1 STATE OF TEXAS COUNTY OF DENTON TOWN OF DOUBLE OAK The met in regular session at 7:00 p.m. at the Double Oak Town Hall, located at 320 Waketon Road with the following members present to-wit: Mike Donnelly Mayor Andrew Wills Mayor Pro-Tem Scott Whisenhunt Deputy Mayor Pro-Tem Anita Nelson Joe Dent Ginger Brittain Also in attendance were Town Attorney David Berman, Town Secretary Charlotte Allen and Assistant Town Secretary Eileen Kennedy Mayor Donnelly called the meeting to order at 7:02 p.m. Mayor Pro-Tem Wills gave the invocation Nelson led the pledge of allegiance Mayor Donnelly asked for a moment of silence for the Fort Worth Police Officer who had lost his life in the line of duty II. CONSENT AGENDA As no items were listed on the Consent Agenda it was passed in the agenda order III. CITIZENS COMMENTS Ms. Deborah Rothermel, 540 Waketon Road, commented: The proposed widening of Waketon Road was a debacle This was a residential street not a thorofare for the benefit of Flower Mound She was not arguing that it was not needed The method the engineering firm had looked at was a complete debacle Again, engineers had an 8-foot wide sidewalk on the south side, which was her side, which was going to run 1 block and destroy every tree on the front of her property The way that their plan goes now, they re going to destroy everything She had met with Charlie and the engineer out there 3 times revising the plans She had been appalled at the lack of knowledge by the engineer

2 Page 2 They had no knowledge of city law they didn t even know that I was required to maintain the right-of-way by state law They did not know you can t take 10-feet on one side of the easement and 30-feet on the other side of the easement which is what they re doing now This is my 4 th rodeo with cities about aligning streets with my property I don t mind the widening but the widening on my side is only going to run 1 block The other sidewalks in Flower Mound are 4 feet wide mine is 8 feet wide The neighbors have banded into a coalition to figure what they re going to do They are offering us $10 for our easements which is not enough They want to take 1-acre of my property for $20 I don t think so The plans now say they re going to take it as a right-of-way If they do that. by law I can t put anything on it so it is basically rendered useless There is a prescriptive right-of-way which goes to the middle of Waketon The drainage plan that they have will virtually kill every tree that is there IV. Public Works and Code Enforcement Mayor Donnelly reported: There had been a few complaints regarding tall grass and weeds The Whispering Oaks project was completed 3. Administration no report was given 4. Public Safety Police Chief Watson reported: a replacement police officer candidate had been interviewed background investigation was being run and it was hoped he would be on-board soon 5. Road and Drainage Committee no report was given V. NEW BUSINESS AGENDA (CONSIDERATION AND ACTION): Mayor Donnelly moved agenda item 10 forward in the agenda order. 10. SECOND PUBLIC HEARING ON A PROPOSAL TO INCREASE TOTAL TAX REVENUES FROM PROPERTIES ON THE TAX ROLL IN THE PRECEDING TAX YEAR

PUBLIC HEARING TO CONSIDER AND ACT ON AMENDING THE COMPREHENSIVE ZONING ORDINANCE, EXHIBIT A OF ARTICLE ( ZONING ORDINANCE ADOPTED ) OF CHAPTER 14 ( ZONING ), TO ADD A NEW SECTION 11A AND A NEW RESIDENTIAL ZONING DISTRICT TO BE ENTITLED RE-2 RANCH ESTATES 2, PROVIDING A NEW ZONING CATEGORY FOR LOT SIZES OF AT LEAST 2 ACRES AND ADDITIONAL REGULATIONS FOR PROPERTY WITHIN THE RE-2 RANCH ESTATES 2 DISTRICT Mayor Donnelly opened the public hearing at 7:15 p.m. No one spoke in favor or opposition Mayor Donnelly closed the public hearing at 7:17 p.m. 7. PUBLIC HEARING TO CONSIDER AND ACT UPON THE REQUEST FROM DREW WALLING ON BEHALF OF GENARA HILLPOT TO REZONE THE PROPERTY LOCATED AT 5900 PEPPERPORT FROM AGRICULTURAL-1 (AG-1) TO RANCH ESTATES (RE), REVIEW A PRELIMINARY DEVELOPMENT PLAN, REPLAT 9.12 ACRES IN THE NORTH SHILOH ADDN BLK TR 5 (NE PT) TO SEVEN 1 ACRE MINIMUM LOTS Mayor Donnelly opened the public hearing at 7:20 p.m.

4 Page 4 Mr. Drew Walling, 230 Kings Road, the applicant, stated: This was a preliminary plat for property at 5900 Pepperport, currently a 9-acre tract with a single home on it They were looking to create 6 new individual 1-acre lots from the current 9.12 acre parcel Ingress and egress would be via a dead-end street with a cul-de-sac at the end which would not be connected to any other major thoroughfare Kings Road, etc. Anticipated size of the home size to to 3700 square feet with the hill country modern theme H was seeking approval of the rezone and replat of 5900 Pepperport Mr. John Downey, 6000 Pepperport, spoke in opposition stating: He was asking the Council deny the request The country feel of the neighborhood would be lost The Planning and Zoning Commission had denied this the first time Moving to 1-acre lots would destroy the country feel Ms. Carol Wright, 6108 Pepporport, spoke in opposition stating: If 6 houses were put there it would double the traffic problem Plus there would be construction traffic It didn t fit their street There were traffic and safety issues Mr. Kevin Kuster, 6100 Pepporport, also spoke in opposition Mayor Donnelly closed the public hearing at 7:36 p.m. 9.
