1 780 CMR: MASSACHUSETTS AMENDMENTS TO THE INTERNATIONAL EXISTING BUILDING CODE 2009 CHAPTER 34: EXISTING STRUCTURES Replace as follows: Title. These regulations shall be known as e Existing Building Code of Massachusetts, hereinafter referred to as "is code." Replace as follows: Scope. The provisions of is code shall apply to e repair, alteration, change of occupancy, addition, and relocation of existing buildings. See Table below which includes, but is not limited to, applicable laws and specific use of oer regulations. The fire official enforces e provisions of 527 CMR. Reference to sections of e International Fire Code (IFC) 2009 Edition for building code requirements are adopted, except at retroactive requirements of e IFC are not adopted. The building official enforces 780 CMR and all adopted IFC requirements. Also see MGL c. 148, CMR 12.00: Massachusetts Electrical Code (Amendments) 780 CMR 13 and 51 (IECC wi MA amendments) Reference to e IMC shall apply to all mechanical systems except for at which is defined as sheet metal work by M.G.L. c. 112, 237. The provisions of 271 CMR shall apply to all sheet metal work as defined by M.G.L. c.112, 237. 2 Add subsections: Compliance Alternatives. Where compliance wi e provisions of e code for new construction, required by is code, is impractical because of construction difficulties or regulatory conflicts, compliance alternatives may be accepted by e building official. The building official may accept ese compliance alternatives, archaic materials and assemblies in Resource A of is code, or oers proposed. If e compliance alternative involves fire protection systems e building official shall consult wi e fire official Add subsection: Submittals. The application for a permit shall be in accordance wi 780 CMR 1.00: Scope and Administration and identify all items of non- or partial compliance wi e requirements of is code, and compliance alternatives, if any are proposed, for approval by e building official. The building official shall respond to e acceptability of any proposed compliance alternatives wiin 30 days of e filing of e permit application. Where proposed compliance alternatives are, in e opinion of e building official, unacceptable, or where issues of non-compliance remain, e permit applicant shall have e remedies prescribed by 780 CMR, section Investigation and Evaluation. For any proposed work regulated by is code and subject to 780 CMR, section 107, as a condition of e issuance of a permit e building owner shall cause e existing building (or portion ereof) to be investigated and evaluated in accordance wi e provisions of is code The investigation and evaluation shall be in sufficient detail to ascertain e effects of e proposed work on at least ese systems: structural, means of egress, fire protection, energy conservation, lighting, hazardous materials, and ventilation for e space under consideration and, where necessary, e entire building or structure and its foundation if impacted by e proposed work. The results of e investigation and evaluation, along wi any proposed compliance alternatives, shall be submitted to e building official in written report form CMR using 100% of e prescribed forces. For existing buildings wi seismic force resisting systems found in Table , e values of R, 0, and C dfrom is table shall be used in e analysis. The seismic resistance of e frame shall be based on its seismic connections being subject to two times e computed forces and moments resulting from seismic load. 5. Class A reinforced masonry shear walls have a minimum total area of reinforcement in e vertical and horizontal direction at least times e gross cross-sectional area of e wall, wi a minimum area in each direction at least times e gross cross-sectional area of e wall. Maximum spacing of reinforcing steel bars in grouted cells or bond courses is 6'-0" in one direction and 4'-0" in e oer direction, but not more an a of e leng or height of e wall, whichever is less, in each direction. Class A walls satisfy oer requirements for reinforced masonry of e base code. 6. Class B reinforced masonry shear walls satisfy all requirements for Class A walls, except at spacing limits for reinforcing steel bars are exceeded. 7. Class C reinforced masonry shear walls satisfy all requirements for reinforced masonry of e base code. 8. Class A reinforced concrete moment frames satisfy requirements of Sections , , and of 780 CMR 5 Edition and Sections and of ACI for reinforcing of beam to column joints. 9. Class B reinforced concrete moment frames do not satisfy requirements for Class A reinforced concrete moment frames. 10. Wood siding over horizontal or diagonal boards, plaster on wood or metal la, and stucco on metal la may be used to resist in-plane shear, where e walls are anchored to floors and to e floor or roof construction above such at ey can transfer e shear between floors and to e foundation. Gypsum sheaing, la, wall board, drywall, fiberboard and particle board are not permitted to resist in-plane shear unless originally designed in accordance wi 780 CMR for at purpose Add ese exceptions to Item Add subsection: Exceptions: CMR using 50% of prescribed forces when directed here by section CMR using eier a. 50 % of prescribed forces when directed here by section and when e vertical addition increases e building area less an or equal to 30% or, b. 75% of prescribed forces when directed here by section and when e vertical addition increases e building area more an 30% but less an 50% Cumulative Effects of Alterations, Additions, or Changes of Occupancy on Structural Elements. As noted in several sections of is code, evaluation of structural elements and eir connections shall consider e cumulative effects of alterations, additions, or changes of occupancy since original construction. Exception. When structural work: 1. does not involve more an 2% of e total tributary area of horizontal framing members of any existing framed floor or roof and, 2. does not alter shear walls above e foundation and, 3. does not alter columns or diagonal braces and, 4. does not create an opening in any framed floor or roof at has an area more an 2% of e framed floor or roof and, 5. does not alter any floor or roof diaphragm and its connections such at in-plane shear resistance is reduced by more an 5% and, 6. does not remove or reconfigure lateral load resisting frames, or foundations supporting em. 4/11/ CMR - Eigh Edition - 136

PART 2 - ADMINISTRATION AND ENFORCEMENT and all sections contained wiin it, replace wi: PART 2 - ADMINISTRATION AND ENFORCEMENT. For administration and enforcement provisions refer to 780 CMR Replace two and add two definitions as follows: CODE OFFICIAL. See BUILDING OFFICIAL in 780 CMR 2.00: Definitions. COMPLIANCE ALTERNATIVE. An alternative life-safety construction feature which meets or exceeds e requirements or intent of a specific provision of 780 CMR. The building official is auorized to approve or disapprove compliance alternatives. Compliance alternatives are allowed only for existing buildings. HOUSE MUSEUM. A house museum is an historic building or structure. The principal use of such must be as an exhibit of e building or e structure itself which is open to e public not less an 12 days per year, alough additional uses, original and/or ancillary to e principal use shall be permitted wiin e same building up to maximum of 40% of e gross floor area. All entries into e house museum list shall be certified by e Massachusetts Historical Commission. The list can be found at REGISTERED DESIGN PROFESSIONAL IN RESPONSIBLE CHARGE. REGISTERED DESIGN PROFESSIONAL in 780 CMR 2.00: Definitions. Compliance wi is section is required where e work area exceeds 50% of e aggregate area of e building Wall Anchors for Concrete and Masonry Buildings. For any building assigned to Seismic Design Category B, C, D, E or F wi a structural system consisting of concrete or reinforced masonry walls wi flexible roof or floor diaphragms or unreinforced masonry walls wi any type of roof or floor diaphragm, e alteration work shall include installation of wall anchors at e roof and floor levels to resist e reduced IBC-level seismic forces specified in section , unless an evaluation demonstrates compliance of existing wall anchorage Bracing for Unreinforced Masonry Parapets. Parapets constructed of unreinforced masonry in buildings assigned to Seismic Design Category B, C, D, E or F shall have bracing installed as needed to resist e reduced IBC-level seismic forces specified in section , unless an evaluation demonstrates compliance of such items. Parapet corrective work shall be performed in conjunction wi e installation of tension roof anchors. The minimum height of a parapet above any wall anchor shall be 12 inches. Exception: If e maximum height of an unbraced unreinforced masonry parapet above e lower of eier e level of tension anchors or e roof sheaing does not exceed a height-to-ickness ratio of 2.5, en bracing is not required. 4/11/ CMR - Eigh Edition - 137

Where roofing materials are removed from e entire roof diaphragm of a building located where e basic wind speed is 115 mph or greater and e occupancy category is type IV as defined in Table of 780 CMR, roof diaphragms and connections at are part of e main wind-force resisting system shall be evaluated for e wind loads specified in 780 CMR, including wind uplift. If e diaphragms and connections in eir current condition do not comply wi ose wind provisions, ey shall be replaced or strengened in accordance wi e loads specified in 780 CMR Replace e exception as follows: Exception. Buildings in which e reconfiguration is exclusively e result of compliance wi e accessibility requirements of e Architectural Access Board at 521 CMR Add is exception: Exception. R-2 structures of ree units, undergoing Level 2 renovations, are exempt from e requirements of is section provided at: 1. The work area is on a single unit and, 2. It is e intent of is chapter to provide means for e preservation of historic buildings as certified by e Massachusetts Historical Commission. There is no obligation for owners of historic buildings to use e provisions of is chapter. This chapter shall preempt all oer regulations of 780 CMR governing e reconstruction, renovation, alteration, change of use and occupancy, repair, maintenance and additions for e conformity of historic buildings and structures to 780 CMR, wi e exception of 780 CMR, section 113 for appeals, or unless oerwise specified. In case of fire or oer casualty to a historic building, said building may be rebuilt, in total or in part, using such techniques and materials as are necessary to restore it to its original condition and use group. If a building or structure as a result of proposed work would become eligible for certification as a historic building and e Massachusetts Historical Commission so certifies by affidavit, and such affidavit is submitted to e building official wi e permit application, en e building official shall have e auority to allow e work to proceed under e provisions of is chapter Replace all references to 'museum' wi 'house museum' Add a second paragraph as follows: Where one or more floors of a house museum are limited to one means of egress, e occupancy load shall be computed as follows: 1. Floors below e First Story. Not more an one occupant per 100 square feet of gross floor area wi a maximum occupancy of First Story. Not more an one occupant per 50 square feet of gross floor area. 3. Second Story and Above. Not more an one occupant per 100 square feet of gross floor area, or 30 occupants per 22 inch unit of egress wid, whichever condition results in e lesser occupancy load Replace as follows: Fire Protection Equipment. Fire protection equipment shall be provided for house museums according to e following requirements: 1. Manual Fire Extinguishing Equipment. All use groups, oer an R-3 and R-4, shall have approved manual fire extinguishing equipment, as determined by e head of e local fire department. 2. Fire Alarm Systems. Use groups R-1, R-2 and R-3 shall conform to e requirements of 780 CMR 907, as applicable. All oer use groups shall comply wi section items 2.(a) and (b). (a) Locations. Provide smoke detectors in accordance wi manufacturers listing and spacing requirements, but not less an one, for every 1200 square feet of floor area per level. In addition, all lobbies, common corridors, hallways and exitway access and discharge routes shall be provided wi approved smoke detectors installed in accordance wi e manufacturers listing and spacing requirements but not more an 30 feet spacing between detectors. All required smoke detectors shall have an alarm audible roughout e structure or building. (b) Single Station and Multiple Station Smoke Detection Devices. As required by 780 CMR 9.00: Fire Protection Systems. 4/11/ CMR - Eigh Edition - 140
9 3. Manual Pull Stations. A manual fire alarm pull station shall be provided in e natural pa of egress in all use groups except R-3 and R-4. Manual pull stations shall be connected to e building fire warning system in conformance wi NFPA 72. Exception. House museums which are provided wi an approved automatic fire-extinguishing system roughout shall not be required to be provided wi manual fire extinguishing equipment. Smoke detection devices shall not be required in occupancies oer an Use Groups R-1, R-2, and R Supervision. Fire alarm systems required by is section shall be supervised in accordance wi e requirements 780 CMR 9.00: Fire Protection Systems. Exception. Residential single and multiple station smoke detectors Add a second exception as follows: Exceptions 2. House museums need not comply wi e wind load and seismic load requirements of is code Delete e first sentence of is section Add section: Peer Review. At e discretion of e building official, e owner shall engage a registered design professional to review e performance compliance evaluation and meodologies proposed to determine compliance wi is section. The registered design professional shall prepare a written report to e building official summarizing e results of eir review. Items identified by e registered design professional as needing modification in order to be in compliance wi is section shall be addressed to e satisfaction of e building official prior to e issuance of a building permit Add note as follows: Note. Automatic sprinklers required by M.G.L. c G need not be considered "Required sprinklers" for e purposes of is section Add two notes at e end of is section: Add section: Note 1. As applicable, Department of Environmental Protection (DEP) Regulations, 310 CMR 7.09: U: Dust, Odor, Construction and Demolition, and e requirements of M.G.L. c A, addressing disposal of demolition debris, must be satisfied. Note 2. As applicable, 527 CMR, in conjunction wi M.G.L. c A must be satisfied if fire protection systems are to be dismantled, shut-off, or modified Removal of Waste Material. Material shall not be dropped by gravity or rown outside e exterior walls of a building during demolition or erection, chutes shall be provided for e removal of such materials. Where e removal of any material will cause an excessive amount of dust, such material shall be wet down to prevent e creation of a nuisance. Exception.
