1 City Council Regular Meeting Tuesday, April 26, :30 PM MINUTES Mayor Dale Massad called the meeting to order at 7:30 P.M. The invocation was given by Reverend Sandra Spaldi, Chapel of the divine spirit. The Pledge of Allegiance was recited. The roll was called. Mayor Dale Massad, Vice Mayor Terrence Rowe, Councilwoman Nancy Britton, Councilman William Dittmer, Councilwoman Jennie Sorrell, City Attorney Joseph Poblick, and City Manager Tom O Neill were present. APPROVE COUNCIL MINUTES Regular City Council meeting minutes of April 13, 2016 Swearing-In Ceremony minutes of April 18, 2016 Councilman Rowe made a motion to approve. Councilwoman Sorrell seconded the motion. All were in favor. ANNOUNCEMENTS There were no announcements. COMMENTS FROM THE GENERAL PUBLIC Thomas Brown Candlelight Ct. - Spoke with regard to Lake Cox and aerial views from 1974 in which he believed showed that Lake Cox was already existing. Mayor Massad advised the Planning and Zoning Board would be looking at the matter and there could be changes. Pastor Leonard Lord Leo Kidd Ave. - Welcomed new Council members. He spoke briefly about the up-coming backpack orders and thanked everyone for their support. Eric Suojanen Treadway Ave. - Welcomed the new Council members. He thanked the Council for putting the issue of dogs in restaurants on the agenda. COMMENTS FROM THE MAYOR & CITY COUNCIL Vice Mayor Rowe welcomed the new Council members. He stated that he was looking forward to working with everyone. Councilwoman Britton welcomed the new Council members and said that she too was looking forward to working together and apologized for not being able to attend. She thanked Pastor Lord for all that he does for the City. 1. CONSENT AGENDA Page 1/6 CCM 4/26/2016 Minutes
2 A. $ 23, Payroll Taxes for March 28, 2016 to April 10, 2016 B. $ 24, Florida Blue for May 2016 Employee Health Insurance C. $ 13, City of New Port Richey - Broadway Water for March 2016 D. $ 35, City of New Port Richey - Limit Dr. Sewer for March 2016 E. $ 20, City of New Port Richey - Limit Dr. Water for March 2016 F. $ 14, City of New Port Richey - Congress and Pine Hill Water for March 2016 Mayor Massad made a brief comment on the cost to purchase water as listed on the Consent Agenda. City Manager O'Neill advised that the costs are for bulk water meters and sewer and advised that the cost for the water from New Port Richey is less than purchasing from Pasco County. Vice Mayor Rowe made a motion to approve. Councilman Dittmer seconded the motion. All were in favor. 2. COTEE RIVER SINGLE FAMILY HOME DEVELOPMENT City Manager O'Neill advised Council that Mr. Yepes could not attend this evening's Council meeting and that they could table this item if they chose to do so. Mayor Massad confirmed that the project was completely permitted. Vice Mayor Rowe stated that the project was permitted and had expired and been brought back to Council to be re-approved. City Manager O'Neill advised that the original PUD called for 178 town homes. The developments stalled and the new owner wanted single family homes. The PUD did expire but had been reconsidered and approved last November. Mayor Massad felt that $25, was not a lot of money. Councilman Dittmer stated that the developer could simply use the trails on the property and not pay the City anything at all. City Manager O'Neill advised that the one acre park requirement inside the development does not have to have park amenities. He liked the idea of the money so that the City could use the money elsewhere, where funding was lacking. Councilwoman Britton felt the City should move forward as the developer is taking interest in the City. She felt the City should accept the money and let the developer move forward. Mayor Massad felt that the City would be selling itself short. There was additional brief discussion on accepting the $25, Vice Mayor Rowe made a motion to table this item until the next meeting. Councilwoman Jennie Sorrell seconded the motion. All were in favor. 3. PRESENTATION BY PASCO COUNTY ANIMAL CONTROL SERVICES City Manager O'Neill advised Council that the staff of Pasco County Animal Control were present this evening to provide a presentation on services. The City is currently under contract Page 2/6 CCM 4/26/2016 Minutes
3 with Pasco County Animal Control services. The current contract is $13, per year. Mr. Robert Schumaker - Shelter Director, Pasco County Animal Control - provided the Council with a Powerpoint presentation. The following items were highlighted in the presentation: * Spay/Neuter and educational funding. * Contract termination with Spay Pasco * Ordinance revision of Chapter 14 (animals) * Fee schedule changes Mayor Massad asked if the County understood that the City of Port Richey does not include the entire area code based on the contract cost. Mr. Schumaker said that they did understand. City Manager O'Neill advised that the cost of the contract is based on the City's population. Mayor Massad asked how much it was to adopt. Mr. Schucmaker advised that it was $70.00 to adopt a dog and that is complete with microchipping. Councilwoman Spoke briefly on wildlife issues and trapping stray animals and risks to the citizens as well as low income services. Councilman Rowe thanked Mr. Schumaker for coming out and asked if Animal Control has anyone working on the weekend. Mr. Schumaker advised that animal services is on call 24/7 however they usually only go out on night or weekend calls for aggressive animals. 4. DISCUSSION OF NICKS PARK PARKING FEE Prior to the start of this agenda item, Captain William Ferguson presented a City Flag to City Manager Tom O'Neill for all the work and time he has put in to the City. Mayor Massad stated that the City keeps up with the Nicks Park ramp and the people who utilize it the most live in County's jurisdiction. City Manager O'Neill advised that he recommends Council put a kiosk in a Nicks Park and use the money for the maintenance of the park. Many of the local parks charge for parking and most people are outside the City that use the Park. Vice Mayor Rowe said he was concerned that the Nicks Family may not want this for the park. City Manager Massad said he was going to see Mrs. Mallet and speak to her about this. Vice Mayor Rowe stated that the honor system kiosk would need monitoring and a decision made for who would handle the money. Councilwoman Britton said there was a potential to make $155 per day on the weekends alone. Councilman Dittmer stated the City could use the $25, from the developer (earlier in the agenda) to pay for the kiosk. The police will still need to go out and address illegal parking and those who do not pay. Page 3/6 CCM 4/26/2016 Minutes
4 Joel Smith - Candlelight Ct. - stated that most boat launches are a $10.00 fee with the exception of handicapped parking which there is no charge. Pastor Leonard Lord Leo Kidd Ave. - stated that Anclote Park and Hudson Beach are $5.00. Sandra Spaldi Old Post Rd. - She stated that she believed the county had something to do with the park and the City should crawl before running in to this. Kristen Tonkin Sunset Blvd. - She felt it was a great idea to charge for parking and spoke of some of the kiosks she had done some research on that use the honor system. Eric Suojanen Treadway Dr. - Felt it was irresponsible not to charge. People do expect to pay and its really not many of the locals who are using the boat launch. He did not feel choosing a cheap kiosk was necessarily the way to go. He felt the City should get progressive and make a statement. City Manager O'Neill advised that the fees would need to be the same for everyone. Mayor Massad felt the City should go forward with a kiosk. City Manager O'Neill advised Council that they would need to authorize the City Attorney to draft an ordinance for fees and illegal parking. Then the staff would need to obtain an actual cost and bring the matter back to Council. There was a Council consensus to have the City Attorney draft and ordinance and have kiosk costs brought back to Council at a later meeting. 5. DISCUSSION OF FEATHER FLAG REGULATION Mayor Massad said the main question for this item was how big should the feather flags be, how frequently can the businesses display them and how many. City Manager O'Neill said it would be a good item to send to the Planning and Zoning Board. He felt they would provide valuable insight. Councilman Dittmer said he has them for his business which is in New Port Richey and removes them every night at closing. They are about feet tall. The ones he has are expandable. Vice Mayor Rowe felt this item should start with the Planning and Zoning Board. Councilwoman Britton agreed with Vice Mayor Rowe. She confirmed that this would be for commercial properties only. City Manager O'Neill advised that it would be limited to commercial properties and that would be stated in the ordinance. Kristen Tonkin 5115 Sunset Blvd. - stated that the businesses wanted to talk about additional signage but had complained that code enforcement had been taking down signs. Sandra Spaldi Old Post Rd. - asked what happened to all the plans of lights and landscaping in the Waterfront District. 5 many. There was Council consensus that the Feather Flags would go to the Planning and Zoning Board for discussion and recommendation to Council. 6. DISCUSSION OF DOGS IN RESTAURANTS Mayor Massad said he was very much in favor of having dogs at restaurants, outside. Councilwoman Britton was all for it if that was what the business owner wanted. Vice Mayor Rowe said that the Health Department regulations were cut and dry and he was all for dogs being able to be at restaurants, outside. Mayor Massad said there would need to be set rules for outside the business only. Claudia Smith Candlelight Ct. - advised Council that she had recently visited New Smyrna Beach and they are a very dog friendly city. They cater a great deal to pet owners. She felt it was a great selling point for restaurants. Sandra Spaldo Old Post Rd. - Said she was all for it as long as the business owner was responsible. Vice Mayor Rowe made a motion to approve the City Attorney to create a draft ordinance to allow dogs at restaurants. Councilman Dittmer seconded the motion. All were in favor. 7. RECLAIMED WATER Councilman Dittmer asked how many water main breaks there had been within the last 6 months. City Manager O'Neill advised that he would estimate that there had been water main breaks within the last 6 months. There was a brief discussion between Council on the reclaimed water and concerns were voiced that there still was not enough information to be sure that it would be safe. Vice Mayor Rowe made a motion to rescind the previous decision to approve the reclaimed water contract with SWFWMD. Councilwoman Sorrell seconded the motion. All were in favor with the exception of Councilwoman Britton who voted nay. Sandra Spaldi Old Post Rd. - said that it was a good decision. 8. DISCUSSION OF INTERIM CITY MANAGER Mayor Massad advised Council of what each of the potential Interim City Managers wanted with regard to salary and allowances. Those interested were Mr. Jim Mathieu and Mr. James Gabbard. He stated that he personally new Mr. Mathieu and that he had not only worked as the City Attorney, he also served as the Interim City Manager in the past. Page 5/6 CCM 4/26/2016 Minutes
6 Councilman Rowe said he had heard nothing but positive praises regarding Mr. Jim Mathieu. Councilwoman Britton said the she obviously though Mr. Mathieu was great but she lives with Mr. Mathieu and in the past she was treated negatively in the newspapers and by the citizens because of her relationship with Mr. Mathieu. She advised that she had nothing to do with the decision last time or would she this time and had recused herself at a previous meeting from voting on this issue. Mayor Massad advised that he owned real estate with Mr. Mathieu and would also not be voting on the issue and he too had recused himself from doing so. There was addition brief discussion on the Interim City Manager candidates. MOTION; Vice Mayor Rowe made a motion to approve Mr. Jim Mathieu as the Interim City Manager. Councilman Dittmer seconded the motion. All were in favor with the exception of Councilwoman Britton and Mayor Massad who had recused themselves from voting. ADJOURN Mayor Dale Massad thanked City Manager Tom O'Neil for all the work he had done for the City. City Manager O'Neill thanked Council for the opportunity to serve the City and was happy that he had the chance to get many things completed during his employment. Councilwoman Britton also thanked Mr. O'Neill for all his work. Vice Mayor Rowe made a motion to adjourn. Councilman Dittmer seconded the motion. All were in favor.
