Project Description: A request by Lamar Outdoor Advertising for approval of a conditional use to relocate an existing 400 square foot billboard in a PIP-2 (Planned Industrial Park) zone. The subject property consists of acres and is located approximately 600 feet east of Wooten Road on the south side of Platte Avenue. This is a request to install a 400 square foot billboard, with an overall height of 30 feet, east of the Wooten Road and Platte Avenue intersection at 0 East Platte Avenue. (Refer to Figure 1) The applicant is using billboard credits (from a previously removed billboard just to the west of the proposed location) to permit this billboard. (Refer to Figures 2-4). 2. Applicant s Project Statement (Refer to Figures 5 & 6) 3. Planning and Development Team s Recommendation: Approve the requested conditional use application subject to the conditions outlined under the Staff Recommendation heading.

Comprehensive Plan/Designated 2020 Land Use: Employment Center 5. Annexation December 1, Master Plan/Designated Master Plan Land Use: Town East Master Plan 7. Subdivision Smartt s Add #9 8. Zoning Enforcement Action - None 9. Physical Characteristics This parcel is located on the south side of Platte Avenue and is basically flat. STAKEHOLDER PROCESS: A mailing was done to property owners within the 1,000-foot buffer notification. Staff received no inquiries on the billboard location. Enumerations An address will be assigned per the plan submitted. A $30 fee will be due at time of permitting. Utility Comments Concerns regarding the billboard location relative to electric lines were addressed. The site is approximately 60 feet from any electric utilities, which is adequate. All Other Reporting Departments - Standard or no comment. ANALYSIS OF MAJOR ISSUES: There are two primary planning issues regarding this request: 1. Conformance with the billboard standards listed in Chapter 7, Article 4, Part 406.I of the Zoning Code. 2. Conformance with Conditional Use criteria. CONDITIONAL USE REVIEW CRITERIA In order for a conditional use to be approved, all of the following three criteria must be met: A. The value and qualities of the surrounding neighborhood should not be substantially injured. In February 1991, the current billboard ordinance was passed which set stringent standards for the location of billboards. This ordinance was reviewed and revised with the input of neighborhood associations, the billboard industry and staff. The billboard criteria listed in the Zoning Ordinance today is the result of negotiations between all parties before it was approved by City Council. The proposed billboard is oriented to the east/west traffic along Platte Avenue. There are not any residential zoned properties within 500 feet. The billboard is located on the northwest corner of the property and has commercial properties surrounding it. This criterion is met. B. The conditional use should be consistent with the intent and purpose of the Zoning Ordinance. The purpose of the billboard ordinance is to limit the impact of billboards on the community; to improve the appearance of specific corridors; to ensure compatibility between billboards and adjacent land uses and limit the impact billboards have on sign clutter in the community. Although billboards are a necessary form of advertising, it is also understood that they are not appropriate in all zones. The Zoning Code allows billboards as a conditional use in the PIP-2 zone. The Zoning Code addresses a variety of standards billboards must adhere to, one of which details the location standards. The first location standard is the 1,000-foot spacing between billboards; the second is a limitation in the number of billboards allowed at intersections; and finally the third standard addresses the 500-foot spacing requirement from residential zones.
3 Page 15 This billboard meets all the above criteria. Lamar Outdoor Advertising will be using three credits issued from a billboard that was previously removed just to the west of the proposed location. The proposed billboard meets all the pertinent standards. This criterion is met. C. The conditional use must be consistent with the Comprehensive Plan. The Comprehensive Plan encourages the reduction of clutter in commercial zones and along major transportation corridors. The current billboard ordinance addresses specific concerns regarding the impact of billboards on our community. The standards listed under the billboard section of the Zoning Code were developed to help reduce the proliferation of billboards as well as ensure their compatibility with adjacent land uses. This criterion is met. STAFF RECOMMENDATION ITEM NO. B CPC CU CONDITIONAL USE Approve the conditional use request to relocate an existing 400 square-foot billboard in a PIP-2 zone based upon the finding that the conditional use complies with the review criteria set forth in Sections and (I) of the Zoning Code, subject to the following conditions: Conditions of Approval: 1. Lamar Outdoor Advertising will need to apply for a sign permit from the City for the billboard. 2. The original billboard credits should be attached to the sign application. 3. The Record of Decision and stamped plans from the City Planning Commission hearing should be attached to the sign application. 4. Illegal trailer being used as a billboard must be removed from the property prior to City billboard permit being issued (Refer to Figure 7).
