By-Law 1.3 states: REQUIREMENT PURPOSE 2. To preserve the Classic Architectural style established by the developer in the construction of the homes in the community. 3. To provide maximum, quiet enjoyment in the use of personal and real property for each resident. 4. To allow for individual creativity within standard guidelines to provide for a continuity of design. 5. To recognize and allow for individual preferences and tastes in the private areas. ARCHITECTURAL STANDARDS 6. Architectural Standards means the architectural standards prescribed in the building application plans for improvements erected on the Community Parcel approved by the Council and the architectural standards prescribed by the Community Association from time to time in respect of the Community Parcel. The architectural standards include but are not limited by the completed design, colour and materials of the buildings and external structures such as fences and pergolas within Lagoons Estate as approved by the Port Stephens Council and offered for sale by the original developer. 8. Where proprietors and occupiers wish to modify or depart from these Architectural Standards they must obtain written approval from the EC prior to undertaking any changes. INTRODUCTION 9. These architectural standards and guidelines are supplemental to the Community Management Statement (CMS) and should be read in conjunction with the By-Laws. 10. The Executive Committee (EC) does not seek to restrict individual creativity or personal preferences, but rather to assure continuity in design that will preserve and improve the appearance of the Community and the property values therein. 11. The EC reviews all plans for exterior improvements and additions to residential lots and dwellings in Lagoons Estate. These improvements include without limitation, additions, modifications and alterations to residential dwellings such as fences, walls, patio covers, gazebos and spas. Changes to all painted brick walls, roof tiles, window treatment, external porches, courtyards, fences, balustrades, handrails and balconies must be in accordance with the Architectural Standards. GENERAL CONDITIONS 12. Any condition or material not defined within these guidelines shall become a matter for the consideration and determination of the EC. 13. Architectural approval by the EC does not constitute waiver of any requirements by applicable governmental agencies. 14. EC approval of plans does not constitute acceptance of any technical or engineering specifications, or requirements of the Port Stephens Council, and Lagoons Estate assumes no responsibility for such. The function of the EC is to review submittals for conformity to the Master Plan for the community. All technical and engineering matters as well as applicable permits are the responsibility of the proprietors. APPROVALS OR VARIANCES GRANTED BY PORT STEPHENS COUNCIL DO NOT SUPERSEDE THE CMS, BY-LAWS OR THESE STANDARDS AND GUIDELINES. 15. Approval of plans is not authorization to proceed with improvements on any property other than the applicant's. V1.00 4

5 16. An oversight by the Committee regarding the CMS, By-Laws or these Standards & Guidelines does not constitute a waiver; therefore, any violation must be corrected upon notice. 17. Access for equipment used in construction must be through your property. Building equipment and materials must be contained on the applicant's property. Streets may not be obstructed with equipment or building materials that are hazardous to pedestrians, vehicles, etc. 18. When construction requires use of an adjoining property, the applicant must obtain written permission from the adjoining property proprietors and submit it with the plan submittal. If through Common Property written permission must be sought from the EC. 19. All work must be performed in a manner consistent with the standards of the general dwelling construction and appearance of the community. All work considered of an unsightly standard of finished or of lesser quality than the prevailing community standards shall be reworked to an acceptable appearance at the proprietor s expense. 20, Submittal of colour samples of any paint or stain is required when they deviate from the original colour of the existing dwelling. 21. Pergolas, porches, verandas or balconies will not be permitted to be enclosed under any circumstances. 22. Pergolas, porches, verandas or balconies may not be roofed, without EC permission, unless the roof was part of the original design as sold by the developer. 23. Written agreement from impacted neighbours, both facing and adjoining, regarding any improvements that may impact their use and enjoyment of their property should be submitted with applications. Note: "Facing" refers to most directly across the street. "Adjacent" refers to adjoining properties. "Impacted" refers to the immediate surrounding area affected by the construction. Fencing And Gates ARCHITECTURAL AND MATERIAL STANDARD 24. All fencing construction and extensions require prior submittal and approval of the EC. Any walls serving as fencing shall be finished in a similar manner as the dwelling and painted the same colour as the dwelling. Refer to By-Law 18 Internal Fencing for additional information. 25. Previously approved forms of fencing: a. Black chain link fencing (original developer); b. Lilly Pilly hedge (original developer); V1.00 5

6 c. Horizontal slat fencing panels with air gaps between slats in wood, imitation wood or powder coated metal. Coloured black or the same colour as the privacy screens on verandas or balconies. d. Fixed louver panels similar to the privacy screens on verandas or balconies. 26. Unacceptable materials for fencing are: a. Aluminium or sheet metal b. Chicken wire c. Colorbond, plastic or fiberglass panels d. Plastic webbing, reeded or straw like materials e. Glass block and panels f. Woven benderboard g. Picket fencing 27. No double property line fences shall be constructed and fencing shall not be constructed higher than 1.8 metres above grade of the highest adjacent lot, unless approved by the EC. 28. Gates must be constructed of the same material as the fencing. Pools, Spas And Related Equipment 29. Submittal of complete construction plans showing the placement of the pool and equipment on the property is required. Plans should also include details of both visual and aural screening of equipment. Each will be considered on an individual basis. Fixing Of Signs 30. Fixing of signs is not permitted without prior EC approval the exception being Real Estate signs. Refer to By-Law 8 for more information. Aerials And Solar Energy Devices 31. Are not permitted without prior CA approval. Refer to By-Law 9 for more information. External Air Conditioners 32. Are not permitted without prior CA approval. Through window Air conditioners will not be approved. Refer to By-Laws 9.2 and 9.3 for more information. Maintenance Of Building On Lot 33. Proprietors must keep buildings on their lot clean and in good repair and condition. Refer to By-Law 10 for more information. V1.00 6

7 Clothes Lines 34. Clothes lines may only be fitted at the rear of properties. Refer to By-Law 23 - Washing for more information. Privacy Screens, Balustrades and Railings 35. Proprietors shall not attach screening material, clotheslines or other items to Privacy Screens, Balustrades or Railings without prior approval from the EC. OTHER STRUCTURES 36. Garage Conversions. No garage conversions will be permitted as the purpose of garages is to store vehicles. Garages may not be converted into living space or incur any structural changes. 37. Storage Sheds and Utility Buildings. Storage sheds and utility buildings require prior CA approval. They must be placed on the property so as not to be visible from the street, or community property of Lagoons Estate. 38. Animal Shelters and Aviaries. Animal Shelters and Aviaries may only be fitted at the rear of properties and may not be located closer than one meter to any lot boundary. Refer to By-Law 24 Keeping of Animals for more information. ADDITIONAL MODIFICATIONS 39. Window Tinting. Window tinting will not require prior approval of the EC if it consists of either light, medium or dark Smoke Grey. Any other colour of window tinting requires prior approval. Mirror finishes are not allowed. 40. Screen/Security Doors. Screen/Security door installations coloured to match the house door and window frames do not require prior approval. However, overly ornate styles should be avoided and EC approval sought if proprietors wish to install other than a basic style. 41. Exterior Lighting. Exterior lighting to the front of homes must retain the same style as originally installed. Proprietors may install different lighting at the rear or sides of their homes provided it is placed so that it does not create an annoyance to the neighbours, as determined by the EC. 42. House Numbers. House Numbers shall be uniform. House numbers other than the house numbers installed by the original developer, or those approved by the EC will not be permitted. V1.00 7

8 43. Window Awnings. Awnings must be of canvas, shade cloth or other approved fabric and of solid accent colours complimenting the architecture. Awnings must be properly maintained to the satisfaction of the EC and may not be kept when frayed, split, torn or faded. 44. Porch, Veranda or Balcony Awnings. Porch, verandas or balconies may not be roofed, without EC permission, unless the roof was part of the original design as sold by the developer. Porch, veranda or balcony awnings are not to be installed without prior EC approval. Retractable swing arm or roller types are preferred and must be of canvas, shade cloth or other approved fabric and of solid accent colours complimenting the architecture. Awnings must be properly maintained to the satisfaction of the EC and may not be kept when frayed, split, torn or faded. 45. Exterior Painting. Any change in colour from the original primary or trim colours of any dwelling or fencing requires prior submittal and approval. Annex A details the paint colours and finish for all properties on Lagoons Estate. 46. Letterboxes. Replacement letterboxes shall be of the same style and colour as the original. TEMPORARY MODIFICATIONS 47. Exterior Christmas Lights and Decorations. Exterior Christmas Lights and decorations may be fitted no earlier than 01 December each year and must be removed no later than the 07 January of the following year. 48. Exterior Halloween Lights and Decorations. Exterior Halloween Lights and Decorations may be fitted no earlier than seven days before Halloween and must be removed no later than seven days after Halloween. CHANGES AND AMENDMENTS TO THE ARCHITECTURAL STANDARDS 49. By-Law 2 Amending Architectural Standards and Landscape Standards: 2.1 Rights of Community Association to Amend, details how the Community Association may add to or alter the Architectural Standards. 51. All amendments shall become effective upon adoption by the EC. Such amendments shall not be retroactive to previous work or approve work in progress. 52. In no way shall any amendment to the Architectural Standards and Guidelines change, alter or modify any provision of the CMS or By-Laws. V1.00 8

9 APPLICATIONS BY PROPRIETORS REQUESTING APPROVAL FOR ADDITIONS OR ALTERATIONS 53. By-Law 2 Amending Architectural Standards and Landscape Standards: 2.2 thru to 2.9 Rights of Proprietors of Lots to Apply for Amendments, details how individual proprietors may apply for Approval for Additions or Alterations. EXECUTIVE COMMITTEE APPROVALS 54. By-Law 3 Executive Committee, details the process that the EC follows in Approving or Rejecting any Additions or Alterations from proprietors. NON - LIABILITY FOR APPROVAL OF PLANS 55. EC approval of plans shall not constitute a representation, warranty or guarantee that such plans and specifications comply with engineering design practices or with zoning or building ordinances, or other governmental regulations or restrictions. By approving such plans and specifications, neither the EC, the members thereof, the Community Association, any member thereof assumes any liability or responsibility therefore or for any defect in the structure constructed from such plans or specifications. Neither the EC, any member thereof, the Community Association shall be liable to any member, proprietor s occupant, or other person or entity for any damage, loss, or prejudice suffered or claimed on account of: a. the approval or disapproval of any plans, drawings, and specifications, whether or not defective, or b. the construction or performance of any work, whether or not pursuant to the approved plans drawings, and specifications. MODIFICATIONS AND CHANGES MADE PRIOR TO ADOPTION OF THESE ARCHITECTURAL STANDARDS 56. Procedure for proprietors who constructed structures before the adoption of these guidelines: a. If the proprietor did not get a permit from Port Stephens Council, he must begin the process as if no construction had taken place. b. If the proprietor received a permit for the construction from Port Stephens Council, they shall make application to the EC for retroactive approval. The EC shall make every effort to approve of the structure with minimum recommendations, if any, to bring the structure into compliance. V1.00 9

10 c. The standard to be used in attempting to grandfather approval shall be the following: Any structure that corresponds to a like structure erected by the original developer in materials, workmanship, size, and appearance will be allowed. All others shall come before the EC for review and approval. V

11 ANNEX A EXTERNAL PAINT COLOURS FOR LAGOONS ESTATE BUILDINGS 1. These Taubman s paints were applied to the Lagoons Estate homes using the Rockcote Render System. The paint type is Rockcote Contour. 2.
