2 SECTION 01 (Letter for submission of Tender) (To be filed by the Tenderer) Note 1. Additional conditions appended to the tender will make the tender liable for rejection. 2. Non- submission of EMD in proper shape and other required documents as deviated hereafter shall make the tender liable for rejection. Ref No.. dt. Ref: Your Tender Call Notice No.10 of Dear Sir, 1. with reference to the above I / we am/are to inform you that in response to your above referred TCN, I / we have purchased the Detailed Tender Call Notice (DTCN) vide MR No.Book No from the Office of the, RWS&S Division, Bhanjanagar and that after having thoroughly examined the same, we here by tender for the work to execute the work within the stipulated time and in conformity with the relevant clauses of the DTCN along with all related statutory rules and regulations for the amounts as quoted in the accompanying price bid. 2. I / we have studied acquainted and satisfied ourselves with the site and its working conditions for the successful and timely completion of the work. 3. I am submitting herewith the work Programme to complete work within the stipulated time. 4. Our offer is unconditional in conformity with the requirements of DTCN. We understand that any additional condition put by us in the Tender shall make out Tender liable for rejection. 2

TENDER CALL NOTICE No. 10 of ******************************************* 1.The, RWS&S Division, Bhanjanagar district Ganjam On behalf of Governor of Odisha invites bids on item rate contract for execution of the work, Fabrication and laying of G.I pipe line and fitting at site for piped water supply to village Sama & Sikula in Purusottampur Block in the District of Ganjam. in the district of Ganjam at an Estimated cost (approx.) of Rs Lakhs (Rupees Four Lakhs Fifty six thousand) only from eligible contractors of class D and class C registered with Central Government / MES / Railways / individuals / Registered firms for execution of works on production of definite proof from the appropriate authority. The agreement for execution of the said work to be eventually drawn in PWD F2 item Rate contract prescribed by Govt. of Odisha. 2. The Bid Documents for the above work will be sold in the office of the, RWS&S Division, Bhanjanagar and Assistant, RWS&S Sub-Division, Aska / Polasara during the office hours (10.00 AM to 5.00 PM) on working days from to & up-to 3.00 PM. on dtd on payment of cost of bill of quantity ( non-refundable). The tender will be received in the office of the, RWS&S Division, Bhanjanagar as well as in the office of the Assistant, RWS&S Sub-Division Aska / Polasara up to 5.00 P.M. on dtd The tender will be opened by the, in the office of the, RWS&S Division, Bhanjanagar at A.M. on dated in the presence of the bidders or their authorized representatives who wish to attend. 4.If the tender documents sent through registered / speed post do not reach in the concerned office by the above date and time, the offer will not be considered on any account even if the tender documents were dispatched by the tenderers before the due date. 5. The tender is to be submitted n sealed covers, containing EMD, signed DTCN, attested copy of registration certificate, PAN Card, valid VAT, clearance certificate, certificates duly filled in and documents required as per the relevant clauses of this DTCN and special conditions if any. The cover is to be properly sealed, the contractor can seal them with superglue and also add tamperproof tapes as additional precaution. The tenderers are not required to write their name on the outer cover containing the bid documents. They are only required to write the name of the work and authority who had issue the tender schedule. The tender should be delivered in the tender box having Bid identification No.10 of

The bid must be accompanied by EMD of the (one percent) of the estimated cost put to tender rounded to nearest hundred rupees along with tender in the form of term deposit receipt of Nationalized commercial Bank (of minimum one year tenure) / Post Office Savings Bank Account / National Savings Certificate / Postal Office Time Deposit Account (of minimum one year tenure) duly pledged in favour of, RWS&S Division, Bhanjanagar. 7. The tenders should be accompanied with the true copies of the valid Registration Certificate valid VAT clearance and PAN card which are mandatory and the original certificate are to be produced with 3(three) days after opening of the tender before, RWS&S Division, Bhanjanagar for verification otherwise his / her bid shall be declared as non-responsive and thus liable for rejection. 8. The work is to be completed in all respect within 30 days (Thirty) days from the date of issue of work order. Tenders whose tender is accepted must submit a work Programme at the time of execution of Agreement. 9. All tenders received will remain valid for a period of 90(Ninety) days from the date of opening of tenders and validity of tenders can also be extended if agreed to by the tenderers and the Department. 10. An application or any of its constituent partners of whose contract for any work has been rescinded or who has abandoned any work in the last five years, prior to the date of the bid, shall be disqualified. The tenderer is to furnish an affidavit at the time of submission of tender paper about the authentication of tender documents. 11. The contractor shall furnish a No Relation Certificate along with the tender. 12. (i) Each tenderers s to submit along with tender a note regarding experience in construction of similar nature of work. (ii) The intending bidder should furnish a statement showing the list of similar nature of works (M.S/G.I) executed so far specifying the department / organization for whom the work has been satisfactory executed indicating the year of execution and list of works in hand with necessary certificate obtained from the officer concerned not below the rank of the in the Proforma attached in the Annexure-B. (iii) Besides a list of tools and plants possessed by the tenderer shall be given in Annexure-C. 13. If the application is made by proprietary firm, it shall be signed by the proprietor above as full type written name and the full name of his firm with its current address. 14. If the application is made by a firm in partnership, it shall be signed by all the partners of the firm above their full type written names and current address, or alternatively by a partner holding power of attorney for the firm in which case a certified copy of the power of attorney shall accompany the application. A certified copy of the partnership deed and current address of all partners of the firm shall also accompany the application. 5

6 15. The tender should be strictly in accordance with the provisions as mentioned in the tender schedule. Any change in the wordings will not be accepted. 16. No tenderer will be permitted to furnish their tender in their own manuscript papers. The applicants name should appear on each page of the applications along with his signature or the signature of his authorized representatives having P.A. at the bottom of each page. 17. The tenderer shall carefully study the tentative drawings and specifications applicable to the contract and all the documents which will form part of the agreement to be entered in to by the accepted tenderer and detailed specifications for Odisha and other relevant specifications and drawings which are for sale. Complaint at future date that plans and specifications have not been seen by the tenderers cannot be entertained. 18. Every tenderer is expected before quoting his rates to inspect the site of the proposed work. He should also inspect the quarries and approach roads to quarries and satisfy himself about the quantity and availability of materials. In every case the materials must comply with the relevant specifications. Complaints at future date that the availability of materials at quarries has been misjudged will not be entertained. 19. The offer of tender shall be inclusive of cost of construction and maintenance of island, ferry service, far weather road, service road, Foot Bridge, pylon base, which stand and derrick stand etc. as required for the work. 20. The tender containing extraneous conditions not covered by the Tender Notice / DTCN are liable for rejection and quotations should be strictly in accordance with the tender call notice. Any change in the wording will not be accepted. 21. Letters etc. found in the tender box regarding raising or lowering the rates or dealing with any point in connection with the tenders will not be considered. 22. Schedule of quantities as accompanied shall be definitely understood that the Government does not accept any responsibility for the correctness or completeness of this Schedule and that this Schedule is liable for alternation or omissions, deductions or alternations, set forth the conditions of the contract and such omissions, deductions, additions or alternations shall no way invalid the contract and no extra monetary compensation will be entertained. 23. The authority reserves the right to reject any or all the tenders received without assigning any reasons thereof what-so-ever. 24. The earnest money will be retained and dealt with as per the terms and conditions of the O.P.W.D. code. 25. The bidding documents are to be properly sealed and clearly superscripted with Tender for G.I/M.S. works, 6

7 26. The tenderer quoting rates for more than one work is required to submit the bid documents separately i.e one envelope for each work with individual E.M.D. 27. The Engineering Graduates / Diploma holders having contractor license & participating in the tender without EMD must be present at the date, time & venue of opening of tender, with their original valid registration certificates, for their claim for exemption of E.M.D or else the said tender will be rejected at the spot. 28. The SC/ST Contractor desirous of availing preference should submit an attested copy of cast certificate, other wise tender will be liable for rejection. 29. Tenderers bidding for an amount of less than the estimated cost by more than 10% will have to deposit the differential cost of 90% of the estimated cost and tender value towards additional performance security deposit in favour of the, RWS&S Division, Bhanjanagar in addition to the requisite EMD along with the tender, failing which the tender will be summarily rejected Agencies having experience of successful execution of M.S/G.I. works need only apply. The experience certificate along with the list of works executed in past should be obtained from minimum the rank of Executive Engineer. 31. The tender paper if required by Mail will be despatched by registered post on payment of an extra Rs (Rupees One hundred) only (Non -refundable) towards registration charges. The undersigned will not be held responsible for the Postal delay if any for the delivery of the documents or non-receipt of the same in time. However no Tender will be received by FAX or By Conditional tenders shall be out rightly rejected., RWS&S Division, Bhanjanagar. 7

8 ANNEXURE-A DECLARATION OF TENDERER (See clause 18 & 11 of section-02) (To be signed by the tenderer) A 1. I/ We have visited the site and have fully acquainted with the local situation regarding the materials, labour etc. and the external factors expected to influence the progress or to the work before submitting the tender. 2. I / We have carefully studied the conditions of the contract specifications and other documents of this work and agree to execute the same accordingly. 3. I /We solemnly pledge that I / We shall be sincere in discharging my / our duties as responsible contractor and complete the work within the prescribed time limit. In case there are deviations from the constructions Programme, I shall abide by the decision of the engineer-in-charge for revision of the Programme and arrange for the labour, materials, equipments etc. accordingly. 4. In the event of award of the work to me / us, I /We undertake the entire responsibility for the structural stability to reconstruct / replace the whole or part of the component of the structure in the event of failure or in proper functioning within a period of 1 year from the date of testing. B. CERTIFICATE OF NO-RELATIONSHIP I / We here by certified that I / We am / are related / not related to any officer of RWS&S Division, Bhanjanagar in the rank of Junior Engineer and above. If the facts subsequently proved to be false, my / our contract will be rescinded with for forfeiture of EMD. Signature of the tenderer 8

The tender shall be accompanied by EMD for the amount as mentioned in the above table in shape of NSC / Postal saving pass books / one years Term Deposit receipt from any Nationalized Bank/ one Years Post Office term Deposit Account duly pledged in favour of the, R.W.S & S Division, Bhanjanagar. The tenders with part EMD / without EMD /unpledged EMD is liable for rejection. 8. Minimum one year Experience certificate form the rank of or equivalent officer of Govt. in execution of MS works must be accompanied with tenders for all the works or else the tender will be liable for rejection. 9. Conditional tenders shall be out rightly rejected. 10. Attested copies of valid VATCC, Pan Card, Labour contract license shall be furnished along with the tender.

14 11. The tenderer has to sign on each page of bid document with seal. Cutting / Overwriting / Correction if any should be initialed by the tenderer. 12. The tenderer has to submit No Relationship Certificate along with the tender. 13. The bidder has to produce an affidavit in support of the authenticity of the documents should be attached with the bid. 14. The DTCN for the above work will be sold in the office of the, R.W.S & S Division, Bhanjanagar & Assistant Engineer, R.W.S & S Sub-Division, Aska / Polasara during the office hours on working days from dt to and upto 3.00AM on dt on payment of cost of bill of quantity (non-refundable). 15. The Tenders will be received in office of the, R.W.S & S Division, Bhanjanagar as well as in the office of Asst. Engineer, R.W.S & S Sub-Division, Aska / Polasara on dt upto 5.00PM by person or through speed post / registered post and the same will be opened on dt at AM in the office of the E.E. R.W.S & S Division. Bhanjanagar in presence of the tenderer or their authorized representatives who ever may be present. Tender received after due date and time shall not be entertained and the authority shall not be held responsible for delay or missing of the tender during postal transit. Telegraphic tender or tenders by / fax shall not be entertained. If the office happens to be closed on date of receipt and opening of this tender specified, the tender will be received & opened on the next working day at the same time & venue. 16. Agencies having experience of successful execution of G.I. works need only apply. The experience certificate along with the list of works executed in past should be obtained from minimum the rank of or equivalent. 17. The tender paper if required by Mail will be despatched by registered post on payment of an extra Rs (Rupees One hundred) only (Non-refundable) towards registration charges. The undersigned will not be held responsible for the Postal delay, if any for the delivery of the documents or non-receipt of the same in time.
