1 MOT Page 1 of 11 ITEM MOT VILLAGE OF DOWNERS GROVE Report for the Village Council Meeting 3/3/2015 SUBJECT: 942 Maple Structure Relocation SUBMITTED BY: David Fieldman Village Manager SYNOPSIS Discussion of an agreement between the Village, John Tillotson and FFM-DG Development, LLC regarding the relocation of the structure at 942 Maple Avenue to 743 Maple Avenue. STRATEGIC PLAN ALIGNMENT The goals for include Exceptional Municipal Services. FISCAL IMPACT The Village would forgo building permit fee revenue in the amount of $123,560 for the multi-family residential building to be constructed at Maple and the amount of building permit fees for the improvements of the relocated house and property at 743 Maple. RECOMMENDATION Action at the discretion of the Village Council. BACKGROUND On December 16, 2014, the Village Council approved a Special Use for a multiple family residential development at 936 and 942 Maple. Construction of the development requires the demolition or relocation of the existing structures located on the properties. John Tillotson, owner of the property at 743 Maple Avenue, is interested in moving the existing structure at 942 Maple to the property at 743 Maple, and making improvements to the structure so that it could be occupied as a single family house and would qualify for historic landmark designation by the Village. The relocation would require cooperation and participation by the Village and the developer of the multiple family residential development. The structure relocation route has been revised since the original request presented on January 20, The revised route calls for the structure to travel on portions of the Maple Avenue parkway. The original route called for the structure to travel only on the Maple Avenue pavement. The parkway would be protected with steel plating that would allow the wheeled dollies carrying the structure to travel over the curbs on Maple Avenue and onto the sidewalks. The relocation of the structure will require tree removals and pruning as shown in the attached plan. The plan consists of:

2 MOT Page 2 of 11 Removal of 7 parkway trees (4 non-ash trees, 3 ash trees planned to be removed by the Village) Temporary removal and replanting of 5 parkway trees Pruning of 1 parkway tree Pruning of 2 private trees Removal of 1 private tree located at 743 Maple During the relocation, the structure will temporarily overhang onto the front yards of six properties. The wheeled dollies will remain on public property at all times. According to the project budget submitted by the petitioner (attached), the relocation of the structure will cost approximately $134,000. Improvements to the structure once it is relocated will cost approximately $388,000 to $534,000. The total estimated project expenses are indicated in the attached project budget. A three-party agreement would be required to specify the terms and conditions under which the Village, Tillotson and developer would work together to facilitate and pay for the relocation. While a draft agreement has not been prepared, the following key terms listed would be included in an agreement. Tillotson Obligations Submit a final budget outlining all expenses and revenues related to the relocation of the structure Relocate the structure Obtain any and all governmental permits required for the relocation Execute contracts with the house relocation company and public utilities required for the relocation Remove and trim trees (both public and private) necessary for the relocation as determined by the Village Forester and as shown on the structure relocation route and tree impact plan attached to the agreement as an exhibit Contract with utility companies to temporarily relocate utilities Adhere to the structure relocation route and tree impact plan attached to the agreement as an exhibit Prepare the property at 743 Maple for the placement of the relocated structure Design and construct a foundation for the structure Obtain the required permits for the construction of the foundation Make improvements to the structure so that it can be occupied as a single family house, pursuant to building plans approved by the Village. Prepare the structure for the relocation including the interior demolition of the basement of the structure Obtain written agreements with the owners of private property trees that must be pruned for the structure relocation Obtain written agreements for the temporary encroachment of the structure with the owners of the affected properties Indemnify the Village and Developer Pay the Village $5,600 for the removal and pruning of parkway trees, pursuant to Village Code Upon completion of the structure relocation and improvements, seek historic landmark designation of the structure pursuant to Chapter 12 of the Municipal Code Comply with any and all applicable prevailing wage requirements and agrees to fully indemnify, defend and hold harmless the Village with regard to any actions or proceedings instituted regarding such compliance. Adhere to the project schedule

3 MOT Page 3 of 11 Post a cash bond or other security instrument in a form and amount acceptable to the Village to guarantee the preservation of sidewalks, other public improvements and the parkway trees to be preserved, transplanted or pruned as shown on the structure relocation route and tree impact plan attached to the agreement as an exhibit Developer Obligations Donate the structure to the Tillotsons Pay to the Tillotsons an amount equal to the estimated cost of demolishing the structure as determined by Developer Upon the issuance of a building permit for the multi-family residential building, place $123,560 in an escrow account. The escrow agreement will be attached as an exhibit to the agreement. Agree to pay all building permit fees in excess of $123,560 to the Village Apply for a building permit for the multiple family residential building Prior to the relocation of the structure, remove the existing oak tree at 942 Maple and the existing parkway tree located in front of 942 Maple Adhere to the project schedule Village Obligations Provide technical assistance to the Tillotsons and Developer in the relocation of the structure Waive $123,560 of the building permit fees for the multiple family residential building development at Maple Facilitate the disbursement of the funds held in escrow to Tillotson upon completion of the relocation and improvement of the structure pursuant to the terms of the escrow agreement Expedite the review and approval of the building permit application for foundation and improvements to the structure at 743 Maple Avenue Issue building permits for 743 Maple Avenue in phases to facilitate the relocation and improvements to the structure Expedite the review and approval of the building permit application for the multiple family residential building at 942 Maple Avenue Waive the building permit fees for the improvements at 743 Maple Avenue Identify the public trees that have to be removed, relocated or trimmed to facilitate the relocation of the structure Waive the application fees for the historic landmark designation Duly consider Tillotson s application for historic landmark designation Adhere to the project schedule ATTACHMENT Structure Relocation Route and Tree Impact Map Tree Impact Summary Project Budget
