(Olson) 7. Consider and act upon topics to be scheduled for a future Planning & Zoning Commission meeting. The Planning & Zoning Commission is not permitted to take action on or engage in any discussion regarding an item not listed on the agenda. However, this agenda item provides an opportunity for any member of the Planning & Zoning Commission to propose that a topic be scheduled for a future meeting. Upon an item being proposed for discussion, the Planning & Zoning Commission will vote to determine its collective desire to schedule the item for discussion and/or action at a future meeting. A majority vote of the Planning & Zoning Commission is required to schedule an item for discussion and/or action at a future meeting. 8. Adjourn. Consider and act upon the minutes from the December 5, 2017 regular meeting of the Planning & Zoning Commission. (Bockes) Vice Chairperson Meek had minor changes that were updated before the meeting. John Lusk asked that the minutes be amended to reflect that Chairperson Collins did not vote on the Lilly comp plan amendment or the Lilly tract rezoning items on December 5, Commissioner Stafford motioned to approve the minutes of the December 5, 2017 Planning & Zoning meeting with corrections; motion seconded by Vice Chairperson Meek. Motion passed with a vote of 6-0 with Chairperson Collins not voting on the item. 4. Discuss and act upon a Preliminary Plat of the FM 720 Storage Addition (Yellow Door Storage), containing one 3.86 acre tract of land situated in the Marcella Jones Survey, Abstract No. 662, in the City of Oak Point s Extra Territorial Jurisdiction (ETJ), Denton County, Texas. Luke Olson, City Manager, provided a brief presentation of a preliminary plat located outside City limits for the FM 720 storage addition located just between Lloyds Road and the future Martop Regular Meeting of the Oak Point Planning & Zoning Commission Tuesday, January 2, 2018 Page 1 of 3

3 expansion including a 3.86 acre tract of land. The property is located in the City s ETJ and therefore the only regulations by the City are the platting and subdivision regulations. City staff recommended approval of the preliminary plat and stated that the final plat would be presented at the February meeting. Commissioners had questions about the size of the development. Steven Homeyer, engineer for applicant, discussed the size and estimated time to start construction. Commissioner Boler motioned that the Planning & Zoning Commission vote to recommend that the City Council approve a preliminary plat of the FM 720 Storage Addition (Yellow Door Storage), consisting of a 3.86 acre tract of land situated in the Marcella Jones Survey, Abstract No. 662, in the City of Oak Point s Extraterritorial Jurisdiction (ETJ), Denton County, Texas; motion seconded by Commissioner Buttermark. Motion passed with a vote or 6-0. Chairperson Collins did not vote on this item. 5. Conduct a public hearing, discuss, and act upon a request to rezone approximately acres generally located at the northwest corner of McCormick Road and F.M. 720 from Ranch Residential (RE-5) to Planned Development-Community Commercial (PD-CC). Luke Olson, City Manager, presented a request to rezone an approximately tract of land located on the northwest corner of FM 720 and McCormick from RE-5 to PD-CC. The property is currently zoned for 5 acre minimum residential lots, however, the comp plan/future land use plan shows the property as community commercial. The applicant was asking to rezone the property for future commercial development. The PD standards would be the same as other commercial properties located on the other 3 corners of FM 720 and McCormick/Shahan Prairie, with the exception of the Rudman tract which includes garden homes. The notice of public hearing was published in the Little Elm Journal on Friday, December 15 th and public hearing notices were mailed to the property owners within 500 feet on Friday, December 22. As of Friday, December 29 th no reply forms had been received by City staff. City staff recommended approval of the request. Chairperson Collins asked why there wasn t anything stating that electric charging stations are approved. He felt this would be an option that might need to be considered. Chairperson Collins opened the public hearing at 6:19 p.m. The engineers for the applicant were present for any questions. They stated that if the Commissioners wanted to add the electric charging station it could be a condition of approval and they would be fine with that. No one else wished to speak. Chairperson Collins closed the public hearing at 6:21 p.m. Vice Chairperson Meek stated that there was no opposition to the request; that it did not amend the current comp plan; and that the zoning change was anticipated. Vice Chairperson Meek motioned that the Planning & Zoning Commission vote to recommend that the City Council approve a request to rezone approximately acres generally located at the northwest corner of FM 720 and McCormick Road from Ranch Residential (RE-5) to Planned Regular Meeting of the Oak Point Planning & Zoning Commission Tuesday, January 2, 2018 Page 2 of 3

4 Development-Community Commercial (PD-CC); motion seconded by Commissioner Burke. Motion passed with a vote of 6-1. Ayes: Boler, Burke, Buttermark, Collins, Meek, Stafford. Nos: Tremblay. 6. Provide a brief overview of the Comprehensive Plan and process for updating the overall plan. Luke Olson, City Manager, provided a brief overview of the process to amend the comprehensive plan and the make-up of the committee to do so. Commissioners wanted to make sure City staff got started on the process as soon as possible. City staff advised that Council directed staff to do an RFQ for a company to facilitate the comp plan update and then work on the compilation of a board and a timeline. 7. Review and discuss the monthly Zoning and Development Activity Report for January, (Olson) Luke Olson, City Manager, provided an overview of the January Zoning and Development Activity report including the continuance of the Lilly Tract items to the 1/15/18 City Council Meeting. 8. Discuss and provide direction on any future agenda items. (Olson) Staff stated the final plat for the FM 720 Storage addition and a site plan for the Prairie Oaks amenity center would be on the February agenda, and potentially plats for Wildridge. No other items were discussed. 9. Adjourn. Commissioner Stafford motioned to adjourn; motion seconded by Commissioner Tremblay. Motion passed with a vote of 7-0. 5 To: From: Re: Planning & Zoning Commission Luke Olson, City Manager Final Plat-FM 720 Storage Addition (ETJ) Date: February 6, 2018 Agenda Item: Discuss and act upon a Final Plat for the Yellow Door Storage FM 720 Addition, a 3.86 acre tract of land being situated in the Marcella Jones Survey, Abstract No. 662, in the City of Oak Point s Extra-Territorial Jurisdiction (ETJ), Denton County, Texas, more commonly known as 3407 W. FM 720. The property is located east of FM 720 between the future Martop Road and Lloyds Road. Description of Agenda Item: The subject property is located outside of the City limits in the City s extraterritorial jurisdiction (ETJ). The ETJ is the unincorporated area within a certain distance of a city s boundary (generally ½ mile in Oak Point s case) that is not within the city limits or ETJ of another city. While properties located in a city s ETJ are anticipated to be annexed into the associated city at some time in the future, a city may exercise only limited control over properties within their ETJ. Generally, only a city s subdivision regulations and sign regulations may be extended to their ETJ. Under certain conditions, a city may annex the property in its ETJ. However, as a general law city (less than 5,000 in population), the City of Oak Point is unable to involuntarily annex properties. Building Standards Denton County typically regulates the construction of the structures located outside of the City limits. Access The storage facility will have access from FM 720. Preliminary Utility Plans Preliminary civil construction plans including water, wastewater, and drainage plans were submitted. The City Engineer has reviewed and recommended that the documents be revised and resubmitted. Water service will be provided by the Mustang Special Utility District. Approval of the plat should be contingent upon the approval of the preliminary utility plans by Agenda Item No. 4 Page 1 of 7

6 the Mustang Special Utility District and TxDOT and resubmitted plans to the City engineer with revisions. Budget Impact: Approval of the Yellow Door Storage preliminary plat will ultimately lead to the development of a storage facility in the City s ETJ. Sales tax generated by the business will be paid to the City of Oak Point and the Oak Point Municipal Development District. City staff has no budgetary concerns related to the approval of the plat. Legal Obligations and Review: While the approval of zoning is discretionary, the approval of plats is ministerial. Therefore, if a property owner submits a plat that meets or exceeds the minimum development standards and requirements, the Planning & Zoning Commission and City Council have an obligation to approve the plat. Based on City staff s review of the plat, it appears that the plat is also compliant with the City s subdivision regulations. The preliminary plat was approved at both the P&Z Meeting and City Council Meeting in January Board, Committee and/or Staff Recommendation: City staff recommends that the Planning & Zoning Commission recommend that the City Council approve a final plat for the Yellow Door FM 720 Storage Addition consisting of a acre tract of land being situated in the Marsella Jones Survey, Abstract No. 662, in the City of Oak Point s Extra-Territorial Jurisdiction (ETJ), Denton County, Texas subject to: 1. Compliance with the Subdivision Regulations that regulate development of this property; 2. Compliance with all engineering requirements and comments provided to the applicant by the City Engineer; and 3. Approval of the utility plans by Mustang Special Utility District and TxDOT. Olson, City Manager Prairie Oaks-Amenity Center Site Plan Date: February 6, 2018 Agenda Item: Discuss and act upon a Site Plan of the Prairie Oaks Public Improvement District Amenity Center, containing one HOA lot consisting of acres of land situated in the Marsella Jones Survey, Abstract No. 662, in the City of Oak Point s Extraterritorial Jurisdiction (ETJ), Denton County, Texas. Description of Agenda Item: The tract is located east of FM 720 between the future Martop expansion and Lloyds Road in the Oak Point ETJ. The proposed amenity center building is approximately 4,775 square feet on a acre lot within the Prairie Oaks Public Improvement District No. 1. Building Standards The construction of the facility will follow the 2006 series of the International Building Code and the City s local amendments, as they exist or amended at the time of submittal of building permit application. In addition, the structure will be subject to the construction standards outlined in the Development Agreement with regard to construction materials and architectural elements for non-residential development. Access The property will be accessed from Hidden Oaks Trail and will have two points of access maintained at all times to facilitate emergency response for purposes of traffic distribution. Civil Engineering/Utility Plans The civil engineering plans have been reviewed by the City Engineer and comments have been forwarded to the applicant. Water and wastewater service will be provided by Mustang Special Utility District. Because the review of the utility plans have not been completed by Mustang, approval of the site plan should be contingent upon the approval of the utility plans by Mustang Special Utility District. 13 The following development regulations are reviewed and requirements must be met or exceeded to approve the site plan: REGULATION CODE PROPOSED MEETS OR EXCEEDS Total Required Parking Required Handicap Parking 1 1 Landscaping, Tree Preservation and Screening City requirements for landscaping, tree preservation and screening are required on this property. The majority of the trees on this property will be preserved. All landscaping will adhere to the approved landscape plans submitted to the City. Outdoor lighting shall comply with the lighting and glare standards. Light spillage will not be allowed on to the residential development. The dumpster will be screened in accordance with the zoning ordinance. Budget Impact: City staff has no budgetary concerns related to the approval of the site plan. Legal Obligations and Review: The City Planner has reviewed the site plan and has approved as submitted. After review of the site plan, it appears that the site plan is also compliant with the City s regulations.
