1 Food Marketing Institute -- Genetically Modified Organisms (GMO/GE) -- February 4, 2013 State Bill# Sponsor Issues Summary Status ARIZONA 2013 S.B Senator Ed Ableser Requires food that is entirely or partially produced with genetic engineering to be clearly labeled "genetically engineered" on the front of the package. Specifies that in the case of a commodity that is not separately packaged or labeled, those words must appear on the label appearing on the retail store shelf or bin in which the commodity is displayed for sale. Specifies that in the case of processed food, that fact must be disclosed in clear and conspicuous language on the front or back of the package of that food with the words "partially produced with genetic engineering" or "may be partially produced with genetic engineering". g/1r/bills/sb1180p.htm&session_id=110 COLORADO 2013 H.B Representative Jeanne Labuda Requires a person selling, distributing, or offering for sale food in the State that is aware the food contains genetically engineered material or was produced with genetically engineered material to label the food as follows: "This product contains genetically engineered material or was produced with genetically engineered material". Defines "genetically engineered". Exempts foods from the labeling requirement if the food contains less than 1% genetically engineered material; chewing gum; alcoholic beverages; food that a physician prescribes as medically necessary or supervises the consumption or enteric administration of; food that is certified to be labeled, marketed, and offered as "organic" under the federal "organic food production act of 1990"; food that is served, sold, or otherwise provided in a restaurant or other facility that is primarily engaged in the sale or provision of food prepared and intended for immediate human consumption; processed food that is intended for immediate consumption and not packaged for retail sale; or a food product produced pursuant to the "Colorado Cottage Foods Act". /047D81A95D6D2BFF87257AEE ?Open&file=1192_0 1.pdf

Lowen Prohibits genetically engineered food products from being sold or distributed in the State, beginning July 1, HAWAII 2013 H.B. 627 Representative Clift Tsuji Allows food offered for retail sale to have displayed on the food a label stating "not genetically engineered" or "does not include a genetically engineered ingredient" if the statement is true. HAWAII 2013 H.B. 631 Representative Clift Tsuji Authorizes display on qualified food offered for retail sale a label stating "not genetically engineered" or "does not include a genetically engineered ingredient" if the statement is true. Makes an untrue statement a violation. Allows any person or public agency to seek an injunction to prevent or terminate a violation.

6 TENNESSEE 2013 S.B. 894 Senator Frank Niceley (R) Establishes the Genetically Engineered Food Labeling Act of Requires the following foods sold or distributed in the State to bear a label that reads "genetically engineered:" (1) Food derived in whole or in part from genetically engineered microorganisms, plants, or livestock, if such genetically engineered material accounts for more than 10% of the weight of any portion of that food; (2) Food prepared or processed using genetically engineered enzymes or other genetically engineered processing agents; (3) Food derived from agricultural products cultivated using genetically engineered agricultural agents; (4) Dairy and meat products derived from livestock that have been fed genetically engineered feed or food additives or ingredients or derived from livestock that have been treated with genetically engineered hormones or drugs; (5) Genetically engineered food that is significantly altered in composition or nutritional value; (6) Genetically engineered food resulting from trans-species gene transfers; Genetically engineered food resulting from transfer of animal genes into plants that shall be labeled to indicate such fact in a manner that will allow vegetarians and those with dietary restrictions to observe their dietary guidelines. States the sale, delivery for sale, holding for sale, or offering for sale of any genetically engineered food whose label is misleading is in violation of the Genetically Engineered Food Labeling Act of
7 VERMONT 2013 H.B. 112 Representative Kathryn Webb Requires food to be labeled as produced entirely or in part from genetic engineering if it is a product offered for sale in Vermont and is entirely produced or partially produced with genetic engineering. Requires raw agricultural food to have packaging or a holding container with the labeling "produced from genetic engineering" on the front of the package or container. Requires processed foods to print "partially produced with genetic engineering" in clear and conspicuous language on the packaging. Prohibits genetically engineered food from inclusion in advertising signage including the words "natural," "naturally made," " naturally grown," "all natural" or any similar word. Exempts food consisting entirely of or derived from an animal which has not itself been produced with genetic engineering. Excludes raw agricultural food that has been grown, raised, or produced without the knowing and intentional use of food or seed produced with genetic engineering. Exempts food that an independent organization has determined has not been knowingly and intentionally produced from or commingled with food or seed produced with genetic engineering, provided that the determination has been made pursuant to a sampling and testing procedure to be approved by the Department of Agriculture. Excludes food that has been certified for sale as "organic" according to the federal Organic Food Products Act of Exempts food that is not packaged for retail sale and is either prepared for immediate human consumption or is served and sold in a restaurant. Exempts Medical food. WASHINGTON 2013 H.B Representative Cary Condotta (R) Allows local governments, through their legislative authority, to regulate genetically modified organisms. Specifies it is within the jurisdiction of the local legislative authority to determine the parameters of regulation, which may include the production, use, advertising, sale, distribution, storage, transportation, formulation, packaging, labeling, certification, registration, propagation, cultivation, raising, or growing of genetically modified organisms.
8 WASHINGTON 2013 S.B Senator Maralyn Chase States that beginning July 1, 2015, any food offered for retail sale in the State is misbranded if it is, or may have been, entirely or partly produced with genetic engineering and that fact is not disclosed. Provides for exceptions. WASHINGTON 2013 S.B Senator Maralyn Chase Allows local governments, through their legislative authority, to regulate genetically modified organisms. Specifies it is within the jurisdiction of the local legislative authority to determine the parameters of regulation, which may include the production, use, advertising, sale, distribution, storage, transportation, formulation, packaging, labeling, certification, registration, propagation, cultivation, raising, or growing of genetically modified organisms consistent with the provisions of this section.
