications such as Outlook, Excel and Word, as well as Council systems, such as Authority, DM10 and Exponare. Demonstrated experience in the preparation and delivery of educational and promotional information.
