CFR of all Gramsabhas in PESA area Recognize CFR of all Gramsabhas in PESA area or in Forest or Forestfrinze area without demanding claims Govt. should take responsibility to prepare all necessary documents for Recognition of Community Forest Rights of all Gramsabhs under sec.3(1) of FRA 2006 within one month from notification in Govt. gazette and put before concerned Gramsabha for their sanction. Gramsabha may verify or modify the proposal and sanction or reject it and sent to SDO level committee for further procedure or correction.

5 3 rd.jfm Offer JFM to Gramsabhas who are not covered under FRA or IFA only. Create a clear and transparent financial procedure for sharing of account and money received by sale of forest produce. Amount of due share shall be separated and deposited immediately in bank accounts of JFMC. Copy of accounts should be given to JFMC for verification and for correction if any.

6 Basic Unit of Governance Gramsabha or Mohallasabha Defination of Gramsabha or Mohallasabha: A basic non- representative decision making general body,unit of governance of total 150 to 300 nearby living all voters of the village, tola, pada, vadi, palli, hamlet in rural area and mohalla in urban area.

7 Make necessary amendments for the same definition of Gramsabha and Mohallasabha in all central & state Acts &Rules FRA 2006 & Rules IFA 1927 & Rules Biological Diversity Act 2002 & Rules NREGA & Rules Panchayat Raj Act & Rules PESA & Rules Nagar Raj Bill & Rules And all concerned Acts and Rules

8 Proof by existing good Govt. practice Maharashtra Govt. accepted above mentioned definition of gramsabha in principle while formation of Forest Right Committee under FRA in Mendha (Lekha) village having total 227 (Male 107 & Female 120) voters and in other similar many revenue villages in Maharashtra. Lower limit of 150 and upper limit of 300 voters proved practically good basic non-representative unit of participatory direct democratic governance in Mendha(Lekha).

9 Representative units above Gram & Mohalla Gram Panchayat or Ward Panchayat: One representative elected for each 50 voters by Gramsabha or Mohallasabha for Gram Panchayat or Ward Panchayat. 33 % women representation is binding Proportionate representation of each cast and religion is binding.

10 No conflict in basic unit Gramsabha or Mohallasabha shall be the Community Forest Management Committee Village Forest Management Committee Village or Mohalla Biodiversity Management Committee Village or Mohalla Watershed Management Committee Village or Mohalla Emp. Garr. Committee JFMC

11 Good Governance -1 Take all decisions in Gramsabha & Mohallasabha with consensus after necessary study & research by local people. Rules will be made by concerned Gramsabha & Mohallasabha that is concerned committee. Govt. can issue guidelines and directives only. All concerned Govt. departments and officers shall help Gramsabha & Mohallasabha only on their demand. Working Plan sanctioned by Gramsabha or Mohallasabha for their area shall be incorporated in govt. plan, as it is.

12 Good Governance-2 Planning & Implementation by Gramsabha or Mohallasabha that is concerned committee. Money should be given to Gramsabha or Mohallasabha directly. 10 % amount of total budget should be given extra by Govt. as untied grant (learn from Nagaland Experience). 10 % of total land should be maintained as Biodiversity Reserve of & by Gramsabha or Mohallasabha(learn from traditional Sacred Groves ).
