4 History of the Small Business Programs Small Business Mobilization Act of 1942: Congress recognized small business did not have economies of scale necessary to compete with large companies for war efforts Defense Production Act of 1950: Provided emphasis on small business awards during peacetime Small Business Act of 1953: Congress created the Small Business Administration (SBA) to stimulate growth of small business firms Armed Services Procurement Act of 1947: established a fair proportion of total Federal purchases and contracts be placed with small business 82 nd Congress in 1951: 100 large corporations received 67% of Federal prime contracts in the early years of WWII, while 1/6 th of Nation s small businesses closed their doors

10 Why is Subcontracting Important? Small Business Act (PL ), as amended, requires that small businesses are afforded maximum practicable opportunities for contracts and subcontracts and requires large Primes to submit a subcontracting plan Strengthens the industrial base Helps create competition Allows for innovation and specialization Flexibility of requirements, promotes efficiencies FAR (a) General Policy It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns. Such concerns must also have the maximum practicable opportunity to participate as subcontractors in the contracts awarded by any executive agency, consistent with efficient contract performance 10

12 Small Business Utilization Policy Highlights DoDI Jan 17, 2017 Statutory: Program managers will establish goals for applying SBIR and STTR technologies in programs of record and incentivize primes to meet those goals FAR Permits the contracting officer to encourage increased subcontracting opportunities in negotiated acquisitions by providing monetary incentives DoD Class Deviation 2018-O0007 Small Business subcontract reporting requires Primes to notify ACO if a SB proposed in subcontracting plan is substituted for a firm that is not small DoD Class Deviation 2018-O0010 Extension of Comprehensive Subcontracting Plan Test Program through Dec. 31, 2027 FAR (d)(14) and (15) Primes may not restrict subcontractors from discussing payment issues with the Contracting Officer and must pay its small business subcontractors on time 12
13 Mentor-Protégé Program DOD Pilot Mentor-Protégé Program Established in November 1990 under Section 831 of PL Implemented in the National Defense Authorization Act for FY 1991 Administered IAW DFARS & Appendix I Purpose Provide incentives for DoD contractors to assist small businesses in: Enhancing business development and technology capabilities Increasing subcontracting participation in government and commercial contracts Positioning small businesses for prime contracting opportunities Increasing protégé firm s technical and business infrastructure capabilities Increasing the Small Business Industrial Base (Reduced risk/cycle time and increased reliability) Increasing competitive markets (Reduced cost) Increasing utilization of Nontraditional & commercial companies Command Benefits $3M in DoD funding per agreement.
