1 August 19, 2010 Page 14 CITY OF COLORADO SPRINGS PLANNING COMMISSION RECORD-OF-DECISION NEW BUSINESS CALENDAR MEETING: AUGUST 19, 2010 ITEM: 4 STAFF: SHARON ROBINSON FILE NO: CPC CU PROJECT: 98 SQUARE-FOOT BILLBOARD AT 25 NORTH SPRUCE STREET STAFF PRESENTATION Ms. Sharon Robinson, City Sign Specialist, presented PowerPoint slides (Exhibit A). Commissioner Butlak inquired if the current billboard is illuminated and if the proposed billboard will be illuminated also? Ms. Robinson replied the existing freestanding sign advertised businesses located on that lot and was illuminated. Ms. Robinson assumed the proposed billboard will also be lighted. Ms. Robinson added that the surrounding vegetation buffers the proposed sign from the three residences that are located within a 500-foot radius. The billboard should not be visible from the residential properties.. Commissioner Cleveland inquired how long the current sign has been out of operation? Ms. Robinson replied there has been no signage on that sign for at least five or six years. APPLICANT PRESENTATION Mr. Brian O Leary, Lamar Advertising, stated the area is zoned C-6 as of September Colorado Department of Transportation (CDOT) has granted Lamar a highway, off-premise advertising permit. Commissioner Hartsell inquired of the proposed sign s height compared with the existing sign? Mr. O Leary replied the C-6 zone height limit is 50 feet and that is their requested height. Mr. O Leary estimated the current sign at a height of 50 feet. Mr. O Leary addressed Commissioner Butlak s concern of lighting, and stated that all signs are illuminated from the bottom of the sign and shine upward. Their company s billboard signs are all illuminated and the lights are on a timer to turn off at 11pm. Mr. Ron Walden, property owner, provided history of the site originally developed by the Craddocks.

2 August 19, 2010 Page 15 CITY OF COLORADO SPRINGS PLANNING COMMISSION RECORD-OF-DECISION CITIZENS IN FAVOR None CITIZENS IN OPPOSITION Mr. Larry Barrett, Scenic Colorado representative, has adopted a highway for trash cleanup from Red Rock Canyon Open Space to Manitou Springs. He stated that US Highway 24 is a restricted scenic corridor as is I-25 and requested the sign size reduced. APPLICANT REBUTTAL Mr. Hal Ward, General Manager of Lamar Advertising, stated the request complies with all requirements for a billboard sign. The south facing part of the sign would be appropriate for a fast food restaurant, and the north facing side would be appropriate for restaurant or another establishment along Highway 24. The sign will be illuminated from below shining upward. STAFF REQUESTED TO SPEAK Commissioner Butlak inquired of the restricted corridor and what special considerations exist. Ms. Robinson stated in the late 1980s City Council deemed specific corridors as significant corridors for tourism. The restriction is that no new billboards can be erected in that corridor unless the applicant is using a billboard credit for a billboard that was removed from that same corridor. Lamar is using a credit from a billboard that was previously removed from I-25 along the Motor City area. DECISION OF THE PLANNING COMMISSION Moved by Commissioner Gonzalez, seconded by Commissioner Hartsell, to approve Item 4, CPC CU , a conditional use for a 50-foot high, 98 square-foot billboard based upon the finding that it meets all review criteria as set forth in Sections and (I) of the City Code, and is subject to the following conditions: Conditions of Approval: 1. Lamar Outdoor Advertising will need to apply for a sign permit from the City. 2. Lamar Outdoor Advertising will need to attach a current CDOT Roadside Sign Permit to the sign application. 3. The original billboard credits will need to be attached to the sign application. 4. The Record of Decision and stamped plans from the City Planning Commission hearing will need to be attached to the sign application. Motion passed 7-0 (Commissioners Magill and Stroh absent).
