This addendum is issued pursuant to the conditions of the RFP documents and is hereby made part of the RFP. The addendum serves to clarify, revise, and supersede information in the Request for Proposals. The Offeror must acknowledge receipt of this addendum in the appropriate space provided in the Addendum Form. Failure to do so may subject the offeror to disqualification. 1. Attachment I - RFP Bid Form shall be deleted in its entirety and replaced with the attached Attachment I - Revised RFP Bid Form. 2. Attachment J- Water Tank Specifications shall be deleted in its entirety and replaced with Attachment J- Revised Water Tank Specifications. 3. Attachment K Drawing Sheets C6, C26, C27, C30, C33 and C34 shall be deleted in its entirety and replaced with attached Drawing Sheets C6R, C26R, C27R, C30R, C33R and C34R. Drawing Sheet C42 is hereby added as an additional sheet to Attachment K. 4. The term for this contract shall be 240 calendar days. 5. Photos and video are available for viewing on the ASPA Website: 6. Please find below Questions and Responses: Q-1. Sheet C-7 indicates an inspection report section welded steel tank repair inspection. Can you provide this? Response: This is all included in Section 00280, Part 4- Tank Inspection Report, starting at page 130. Q-2. Can you provide the painting spec section as well? Response: This is all included in Section 00280, part Protective Coatings, pages 134 to 143. Q-3. In our experience the warranty given by tank manufacturers are between 5-10 years based on adherence to an inspection schedule. Is there any flexibility in the required 30 year warranty? Response: The 10 year warranty period is acceptable to ASPA. Q-4. Project: Tramway Upper 200,000 gallon Tank I have noted that a 30-year warranty has been requested for each of the 4 tank options the specifications support. Unfortunately, there are no competent tank manufacturer willing or Addendum # 3 Page I of5

2 even capable of providing a 30-year warranty. Most offer 5 years on coatings, while the CST Aquastore glass-fused company will offer a 10-year warranty but only if the owner performs and records the required maintenance and inspections. Welded tank manufacturers provide what we in the industry call "tail lamp warranty". That is; your tank is warranted until you see the taillights of construction trucks fade in the distance. My request is to modify the warranty requirements to something which can realistically be provided. For the welded option, it should be the same as being required for Tramway lower tank. Response: I 0 year warranty will replace the 30 year warranty requirement. See Revised Water Tank Specifications attached. Q-5. Project: Tramway Lower Tank Repair Some of the Scope of Work is unclear to bid on. The Iron Ridge Civil Solutions report and tank ratings is qualitative, but not quantitative. The recommendations (and Section 4.10 of the Specification) do not state specifically what is required. For instance: Replace corroded bolts- what bolts, which bolts? where? Install additional vents- how many? what size? what type? Response: All appurtenances and piping will be built as new. Contractor is responsible in designing and specifying what material type and vent size is required for ASPA 's approval. Q-6. Clearly, this tank will be least expensive (as will the chime option in Tramway Upper, above). But the specification also calls for a 30-year warranty. This type of tank typically comes with a 1-year factory warranty. Maybe it could be extended to 3 or 5 years with a particularly good coating system. But 30-year will be out of the question (see my discussion above). Response: I 0 year warranty will replace the 30 year warranty requirement. See Revised Water Tank Specifications attached. Q-7. As per RFP Form it indicates that install only, just like Install PVC-0 A WW A C etc. Will ASPA provide all PVC and DI pipes/fittings for this RFP? If ever ASPA will supply materials, can you specify them? Response: ASP A will provide all pipeline materials for this project as noted in the Revised RFP Bid Form. Q-8. What are the requirements for submittal on this RFP? Response: Please refer to RFP Package. Q-9. Are Performance and Payment bonds mandatory for this project? Response: Please refer to RFP Package Attachment H. Q-1 0. How are the federal funds allocated for each project that is included under the "Tramway Tank Rehab Project"? For example, funds for building a new 200,000 gal welded tank, repairs on the 1 Mil Gal Tramway Tank, construction of the Gabion Retaining Wall and so forth. Response: This project is one complete project and funds are allocated to this project as a whole, and is not broken down into separate scopes. Addendum #3 Page 2 of5

3 Q-11. Can a company submit their bid only on the work they are qualified to perform, such as the repairs on the 1Mil Gal Tramway Tank? Response: No, the general contractor has to provide a proposal for doing everything outlined in the scope of work provided in the RF P package. If your company can only do one thing, please submit your proposal to any and all General Contractors who are providing proposals for this project. Q-12. Being that the Tramway Tank has not been fully inspected by the qualified contractor itself, what is ASP A's approval procedures for change orders if required? Response: ASPA will address this based on what is discovered after the project is awarded and under construction. Q-13. Who are the Source Evaluation Board (SEB) members and how are they selected to prevent any bias in recommendations and only seek the most qualified contractor to perform the work? Response: These are members recommended by the Procurement Manager and approved by ASPA 's Executive Director. Q-14. Is a contractor considered disqualified if they had any serious OSHA violations? How is this counted on ASP A's point system Page 11 of30 Evaluation Criteria? Response: This will be left up to the SEB members to decide. Q-15. Is the original CBI construction drawing for the lmil gallon Tramway Tank available? Response: ASPA has been looking for these drawings but is unable to secure the original drawings for this tank. Q-16. Requesting qualifications/background on water tanks for the Construction Manager, John Goeke. Response: John Goeke has been doing this type of work for over 20 years, he was the CM for the tank farm oil tanks. You are welcome to contact him directly for more information on his qualifications. Q-17. Although the scope of work calls for development of new 200,000 gallon tank before beginning work on the lmil gallon tank, is this a firm decision or would it still be possible for containment set up and other initial work repairs to be conducted while waiting to begin any sandblasting and painting? Response: Other work can be done outside the 1M gallon water tank as long as water service is not disrupted. Q-18. Is there any possibility for ASPA to reconsider bidding this 1Mil Gallon Tramway Tank Rehab Services as a separate component? Response: EPA has already approved this project be bid out as one complete project. It will not be possible to bid this portion out separately. Q-19. In specification section for a Welded Steel Tank the scope of work consists of the rehabilitation of an existing 1 million gallon welded tank. The report shown in this spec section shows that there is 100% damage on every section of the tank. The requested action to rehabilitate this tank is by sandblasting and recoating the tank. 4 could further reduce the thickness of the steel and create a weaker environment for a tank that is already 51 years old. A. Is the chemical makeup of the present coatings system known? Chemicals such as Lead, Chromium, and Cadmium present? Response: The existing 1M gallon water tank paint tested positive for lead. The contractor is responsible for the proper removal and disposal of the lead paint per EPA requirements. B. Would the engineer accept an alternative replacing the existing 1M gal welded tank with an epoxy coated bolted steel tank? We estimate the cost of an erection for a new bolted steel tank would be comparable to the effort to repair the existing tank and providing the community with a new potable water tank with a longer usable life going forward. Response: No, the scope of work is for the proper rehabilitation of the existing 1 MG tank. Q-20. I would like to verify for the pipes and fitting outside the booster pump, will ASPA supply this materials? Response: ASPA will supply the piping materials for the booster pump and contractor is to furnish and install the booster station building with other appurtenances as listed in the Revised RFP Form. Q-21. For the proposed shotcrete wall, where is it located on the Proposal Breakdown? Response: This work is an optional item that are shown on the drawing due to landowner request. This will be dealt accordingly at the later part of the project when fund is available to cover this for this work. Q-22. Do we have an option to look for other manufacturer that is not included on your recommended manufacturer? Response: Yes, and you will need to submit their qualifications as part of your proposal. Q-23. Is this project "Buy America Act"? Response: Yes it is. Q-24. For the chain link fence, can we substitute Polyolefin (polyethylene copolymer) instead of PVC coating only on the framework? Response: PVC coated fencing material is specified and approved. Substitute can be submitted during submittal review process. Q-25. Please clarify the submission protocol. Technical proposal in separate envelope, Cost Proposal in separate envelope, pdf complete, i.e. technical and cost proposals? Response: All of the above in a larger envelope. Q-26. of? Is the 20% retainage in addition to the performance and payment bonds or in lieu Response: Please refer to Attachment H. Q-27. The background states that the roof trusses and plates of the existing 1 MG Tramway WST are heavily corroded and in need of replacement. However this is not Page 4 of5

5 stated in the scope of work section. Please confirm if the roof trusses and plates of the existing 1MG Tramway WST are to be replaced? Response: Yes, they need to be replaced unless contractor has a way of properly rehabbing them without replacement. Q-28. Is really required for sandblasting and coating to QP 1 and QP2 certified? Response: Yes, this is required. Q-29. On the sandblasting works: Surface preparation is SP 10 did you consider the stability of shell tank, as per your tank is only 75%? Response: Yes, please follow requirement as listed in Scope of Work. Q-30. What is the rate of water for the testing of 2 tanks? Do you have an option that you will provide water? Response: Contractor will purchase water from ASPA for testing the tanks. Q-31. Can you verify this specification from our supplier: Wind: 170 mph, Roof live load: 25 psf, Freeboard: 18", CA: 1116" on tank floor and shell only. Response: Wind velocity of 170mph and roof LL of 24psf are minimum required and must be used for tank design.
