On appeal the governing body or the district court as the case may be shall consider whether the commission has exercised its powers and followed the guidelines established by the law and ordinance, and whether the commission's action was patently arbitrary or capricious.

14 Local Historic Preservation Ordinance Municipal Code Chapter 58 Rules shall include: 1983 or later revised edition of the Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings Additional design guidelines, standards and criteria for reviewing and approving applications for certificates of appropriateness Design Guidelines, Standards and Criteria: Shall be approved by the City Council Shall be copied and made available to property owners within each historic district

Where the severity of deterioration requires replacement of a distinctive feature, the new feature will match the old in design, color, texture, and, where possible, materials. Replacement of missing features will be substantiated by documentary and physical evidence.

19 NPS - Preservation Brief #16 - The Use of Substitute Materials on Historic Building Exteriors In order to provide an appearance that is compatible with the historic material, the new material should match the details and craftsmanship of the original as well as the color, surface texture, surface reflectivity and finish of the original material. The closer an element is to the viewer, the more closely the material and craftsmanship must match the original.
