4 Dear Dunes West Property Owner, All construction, additions, or changes of any kind which take place on any property within Dunes West are subject to Architectural Review Board review prior to starting the work. Over the years, the Dunes West community has grown, but the primary goal of the Architectural Review process has remained the same. To this end, a set of Architectural Review Board Standards was created. These Standards have matured with the community. Enclosed is your copy of the latest revision. The ARB Standards are intended to guide both the owner and the contractor through the often complex Architectural Review process. It was our goal in creating this latest revision to make this document more concise and easier to follow. In an effort to simplify the review process, all forms and agreements have been streamlined. Charts and diagrams have been added, and the entire Home Construction Architectural Review process has been summarized into a flowchart. There are a few important changes to note in this latest revision. Dwellings may not be temporarily or permanently occupied until Certificates of Occupancy have been issued by both the Architectural Review Board and the Town of Mount Pleasant. A tree survey on a plat with home site placement is required at the Plan Review phase, with trees to be saved being marked. A color and material sample board is required with a new home submission. A driveway stakeout inspection is required to confirm compliance with approved plans. The Architectural Review and Oversight fee schedules have been revised. The Construction deposit is a fixed $2,500 for all new construction activity and a Contractor s performance deposit is required in the minimum amount of $10,000 (builder to pay). An additional landscape fee and deposit will be required. All projects approved by the ARB must be inspected and approved upon completion before any deposits can be refunded. It is the responsibility of the property owner to request a final inspection of the project immediately upon its completion. If the request is not made within 18 months of the date of issuance of a Dunes West permit, the deposit will be forfeited. However, the property owner will still be responsible for completing the project to plan. Although every effort has been made to make the Standards as complete as possible, please understand that it can neither provide every answer nor guarantee ideal solutions for every situation. 5 Section I - Dunes West Architectural Control Standards A. DESIGN OBJECTIVES The Dunes West Architectural Review Board (ARB) has been established by Dunes West to achieve the following objectives: Architectural and developmental controls will be administered by the Architectural Review Board. The primary aim of the ARB will be to promote the construction of appealing Architectural designs and not to duplicate the efforts of the Town building inspector. The Dunes West Architectural design concept is that all buildings should complement their natural setting. No particular period styles, foreign or geographic influences, or historical approaches are specifically endorsed or encouraged. The main focus of the architectural concept stresses that the total community be homogenous in feeling and free from discordant or competing architectural shapes and design statements competing for attention. Each building should be treated not as an individual creation or architectural entity but instead as a carefully planned addition to the natural setting that embraces its site. Consequently, architectural solutions will vary from site to site in accordance with these considerations. B. AUTHORITY 1. Every grantee of any interest in the Dunes West Development, by acceptance of a deed or other conveyance of such interest, has agreed to be bound by the Declaration of Covenants, Conditions and Restrictions (DCCR) for Dunes West. Article 5 of the DCCR (pages 21-36) authorizes the establishment of the Architectural Review Board (ARB), and empowers it to enforce the Dunes West Covenants and ARB Standards. 2. No improvements of any nature whatsoever, with only one exception, affecting the exterior appearance of any Dunes West property may be constructed, altered, added to, maintained or removed without the express written permission of the ARB. No work may commence without such permission and the issuance of a Dunes West permit, which must be posted in a visible location to assist the Covenants Committee in noting approved projects. The only exception to the ARB permitting process applies to landscaping projects costing less than $5000 which do NOT include any hardscaping, drainage systems, or grade changes. 3. The ARB has the sole discretion to determine whether plans and specifications submitted for approval are acceptable. 4. A written appeal of ARB decisions can be made. See Section VII.4 of this document for a description of the appeal process. 5. THE VERBAL APPROVAL OF ANY SALES AGENT, JOHN WIELAND HOMES AND NEIGHBORHOODS EMPLOYEE, OR ASSOCIATION REPRESENTATIVE IS INSUFFICIENT UNDER THESE STANDARDS. ALL MODIFICATION APPROVALS MUST BE ISSUED IN WRITING FROM THE ARB. 6. Following approval of any plans and specifications by the Architectural Review Board, representatives of the Architectural Review Board shall have the right, during business hours, to enter and inspect any property or improvements in which construction is underway within the Development to determine whether the plans and specifications thereof have been approved by the ARB and are in compliance with the ARB Standards. In the event that the Architectural Page 5 of 38

6 Review Board determines that such plans and specifications have not been approved or are not in compliance with the ARB Standards, the Architectural Review Board shall halt all work, prohibit further construction, and require the removal or correction of any work in place which does not comply with the approved plans and specifications. (Dunes West Covenants and Restrictions, Section 5.5, pp25-26) Section II New Home Construction Community Standards A. Setback requirements are controlled by the ARB. The ARB requires all homes to have the following minimum setbacks as measured at ground elevation: (setbacks may vary by neighborhood) 1. -Fifteen (15) feet from the side property lines (30 feet for corner lots adjoining two perpendicular roadways) 2. -Forty-five (45) feet from the front property line 3 -Thirty (30) feet from the rear property lines. 4. Setbacks from freshwater wetlands, as determined by the appropriate regulatory agency, are 10 feet for those under 1 acre in size and 50 feet for those larger than 1 acre. On lots adjacent to navigable waters there are OCRM critical line setback and buffer regulations which must be followed. Consult Charleston County and the Town of Mount Pleasant with questions or for information on OCRM regulations. 5. There is a 7.5 foot setback along each side property line for driveways. Fences may be on the property line or set back at least 7.5 feet from the property line. See Section V.E for fence guidelines. Setbacks may vary by neighborhood in accordance with the ARB objectives set forth in Section IA. B. The ARB requires that all water running off the lot be directed to the front and/or rear of the lot, and that no runoff is directed onto adjacent properties. C. The minimum home square footage is 2,000 square feet of heated space. The maximum square footage for any detached structure is 720 square feet. Detached structures, other than detached garages, should be directly behind the home. Only one detached structure per lot is permitted by the Dunes West Covenants. D. The maximum building height is such maximum as determined by the Town of Mt. Pleasant. E. Approved siding materials shall include wood (other than plywood), fiber cement exterior siding, stucco, stone and brick. All other materials may be considered for approval by the ARB on an individual basis. However, the ARB is under no obligation to approve any unlisted materials. F. Masonry walls and foundations must have an approved surface treatment that complements the siding. Masonry walls and foundations may not have exposed concrete blocks. G. No metallic chimney stacks are allowed. Any components of the chimney made from materials other than the siding material are to be painted to match the color of the roof. Page 6 of 38

7 H. Approved roofing materials include wood shake, architectural grade asphalt or fiberglass shingles, slate, tile, or standing seam metal. Asphalt shingles must be a minimum 30 year architectural grade, 300 pounds or greater per square. The ARB may consider for approval, without obligation, any unlisted materials. I. Driveways must be constructed of concrete, brick or pavers. No painted or stained driveways will be permitted. No straight driveways will be permitted unless a specific lot will allow for no other alternative as determined by the ARB. No gravel driveways will be allowed. The driveway shall be constructed to be no more than twelve (12) feet wide for the running length of the driveway, with no more than a thirty (30) foot pad measured horizontally to the garage door, with a turnaround of no more than fifteen (15) feet, and the curb apron no wider than twenty (20) feet. Driveways must accommodate the parking of two or more vehicles outside of the garage. J. Garage doors must be on the side or rear of the home, except on those lots where there is no other alternative as determined by the ARB. No carports are allowed. K. Roof vents, rain diverters, skylights, chimney exhausts and plumbing vents must be painted to match or blend with the roof. Electrical and telephone service lines, cables, and boxes must be screened and/or painted to blend with adjacent surfaces. Backflow valves must be screened or covered. L. Exterior flood light fixtures must be hooded or the bulb recessed in an appropriate receptacle. Bare bulb fixtures are not permitted M. All visible ducts, pipes, wiring, piers, or similar items are to have an approved enclosure, surface treatment or screening. Visually screened areas to serve as service yards must be provided to conceal garbage cans, fuel tanks, gas and electric meters, pool pumps and filters from view from all roadways and adjacent properties. Any such visual barrier shall be at least one (1) foot higher than the item to be screened, and may consist of either fencing or evergreen landscaping and planting approved by the Architectural Review Board in accordance with its standards. N. All accessories such as weathervanes, cupolas, gutters, and awnings must have ARB approval prior to installation. Gutter color should match surrounding material. O. Approval must be granted and a form must be submitted for all exterior decorative objects, both natural and manmade, including but not limited to items such as fountains, pools, antennas, and visible free-standing flag poles (maximum height 20 ). P. Two driveway reflectors no higher than 6 are permitted per curbside entrance. Q. All mailboxes must be an exact match of the approved mailbox style for the neighborhood in which the home is located. The mailbox may be provided and installed by a vendor of the homeowner s or builder s choice. The fee will vary based on the mailbox design approved for the subdivision. It is recommended that the mailbox not be installed until after the majority of construction activity has ceased and immediately prior to occupying the home. All maintenance and repair work may be performed by the homeowner s vendor of choice. The cost to repair any damage to the mailboxes is the responsibility of the homeowner. R. All work performed is subject to the Contractor s Standards which are included within Section IV of this document. Page 7 of 38

9 SECTION III ARB Review Process New Home Construction: A. PRELIMINARY REVIEW - Preliminary review is an optional procedure, the purpose of which is to identify any ARB concerns as early in the design stage as possible. Preliminary review is valid for six months. The submittal requirements for the preliminary review are as follows: 1. A conceptual drawing and plat with a house rendering B. FORMAL REVIEW PROCESS (MANDATORY) 1. CONSTRUCTION DEPOSITS - A $2,500 construction deposit and a minimum $10,000 performance deposit are required prior to the issuance of a construction permit allowing commencement of work. No portions of the deposit or bond will be refunded until the ARB performs a final inspection of the home and landscaping, and all noted items have been corrected to the satisfaction of the ARB. The following information must be submitted to the ARB prior to such formal review: a. Contractor s and Owners Agreement and Permit Application b. Plat of site plan - The scale of the site plan should be no less than 1 inch = 20 feet. The following information must be included on the site plan plat: i. All property lines and the minimum distances from all structure sides to the nearest property lines ii. Locations of buildings iii. Driveway, walkways, decks, and patios - The width of the driveway and pads along the length and at the curb must be indicated. Refer to Section II for driveway and pad width limitations iv. Location of easements and critical lines - clearly indicated and highlighted on plat v. Location of all culverts and storm drainage inlets vi. Drainage provisions with indication of direction of flow - Each property owner is responsible for ensuring that all runoff is directed to the front and/or rear of their lot and that no runoff is directed onto adjacent lots. The use of swales, berms, retaining walls, or underground drainage systems is required to ensure that water drains only to the front or rear of the lot. A site grading plan which includes the location of swales, berms, retaining walls, and underground drainage systems is required. c. Tree Survey - A formal tree survey must be performed by a licensed company prior to starting any underbrushing or clearing activity. All trees greater than 6 in diameter at breast height (4.5 above natural ground) must be identified on the survey, with the size and species noted for each. The tree survey data must be plotted on the plat in order to enable the ARB to determine how the proposed siting of structures and drainage provision relates to and affects the trees on the lot. 10 d. Two complete sets of construction drawings - The following working drawing must be submitted in duplicate, drawn to a standard architectural scale of 1/4 =1 : i. Elevation drawings of all sides depicting foundation treatment, external HVAC enclosure, decks, patios, and propane tank location and enclosure. i. Construction details of HVAC and refuse container enclosures or service yard (if applicable) ii. A color & material sample board must be submitted which shall include samples of shingles, siding materials, and colors. Proposed colors of all exterior materials including siding, trim, brick, stone, roofing, stucco and lattice must be submitted with actual samples of proposed materials. These samples are necessary to evaluate the proposed appearance of home as color chips often vary greatly from actual applications due to varying materials. Pictures illustrating the style and color of entry doors, garage doors, shutters, and external light fixtures are also required. iii. Fee - A non-refundable $500 plan review and oversight fee is required. C. UNDERBRUSHING PERMIT- All of the following requirements must be satisfied prior to issuance of an Underbrushing permit: 1. Signed Contractor s and Owners Agreement and Permit Application 2. Tree Survey - A formal tree survey must be performed by a licensed company prior to starting any Underbrushing or clearing activity on a Dunes West lot. 3. No heavy equipment other than bush hogs, chain saws and hand tools. All debris must be removed within one (1) week. D. CLEARING PERMIT 1. Lot Clearing deposit - A $1000 lot clearing deposit is required prior to the commencement of such work. The clearing deposit will be refunded after the clearing is complete and approved by the ARB, provided that the construction is commenced within six months of the date of issuance of such permit. This permit is valid for 6 months. If Home Construction has not begun prior to expiration of the clearing permit, the $1000 deposit is forfeited and owner must reapply. 2. Silt fences or barriers and string lines along all property boundary lines must be erected and continuously maintained during the entire construction period. 3. A Dunes West permit must be issued and posted on site prior to commencing any lot clearing activity. It shall be a violation if such permit is not posted or cannot be seen visibly from the street. 4. A Tree Survey plat of the property designating all trees to be removed must be submitted and approved prior to clearing. Such plat must depict the footprint of the home and delineation of the driveway. Page 10 of 38

11 5. No hardwood trees greater than 6 in diameter at chest height (4.5 feet above naturally existing ground elevation) may be removed without ARB approval. Further, no hardwood trees over 16 in diameter can be removed without town approval. 6. All cleared material must be immediately removed (i.e., hauled off-site, chipped). No cleared material may be stored on site for longer than 1 week. 7. All work performed shall be subject to the Contractor s Guidelines as set forth in Section IV of this document. E. FOUNDATION STAKE-OUT AND TREE INSPECTION - The purpose of the stake-out inspection is to verify that the home foundation is sited properly according to or consistent with the approved site plan and setback requirements and to approve the removal of hardwood trees greater than 6 in diameter. The stake-out cannot be performed, nor can any hardwood trees greater than 6 in diameter be removed, until the ARB has granted final written approval. The contractor or owner must request a stake-out inspection after the following items have been completed and the property is ready for inspection. 1. Locate all building corners - No foundation work may begin until after the stake-out inspection has been completed and a Dunes West permit has been issued and posted on site. For purposes of the stake-out inspection, wooden stakes must be inserted in the ground at each of the building corners and connected by string to represent the proposed footprint of the home. If is the ARB determines at a later time that the siting was changed after the stake-out inspection the contractor and/or owner will be required to remove all work previously performed and relocate the foundation to its approved location. 2. White tape shall be used to clearly mark all hardwood trees greater than 6 in diameter to be saved. 3. String lines strung along side property lines are required to be maintained throughout construction in order to verify side setbacks. F. DRIVEWAY STAKE-OUT INSPECTION 1. After the driveway is formed, the ARB must be notified and a final stake-out inspection request made to confirm compliance with approved plans. The driveway MAY NOT be poured until ARB approval has been granted. 2. If it is determined that a driveway was completed without ARB approval, or that its location was changed after the stake-out inspection, the contractor and owner will be required to remove the driveway and/or make necessary modifications as the ARB shall determine. G. CONSTRUCTION CHANGES AFFECTING EXTERIOR APPEARANCE 1. Any and all changes and/or additions to the plans originally approved by the ARB which affect the exterior appearance of the home and/or lot must be submitted, and approved in writing by the ARB prior to the commencement of work. A Color & Material board must be submitted with plans, if applicable. Page 11 of 38

12 H. LANDSCAPE PLAN AND INSTALLATION 1. An irrigation system is required for all front and side yard sodded areas. Irrigation may also be required for other planting areas that the ARB determines need supplemental water. Backflow valves must be screened and shown clearly on the landscape plan. 2. All grassed areas in the front and side yards must be sodded beyond the property line and to the street curb. Rear yards shall be sodded, sprigged or seeded. Additionally, corner lots must be sodded along the full length of their frontage along each adjacent street. 3. Evergreen shrubbery with a minimum height of 36 inches tall above grade is required as foundation plantings around the front and sides of the main home as well any structures such as service yards, HVAC enclosures, pool and fences, pool pumps, propane tanks and outbuildings. In addition, evergreen plantings of a predetermined height are required (1) around all back flow valves, (2) well pumps, (3) irrigation pipes, and (4) permanent play structures and shall shield them from view from streets and neighboring properties. The ARB recommends that whenever applicable the sewer cleanout/plumbing devices be cut off at ground level and painted Charleston green, dark brown, or black. Elevated homes, defined as those homes raised sufficiently above grade to allow a garage beneath the main living level, are required to have evergreen shrubbery of a 48 minimum height as foundation plantings. 4. All plant beds, landscape beds, and natural areas must be kept edged and covered with mulching materials. These mulched areas should follow natural lines and forms. All grass areas at curb must be edged. 5. The use of swales, berms, retaining walls, or underground drainage systems shall be required if necessary to ensure that water drains to the front or rear of the property. Berms must have a maximum 4:1 width to height ratio and be formed in a manner that follows established land or plant beds. 6. All forest litter, dead trees, noxious weeds, and noxious undergrowth must be removed from areas designated to be maintained in a natural condition. These areas must be maintained with an adequate depth of pine straw, woodchips, or other organic mulch materials to prevent weed and noxious material growth. 7. The ARB maintains a listing of plant materials that are generally resistant to deer depredation within Dunes West. Please request this listing prior to preparing your landscape plan in order to avoid plant materials that may be susceptible to deer depredation. 8. The use of local landscape design firms is strongly recommended due to their familiarity with the local environmental conditions. All debris must be removed immediately and no such debris shall be deposited on the curbside. 9. Silt fencing must remain in place and be properly maintained during landscaping until sod is installed or seeded and/or sprigged areas are reasonably established. Page 12 of 38

13 I. LANDSCAPE PERMIT REQUIREMENTS 1. A landscaping plan must be submitted to the ARB a minimum of 60 days prior to completion of the home. All irrigation and landscaping must be completely installed within 60 days of issuance of the certificate of occupancy. Landscaping work may NOT commence until written ARB approval is obtained and a Dunes West Landscaping permit is issued and posted on site. The following information must be drawn to scale and indicated on the site plan: a. Planting schedule listing the name, size, and number of all plantings b. Proposed location of all plantings, landscape lighting, hardscape, retaining walls, berms, and surface materials such as grass and ground cover c. Locations of all existing structures, driveways, and pads d. Details of drainage provisions to be taken in order to prevent water run-off onto adjacent lots with indication of direction of water flow e. A site grading plan which includes the location of swales, berms, retaining walls, and underground drainage systems f. Drawings showing elevation and construction details of retaining walls J. FINAL INSPECTION 1. Dwellings may not be temporarily or permanently occupied until Certificates of Occupancy have been issued by both the Architectural Review Board and the Town Of Mount Pleasant. Upon completion of the home, the owner or builder must contact the ARB and request a certificate of occupancy inspection. The ARB shall conduct such inspection within 5 business days of such request. A final landscape inspection must be requested within 60 days of issuance of both Certificates of Occupancy described above. 2. No portion of the construction deposit will be refunded until all items identified during the inspections have been corrected to the satisfaction of the ARB. 3. Any fines levied during the construction process remaining unpaid at the time of Final Inspection shall be deducted from the deposit refund. 4. Should the entire construction process, including landscaping, not be completed within 18 months of the ARB s approval, the deposit and bond shall be forfeited and daily fines will be levied until all deficiencies have been corrected and approved. SECTION IV Contractor s Standards A. NEW HOME CONSTRUCTION- Contractors must post a minimum $10,000 refundable performance deposit prior to the permit being issued. Any applicable fines imposed by the ARB will be levied against the performance deposit. Page 13 of 38

14 B. CONSTRUCTION HOURS - All construction activity is limited to the hours, local time, of 7:00 am - 6:00 pm from Monday through Friday and 8:00 am - 4:30 pm on Saturday. No activities resulting in excessive noise is permitted prior to 8:00 am. No construction activity shall be permitted on Sunday or any holidays, as designated by the ARB. Any work outside of the regular construction hours stated above must have the prior written approval of the Dunes West ARB. C. SILT CONTROL - Prior to any ground being disturbed, and throughout the duration of construction related activity, silt prevention and control measures shall be installed and continuously maintained. These measures shall be installed so as to minimize the siltation of the roadways and storm drainage systems and to minimize the disturbance of the community appearance. These measures must include: 1. Silt Fence A silt fence (as illustrated in Exhibit 2 in Section VII of these ARB Standards) must be installed across the entire length of the front property line. Silt fences may also be required along other property lines if conditions are such that runoff is flowing or may flow onto adjacent properties. The silt fence must be properly trenched and backfilled and maintained until sod is installed. 2. Lot Access - Access to the home site shall be limited to one location. A temporary driveway of S.A.B.C. or #57 stone must be installed at the access point from the curb line to the property line. Access shall not be permitted across another property. 3. Protection of Storm Drain Inlets Drain Protectors must be placed around all storm drain inlets (except curb inlets) located on or adjacent to the lot. The protectors must be maintained and replaced as necessary throughout the duration of construction activity, until ground cover is re-established. 4. Street Cleaning - The owner/contractor shall be solely responsible for keeping the adjacent roadways to the lot clean. If silt control measures are removed to prepare the site for grading or landscaping activity, the contractor shall be responsible for cleaning the roadways. Fines of $100 per violation and $50 per day will be imposed on the owner until the violation is corrected to the satisfaction of the ARB. D. TREE PROTECTION 1. Fill around protected trees - Grading around trees to be left intact (hardwoods with diameter of 16 or greater) must not vary more than 3 from existing grade, within the drip line. Fill material must be topsoil or a mixture of 50% topsoil and 50% sand. 2. Cutting grades - Cutting grades around trees to be left intact will not be allowed within the drip line of the tree without specific approval of the ARB due to extenuating circumstances. 3. Barriers - All trees designated as protected by the ARB shall have barriers erected around them. Barriers will be erected prior to any clearing or grading and remain intact until final landscape construction. No material storage or parking will be permitted within such barriers. Barriers shall consist of a three foot high fence held in place by stakes and shall not be attached to trees. Page 14 of 38

15 E. APPEARANCE AND ACTIONS OF CREW - Contractors are absolutely responsible for the acts of all their employees, subcontractors, and all other persons performing work under a contractor. Contractors shall ensure that the following conditions are met: 1. Shirts, pants and shoes must be worn at all times. No cut-off shorts or shirts are allowed. 2. Only radios with headphones are permitted. 3. No loud or offensive language is allowed. 4. Dogs are not permitted on the job site. 5. Family/friends are not permitted on site. F. CONTRABAND - Absolutely no firearms, alcohol, illegal drugs, or other contraband are permitted within any Dunes West construction site. Any violation of such prohibition will result in the immediate and permanent seizure of the offender s gate pass and the reporting of such activity to the proper legal authorities. G. FACILITIES - A construction dumpster and portable sanitary unit are required to be placed at each home site during the construction stage. Placement of either of these facilities within the roadway or on adjacent properties is strictly prohibited. The portable sanitary unit must be situated at a minimum of 20 feet from the curb with the door facing the interior of the property. The dumpster is to be situated at a minimum of 20 feet from the roadway. Contractors must not permit debris to accumulate outside the dumpster and must provide for regular emptying of the dumpster. Construction equipment or trailers on site must have prior approval by the Dunes West ARB. H. PERMITS - No construction activity may be commenced until a Dunes West Building Permit has been issued. Both the Dunes West building permit (s) and the Town of Mt. Pleasant building permit must be clearly posted on site at all times and shall not be nailed or in any way fastened to trees. I. SIGNS - In addition to the posting of building permits one Dunes West approved project identification sign is permitted. Contact the Dunes West POA office at for specifications. All other identification signage will be removed and disposed of. All such signs must be removed upon completion of the permitted work. Sub-contractors are not permitted to install signs at anytime. J. UTILITIES - Prior to the commencement of digging within any right-of-ways or easements the location of all underground utilities must be ascertained by contacting the appropriate authorities, to include: 1. South Carolina Electric & Gas 2. Mt. Pleasant Water & Sewer Commission 3. Comcast Cable 4. AT&T No Cuts underground utility location company shall be contacted at to identify the location of any underground utilities prior to digging. No construction activity may be commenced on properties of the Dunes West Golf Club and Dunes West Property Owners Association without prior written approval. Page 15 of 38

16 K. WORK AREA LIMITS - All work must be confined to the lot. No other properties may be used by workers or suppliers for access to the job site, storage of materials, parking, or placement of any dumpster or other such facilities. L. PARKING - Parking of vehicles by construction workers must be on the job site, where allowed by the lot dimensions, and not on roadways or adjacent properties unless absolutely necessary. If vehicles must be parked on the roadway, they must be parked on the same side of the roadway as the customer s lot and shall not obstruct any mailboxes or driveways. M. CLEANING - All construction material, equipment, and supplies must be stored in an orderly manner. The construction site shall be cleaned daily and kept weed free. The contractor will furnish and utilize a container on site for lunch debris. No cans, bottles, or other debris are to be deposited on the ground. N. LITTERING AND DUMPING - Litter disposal on roadways is not permitted. Absolutely no dumping of debris is allowed on Dunes West POA property. O. SECURITY - All vehicles are subject to periodic security searches. Neither Dunes West nor its security provider is responsible for loss or damage on the job site. Security will issue tickets for noted ARB and traffic violations according to the provisions set forth in Section VI (Violations) below. SECTION V: ARB Guidelines for Home Owner Renovations and Additions to Existing Homes and Properties No improvements of any nature whatsoever, with only one exception, affecting the exterior appearance of any Dunes West property may be constructed, altered, added to, maintained or removed without the express written permission of the ARB. No work may commence without such permission and the issuance of a Dunes West permit, which must be posted in a visible location to assist the Covenants Committee in noting approved projects. The only exception to the ARB permitting process applies to landscaping projects costing less than $5000 which do NOT include any hardscaping, drainage systems, or grade changes or are NOT part of a pool installation. A. PERMITTING REQUIREMENTS 1. No construction related activity affecting the exterior appearance of a home or lot will commence until a Dunes West permit has been issued and is posted on site. Each area of work which is performed by a separate general contractor requires a separate permit, e.g. a fence surrounding a swimming pool which is not installed by the pool contractor requires a separate permit. All of the following requirements must be satisfied prior to issuance of a permit. a. FEE - There is a plan review and oversight fee for each permit for secondary construction activity (pools, fences, additions, etc.) See Fee & Deposit Schedule on the Permit Application Form b. PLANS, PLATS, AND ELEVATIONS as applicable, showing the location and details of the improvements, as measured from the home and property lines. Page 16 of 38

17 c. COMPLETED CONTRACTOR S AND OWNERS AGREEMENT AND PERMIT APPLICATION (which can be found in Section IX of these ARB Guidelines) B. CONSTRUCTION CHANGES AFFECTING EXTERIOR APPEARANCE 1. No improvements of any nature whatsoever, with only one exception, affecting the exterior appearance of any Dunes West property may be constructed, altered, added to, maintained or removed without the express written permission of the ARB. No work may commence without such permission and the issuance of a Dunes West permit, which must be posted in a visible location to assist the Covenants Committee in noting approved projects. The only exception to the ARB permitting process applies to landscaping projects costing less than $5000 which do NOT include any hardscaping, drainage systems, or grade changes or are NOT part of a pool installation. 2. Approval must be granted and a form must be submitted for all exterior decorative objects, both natural and manmade, including but not limited to items such as fountains, pools, antennas, visible free-standing flag poles (maximum height 20 ). Approval is not required to be submitted for a single flagpole, not to exceed six (6) feet in length, attached to the front portion of the house or attached to the house in the garage entry area. 3. Driveway reflectors no higher than 6 are limited to 2 per curbside entrance. 4. All accessories such as weathervanes, cupolas, gutters and awnings must have ARB approval prior to installation. Gutter color should match surrounding material. 5. Approval is required for all exterior lights or lighting fixtures not included as a part of the original structures. SEE SECTION IV - CONTRACTORS STANDARDS - FOR ADDITIONAL GUIDELINES C. LANDSCAPE CHANGES 1. Any landscape additions or modification project costing greater than $5000 must be submitted to the ARB for approval. Also, all pool landscaping and any landscape change, regardless of cost, which impacts the landscape grades or drainage of water, or includes hardscape, retaining walls, or berms, must be submitted for approval. 2. LANDSCAPE PLAN AND INSTALLATION a. All grassed areas in the front and side yards must be sodded past the property line to the street curb. Rear yards should be sodded, sprigged or seeded. Additionally, corner lots must be sodded along the full length of their frontage along each adjacent roadway. b. Evergreen shrubbery with a minimum height of 36 inches above grade is required as foundation plantings around the front and sides of the main home as well as any structures such as service yards, HVAC enclosures, pool and fences, pool pumps, propane tanks and outbuildings. In addition, evergreen plantings of a predetermined height are required around (1) all back flow valves, (2) well pumps, (3) irrigation pipes, and (4) permanent play structures and shall shield them from view from streets and neighbor s properties. The ARB recommends that whenever applicable the sewer cleanout/plumbing devices be cut off at Page 17 of 38

18 ground level and painted Charleston green, dark brown, or black. Elevated homes those raised sufficiently above grade to allow a garage beneath the main living level - are required to have evergreen shrubbery of a 48 inch minimum height as foundation plantings. c. All plant beds, landscape beds, and natural areas must be kept edged and covered with mulching materials. These mulched areas should follow natural lines and forms. All grass areas at curb must be edged. d. The use of swales, berms, retaining walls, or underground drainage systems shall be required if necessary to ensure that water drains to the front or rear of the property. Berms must have a maximum 4:1 width to height ratio and be formed in a manner that follows established land or plant beds. e. All forest litter, dead trees, noxious weeds, and noxious undergrowth must be removed from areas designated to be maintained in a natural condition. These areas must be maintained with an adequate depth of pine straw, woodchips, or other organic mulch materials to prevent weed and noxious material growth. f. The ARB maintains a listing of plant materials that are generally resistant to deer depredation within Dunes West. Please request this listing prior to preparing your landscape plan in order to avoid plant materials that may be susceptible to deer depredation. g. The use of local landscape design firms is recommended due to their familiarity with the local environmental conditions. All debris must be removed immediately and no such debris shall be deposited on the curbside. 3. LANDSCAPE PERMIT REQUIREMENTS Landscaping work may NOT commence until written ARB approval is obtained and a Dunes West Landscaping permit is issued and posted on site. The following information must be drawn to scale and indicated on the site plan: a. Planting schedule listing the name, size, and number of all plantings b. Proposed location of all plantings, landscape lighting, hardscape, retaining walls, berms, and surface materials such as grass and ground cover c. Locations of all existing structures, driveways, and pads d. Details of drainage provisions to be taken in order to prevent water run-off onto adjacent lots with indication of direction of water flow e. A site grading plan which includes the location of swales, berms, retaining walls, and underground drainage systems f. Drawings showing elevation and construction details of retaining walls SEE SECTION IV - CONTRACTORS STANDARDS - FOR ADDITIONAL GUIDELINES Page 18 of 38

ADDITIONAL BUILDINGS - PLAY EQUIPMENT In order to present a harmonious community appearance, and to help contain noise levels for adjacent neighbors, all structures other than garages, including, but not limited to, play sets, trampolines, pools, pool houses, utility sheds, spas, outdoor fireplaces, etc., should be located behind the rear site lines of the home. In unusual circumstances exceptions may be granted due to lot shape or size, OCRM critical lines and buffers, or town restrictions. Where exceptions are granted, the homeowners will be required to provide extensive screening and (or) fencing to hide the structure from public and neighbors views and to buffer potential noise. Such structures will not be allowed in side yards. 1. The placement of additions and structures, including, but not limited to, storage buildings, skateboard ramps, tree houses, trampolines, gazebos, fencing, pools, pool equipment, tennis courts, propane tanks, game and play structures (including permanent and portable basketball goals), doghouses, decks, patios, firewood storage, energy conservation features (i.e. solar panels), ornamental structures, and lawn items on the property must first be approved in writing by the Dunes West ARB. A plat designating the location of such must be submitted. 2. Due to the unique nature of corner lots, evergreen landscaping or hard screening must be installed and maintained to conceal the pool area, fences, equipment, accessories, storage sheds, pool houses, play sets, toys, and utility tanks from both roadways and neighboring property on all sides. Such concealment shall be in addition to said structures, pools, sheds, pool houses, accessories, equipment and play sets being located behind the site lines of the house. SEE SECTION IV - CONTRACTORS STANDARDS - FOR ADDITIONAL GUIDELINES E. NEW FENCES 1. Fences may be approved in the side and/or rear yards, at the sole discretion of the ARB. No front yard fences will be permitted. Fences must be located either on the side property lines or at least 7.5 feet from said lines. Approved Fencing material shall include: brick, wood, stucco, aluminum, vinyl and wrought iron. Wood fences must be painted, stained, or sealed, and maintained. The deposit shall be retained until wood fences are stained, sealed, or painted. Fencing material and construction should be consistent for the entire length of the fence. Chain link and metal wire fences are not permitted. Living fences may be permitted at the discretion of the ARB if they cannot be viewed by neighbors or from the street. Extensive evergreen plantings will be required. Maximum fence height is 6 feet, with the exception of Palmetto Hall which is 4 foot picket style only. The street-facing side(s) of the fence must be screened by evergreen plants of a minimum 36 from grade. Some fences might require taller plants. A landscape plan is required and must be submitted for approval with the fence request. Both must be approved before ANY work may begin. SEE SECTION IV - CONTRACTORS STANDARDS - FOR ADDITIONAL GUIDELINES F. Where exceptions are granted, the homeowners will be required to provide extensive screening and (or) fencing to hide the structure from public and neighbors views, and to buffer potential noise. Such structures mentioned above will not be allowed in side yards. 1. Freestanding pools located above the ground are not permitted. Elevated pools attached to the house by decking will be considered on a case-by-case basis and, if approved, will require additional landscaping and screening. 2. A Pool Permit Request Form must be submitted prior to pool construction, along with the following items: a) A Plat showing location and dimensions of pool, spa, retaining walls, berms; all applicable setbacks; size and location of trees to be removed; location of pool equipment; drainage directions b) Elevation drawings of pool, spa, waterfalls, retaining walls, etc., showing height of each feature and any grade changes c) Pictures of pool materials, including decking and tile 3. Appearance, height, and detailing must be consistent with the architectural character of the house. 4. The pool must have fencing (see fencing standards). A Fence Permit Request form must be submitted to and approved by the ARB before ANY pool construction may begin. The ARB requires the installation of permanent fencing before the pool is filled. In the case of a fiberglass pool, with special permission of the ARB, a temporary fence of tree barricade is required before filling the pool, and the permanent fence must be installed within 30 days after the pool is filled. 5. Glaring light sources that have a visual impact on neighboring lots are not permitted. 6. Landscaping must conceal pool area, equipment, accessories, and toys from the street on all sides of the required fencing. In addition, the ARB encourages additional landscaping on the sides and rear to shield the pool from neighbors view. Elevated pools will require additional landscaping and taller plants. 7. A Landscape plan must be submitted to and approved by the ARB before ANY pool construction may begin. 8. A Pool Request Form must be submitted for all exterior Spas or Hot Tubs. Spas and Hot tubs must be located directly behind the rear site lines of the home and within a fence area that is screened from adjacent properties and streets. 9. Pools must be sited within the extended boundaries of the house and directly behind the house unless a special exception is granted by the ARB. Page 20 of 38

21 10. Pool equipment must be located within the fence or in the existing service yard of the house. SEE SECTION IV - CONTRACTORS STANDARDS - FOR ADDITIONAL GUIDELINES G. DECK & PORCH PERMIT REQUIREMENTS 1. A request must be submitted and approved by the ARB for all decks and porches. 2. The request must include a plat denoting location and dimensions, construction drawings, and a list of colors and materials. 3. Except in unusual circumstances, the deck may not extend beyond the site lines of the home. 4. Color must be harmonious with the colors of the house. 5. The following will be reviewed: location, size, conformity with design of the house, relationship to neighboring dwellings, and proposed use. 6. The State of South Carolina requires a Town of Mount Pleasant building permit for all projects over $5,000. SEE SECTION IV - CONTRACTORS STANDARDS - FOR ADDITIONAL GUIDELINES H. DOCK PERMIT REQUIREMENTS 1. A copy of the written approval from OCRM (Ocean and Coastal Resource Management), is required before the ARB will consider a dock request. 2. Dock plans which clearly indicate elevations and materials to be used must be submitted with the request. 3. Included insection VIII of these ARB Standards are Typical Dock Plans for Dock corridors terminating directly into Toomer Creek, Wagner Creek, and the Wando River and tributaries. 4. Power Boat Lifts and Davits may be approved, subject to the following restrictions: boats must be raised above the water such that the boat s gunwales are visibly higher than the walkways. Any and all boat covers must be made of neutral colors to blend with the natural environment. 5. All docks must have handrails extending the entire length of the walkway along both sides and around the perimeter of the fixed pier head, as well as along both sides of the gangway between the pier head and floating docks. 6. Gangways between the fixed and floating portions of the dock must be of all wood or all aluminum construction. 7. The maximum size of the pier head and floating dock are established by the South Carolina Coastal Council. Evidence of Ocean and Coastal Resource Management approval must be submitted to the ARB prior to the issuance of a Dunes West dock permit. Page 21 of 38

22 8. All lighting with numbers and styles must be submitted with dock plans. Glaring light sources that have a visual impact on neighboring lots are not permitted. 9. Fee - There is a $100 plan review fee for the construction or modification of a dock. In addition a deposit of $500 is required prior to the issuance of a permit. 10. A Dunes West dock permit must be issued and posted on site prior to commencing work for construction of a dock. The permit must be posted where it is clearly visible from the street. SEE SECTION IV - CONTRACTORS STANDARDS - FOR ADDITIONAL GUIDELINES SECTION VI Community Covenants Standards A. GENERAL STANDARDS 1. The placement of additions and structures, including, but not limited to, storage buildings, skateboard ramps, tree houses, trampolines, gazebos, fencing, pools, pool equipment, tennis courts, propane tanks, game and play structures (including permanent and portable basketball goals), doghouses, decks, patios, firewood storage, energy conservation features (i.e. solar panels), ornamental structures, and lawn items on the property must first be approved in writing by the Dunes West ARB. This is in addition to said structures, pools, sheds, pool houses, accessories, equipment and play sets being located behind the site lines of the house. In addition all forest litter, dead trees, noxious weeds, and noxious undergrowth must be removed from areas to be maintained in a natural condition. These areas must be maintained with an adequate depth of pine straw, woodchips or other organic mulch materials to prevent weed and noxious material growth. 4. All children s toys must be picked up by dusk, including wading pools. Play structures should be placed directly behind the rear site lines of the home. The ARB reserves the right to require play structures to be removed or relocated if they do not comply with the guidelines. The dimensions, Page 22 of 38

23 materials, colors, design and siting should be selected to minimize the impact on neighboring properties. 5. All machinery and equipment, including, but not limited to: campers, golf carts, recreational vehicles, boats, motorcycles, and trailers must be stored or located in such a manner as not to be visible. All motorcycles stored on property must be transported to and from the residence, and cannot be operated within any gated area of Dunes West. GOLF CARTS are not allowed on any roadways in Dunes West (see page 41 Section in the DCCR). Portable Storage Containers or Devices are permitted but must be removed within 14 days. 6. All yards and landscaping must be maintained by keeping grass mowed below a height of four inches (4 ) and must be kept free of debris and garbage. No lawn maintenance resulting in excessive noise (mowers, edges, leaf blowers, hedge trimmers, etc.) may begin prior to 8:00 a.m. Natural areas must be maintained with adequate mulch material to prevent weed growth. The professional retained by the homeowner must remove their clippings and debris promptly upon departure from the property. There is no dumping on POA property allowed anywhere in Dunes West. 7. The Town of Mt. Pleasant requires the placement of a town supplied 90 gallon wheeled refuse container and Town supplied recycling containers at the curb on designated collection days only. Only Town supplied containers are to be used. If more capacity is required, a second unit should be purchased from the Town. No plastic or paper bags containing household waste outside of approved containers may be placed at the curb. THE CONTAINER MUST BE REMOVED FROM THE CURB WITHIN 24 HOURS AFTER THE TOWN PICK-UP. GARBAGE CAN AND RECYCLE CONTAINER MUST BE CONCEALED FROM VIEW OF STREETS AND NEIGHBORING PROPERTIES EXCEPT ON COLLECTION DAYS. 8. No homeowner shall be permitted to discharge any effluent from any source, including but not limited to swimming pool filtration systems, into any street, waterway, wetlands area or any Association or city-owned storm water runoff or drainage system, except as specifically approved by Dunes West ARB. Any approval by the ARB shall not be construed as approval by any City, Town or other entity having legal jurisdiction thereof. 9. Signs are not permitted, except as may be required by legal proceedings. An ARB approved For Sale sign is available from a designated vendor and is the only for sale sign allowed in neighborhood located outside the privacy gates at Dunes West. Only 1 sign is allowed per property and must be placed 10 ft. from the curb in the center of the yard. Brochure boxes and cylinders are not permitted. For Sale signs are not permitted behind the privacy gates. 10. Invisible dog fencing flags must be removed within 6 weeks of installation. 11. No pet shall be allowed to make an unreasonable amount of noise or to become a nuisance. No structure for the care, housing, or confinement of any pet shall be constructed or maintained on any part of the Common Areas, Open Space, or Private Open Space areas. Pets shall be under leash at all times when walked or exercised in any portion of the Common Areas or Open Space areas, and the owner of such pet shall immediately remove the excrement. 12. No rubbish or debris of any kind shall be dumped, placed, or permitted to accumulate upon any portion of the Development, nor shall any nuisance or odors be permitted to exist or operate upon Page 23 of 38

24 or arise from the Development, so as to render any portion thereof unsanitary, unsightly, offensive, or detrimental to persons using or occupying any other portions of the Development. Noxious or offensive activities shall not be carried on in any part of the Development and the Association and each owner, his family, Tenants, guests, invitees, servants, and agents shall refrain from any act or use which could cause disorderly, unsightly, or unkempt conditions, or which could cause embarrassment, discomfort, annoyance, or nuisance to the occupants of other portions of the Development or which could result in a cancellation of any insurance for any portion of the Development or which would be in violation of any law or governmental code or regulation. Any owner, or his/her family, tenants, guests, invitees, servants, or agents, who dumps or places any trash or debris upon any portion of the Development shall be liable to the Association for the actual costs of removal thereof. 13. Garage doors must be kept closed, except when homeowner activities require the door to remain open. In these cases, owners are respectfully requested to close the doors as soon as possible thereafter. 14. Firewood piles are to be maintained in good order and must be directly behind the home, and when they are covered, a neutral color material should be used. 15. Each owner shall be responsible for maintaining his property in a neat, clean, and sanitary condition, and such responsibility shall include the maintenance and care of all exterior surfaces of all Dwellings, buildings, and other structures and all lawns, trees, shrubs, hedges, grass, and other landscaping.. B. COVENANTS COMMITTEE SURVEILLANCE, FINES AND REMEDIAL ACTION 1. INSPECTIONS - Periodic inspections are made throughout the property to monitor activity and assure compliance with the Dunes West Covenants and ARB Standards. Reports of violations will be sent to the contractor and owner. It is imperative that any corrective action indicated on the report be taken care of immediately. 2. VIOLATIONS NOTED BY PROPERTY OWNERS SHOULD BE DIRECTED TO THE ARB COORDINATOR AT FINES a. VIOLATIONS RELATED TO PERMITTED WORK - The ARB will notify the owner and contractor of any noted violations of the Covenants and ARB Standards. Such violations must be corrected immediately. Failure to correct the Violation within 10 days of notification will result in a $100 fine per violation plus a $50 fine per day per violation each day thereafter until corrected. The fine for dumping material on any POA property within Dunes West is $500 per occurrence with additional fines of $50 per day thereafter until removed. b. VIOLATION FOR UNPERMITTED WORK - If any clearing or construction activity is commenced without the express written approval of the Dunes West ARB and the issuance and posting of a Dunes West permit, a $500 fine will be assessed and all work must stop immediately. Security may be called to escort the workers off the property. If work resumes prior to permitting, subsequent fines will be levied at $500 per violation. Page 24 of 38

25 c. ALL FINES MUST BE PAID IMMEDIATELY. The owner and contractor are fully responsible for the payment of fines and costs for repairs. Fines are in addition to any costs to repair damages. The ARB will not issue any new permits until a contractor or owner has cleared all outstanding fines. Fines will be assessed against the performance deposit until paid. Fines outstanding longer than (30) days from the date of the violation will be turned over to legal counsel for collection. 4. VIOLATIONS - Security will issue only one warning ticket per person for ARB violations. The second violation will result in recall of the contractor s gate pass for a period of seven days. The third violation will result in permanent recall of the gate pass. Speed limits are strictly enforced at Dunes West. 5. DAMAGES - The contractor is responsible for damages to properties within Dunes West, including, but not limited to, roadways and road right-of-ways. The costs for repairing damages must be paid immediately. These costs will be deducted from the performance deposit until paid in full. The owner and contractor are fully responsible for payment of all damages. Balances that are outstanding longer than thirty (30) days from the date of assessment will be turned over to legal counsel for collection. 6. UNAUTHORIZED TREE REMOVAL AND/OR DAMAGE - All trees designated as saved trees are to be properly protected. The roots, bark, trunks, limbs and canopies of such trees must not be damaged. Any trees that are removed without the express permission of the Dunes West ARB as well as any trees that die as a result of negligence during the construction will result in a $500 fine per tree, as well as mandatory replacement with trees of similar specifications as the tree(s) removed. SECTION VII - ARB Review and Appeals Procedures A. MEETINGS - Dunes West ARB meetings are held on the first and third Wednesdays of the month at 9:00 a.m. Additional meetings may be scheduled at the ARB's discretion. Submittals received by the Wednesday prior to a meeting will be reviewed at the subsequent Wednesday s meeting. B. SUBMITTALS AND CORRESPONDENCE - All submittals to and correspondence with the ARB should be made in writing to the following address: Dunes West Architectural Review Board 3850 Bessemer Road, Ste. 200 Mt. Pleasant, SC The ARB will mail submittal responses to the owner, contractor, and architect as appropriate, typically within one week, but no more than 14 days after the ARB meeting date. C. COMPLIANCE - The owner and contractor or architect are required to promptly abide by the ARB s decision. Failure to comply promptly with the decision could result in forfeiture of all or part of the deposit and the initiation of any and all legal remedies available under the provision of the Dunes West DCCR Article 13 D. APPEALS - Any decision or action by the Dunes West ARB may be appealed. The following procedure must be followed for any such appeals. Page 25 of 38

26 1. WRITTEN APPEAL - All appeals are required to be submitted in writing with a full explanation, including supporting drawings, plans, etc. and signed by the owner. If the appeal is submitted by the contractor, architect, or designer, it is necessary that it be countersigned by the owner. The appeal will be considered by the ARB at its next meeting. The owner and contractor affected are encouraged to attend this meeting. The results of the ARB s review will be forwarded to the owner and contractor or architect making the appeal, within one week of the ARB s meeting but no longer than 14 days after the ARB meeting date. Any final decision of the ARB may be appealed in writing to the POA Board. Page 26 of 38
